Approval of Variance Request #002-88 of Thomas G. and Rosalee F. Adams for a 13
foot rear yard variance for a 24' x 50' residential addition at the first
residential house on the right side of Fay street from Route 11 South of
Winchester, in the Back Creek Magisterial District.

BACKGROUND INFORMATION - The applicant wishes to construct a 24' X 50' residential
addition to the existing house. The RP (Residential Performance) Zoning Code
requires a 25' rear yard setback for residential structures. This addition is
proposed to be 12' from the rear yard, requiring a 13' variance.
STAFF COMMENT - A building permit is required prior to construction.

THIS DEK), made this 27th day of November, 1959, between Leon V.�
Watson and Lorraine B. Watson, his wife, parties of the first part, hereinafter
called the Grantors, Thomas G. Adams and Rosalie F. Adams, his wife, partles of the;'
second part, hereinafter called the Grantees, and FhiLip H. Sprenkle and Kathryn G.
Sprenkle, his wife, parties of the third part, hereinafter called Sprenkles.
WITNESSETH: That for and in consideration of the sum of Ten
Dollars ($10.00), cash in hand paid and other valuable consideration, receipt where
of is hereby acknowledged, the Grantors do grant and convey unto the Grantees, as
tenants by the entirety, in fee simple, with survivorship as at common law, togethej
with all rights, privileges and appurtenances thereunto belonging, all of those
certain lots or parcels of land, lying and being situate in Shawnee Magisterial
District, Frederick County, Virginia, about one mile Southwest of Kernstown, on the
Western side of U. S. Highway No. 11 in what is known as Beatty's "Hanover Lodge
Subdivision", a plat of which is of record in the Office of the Clerk of the Circui
Court of Frederick County, Virginia in Deed Book 202, at Page 382, as follows, to -
wit:
(1) Lots No. 18, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32,
33, 34, 35, 36, 37, 38, 392 40 and 41 in Block A of said subdivision.
(2) Lots No. 1, 2, 3, 4, 52 6, 7, 8, 9, 10, 11, 12, 132 14, 15,
16, 17, 182 19, 20, 21, and 22 in Block C of said subdivision.
(3) Lots No. 11, 12, 13, 13A, 14, 14A, 15, 16, 17, 18, 19, 20,
21 and 22 in Block D of said subdivision.
The aforesaid lots are a part of the real estate acquired by the
Grantors herein by deed from Wilbur 0. Riley, et al, dated April 18, 1953, and duly
recorded in said Clerk's Office in Deed Book 227, at Page 251, the lots herein con-
veyed being identified therein as Parcels 1, 3 and 4, and further being all of the
lots now owned by the Grantors in Blocks A, C and D of said subdivision.
A reference to the aforesaid deed and plat and to the references
therein contained is here made for a further and more particular description of the
land hereby conveyed.
This conveyance is made subject to the legally enforceable re-
strictive covenants, if any, against said realty and the easements of record, if
any, against said realty.
The Sprenkles, parties of the third part, join in the execution
of this deed for the purpose of assenting to and acknowledging, and do hereby assen
to and acknowledge, the existence of an easement and right of way 50 feet in width
for a street over and across the Sprenkle land, said street being located as shown
on that certain plat of "Hanover Lodge Subdivision", recorded as aforesaid. The
land herein referred to as the Sprenkle land, which is subject to the aforesaid
easement and right of way, is the identical land acquired by Philip H. Sprenkle by
deed from W. 0. Beatty, et ux, dated February 6, 1948 and duly recorded in the afore-
said Clerk's Office in Deed Book 204, at Page 142. Said easement and right of way
exist in favor of the Grantees herein, the lot owners of "Hanover Lodge Subdivision "
their heirs and assigns.
The Grantors covenant that they have the right to convey said
realty to the Grantees; that the Grantees shall have quiet possession thereof', free
