REASON FOR VARIANCE - Due to the shape of the lot, inability to park on the
circle, lot drop-off on the left, and existing driveway on the right. Because of
the shape of the lot and location of the house, the garage variance is needed to
locate the garage on the right side of the.house.
BACKGROUND INFORMATION - The applicant wishes to construct a 16 foot garage on the
right side of the existing lot. A ten foot side yard is required for attached
garages in the RP (Residential Performance) Zoning District, such as this
proposal. Currently, there is a 16.2 foot side yard, therefore, a 9.2 foot
variance is needed to construct the garage.
STAFF COMMENT - Prior to construction, an approved building permit is needed.

THIS DEED made and dated this 22nd day of June, 1978,
by and between THE ROUSS COMPANY, I'NC., a Virginia Corporation,
party of the first part, hereinafter called the Grantor, and
JAMES THURSTON NICKENS and GIENDOLYN SHAT^]N NICKENS, his wife,
parties of the second part, hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum of
Ten ($10.00) Dollars, cash in hand paid, and other good and valu-
able consideration, the receipt of which is hereby acknowledged,
the Grantor does hereby grant and convey with general warranty of
title.unto the Grantees, in fee simple, as tenants by the entiret
with common law right of survivorship, all of that certain lot or
parcel of land, together with the improvements thereon and the
appurtenances thereunto belonging, lying and being situate in
Shawnee Magisterial District, Frederick County, Virginia, and more
particularly described as Lot 25, Section 5, of Green Acres Sub-
division, as the same appears on that certain plat of said Sub-
division drawn by H. Bruce Edens, C. L. S., dated October 28,
1971 of record in the Office of the Clerk of -the Circuit Court
of Frederick County, Virginia in Deed Book 386 at Page 537, and
further described by plat of survey drawn by H. Bruce Edens,
C. L. S., dated January 13, 1978, attached hereto and by this
reference made a part hereof as if set out in full, and being a
portion of the same land conveyed to the Grantor herein by deed
date6 June 21, 1977, from James R. Wilkins, Inc., of record in the
aforesaid Clerk's Office in Deed Book 475 at Page 626. Reference
is made to the aforesaid plats and deed for a more particular
description of the property herein conveyed.
This conveyance is made subject to all easements, rights
of way and restrictions of record affecting the subject property.
The Grantor does hereby covenant that it has the right to

rate Charter or By -Laws reserves the power unto the stockholders
to convey a part of the corporate real property.
