Dear Mr. Koerner:
The above -referenced site plan was approved on July 31, 2018. The site plan is approved for a 138-
foot (FT) tall telecommunications monopole and ground -mounted equipment compound in the RA
(Rural Areas) Zoning District in the Back Creek Magisterial District located at 201 Round Hill Road,
Winchester.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. Attached are three (3) copies of
the approved site plan by the Zoning Administrator. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and
an approved copy must be kept on the construction site throughout the development process. Once
site development is complete, the owner(s) should contact this office to schedule an on -site inspection.

On behalf of the Winchester Regional Airport Authority I offer the following comments on the above referenced
application for a conditional use permit for construction of a 138' monopole. Based on the specifications
included with the application the structure will have a max height of 142' to accommodate wireless equipment.
1. Our office has received a copy of the completed aeronautical study your firm filed in accordance
with the Code of Virginia, Section 15.2-2294 and Federal Title 14 of the Code of Federal
Regulations CFR Part 77, with the Federal Aviation Administration for an airspace study analysis.
2. Cranes and/or temporary construction equipment exceeding the maximum height provided by the
applicant will require separate filing with the FAA for review and comment prior to start of
construction as noted on sheet GN-2 of the site plans.
3. Any and all requirements specified by the FAA in the final airspace determination must be complied
with at all times and should be included in all construction specification documents.
4. For continued safe and efficient operations of all aircraft and helicopters transitioning through the
airspace of the Winchester Regional Airport, the Authority requests the tower be lighted in
accordance with FAA Advisory Circular 70/7460-1 L, Change 1, double steady -burning light (L-810)
as a condition of approval by Frederick County and clearly identified on the site plans.
Provided all conditions are met, the Winchester Regional Airport Authority has no objections to the proposed
Site Plan.

Structure shall comply with The Virginia Uniform Statewide Building Code and Section 312, use
group U (Utility and Miscellaneous) of The .International Building Code 2012.
Per the Section 102.3 of the Virginia Uniform Statewide Building Code, 2012 edition,
Section 102.3 VUSBC exempts equipment, related wining, and poles and towers supporting the related
wiring installed by a provider of publicly regulated utility service.....The exemption shall apply only if
under applicable federal and state law the ownership and control of the equipment and wiring is by the
service provider or its affiliates. Such exempt equipment and wiring shall be located on either public
rights -of -way or private property for which the service provider has rights of occupancy and entry;
however, the structures, including their service equipment, housing, or supporting such exempt equipment
and wiring shall be subject to the USBC. The installation of equipment and wiring exempted by this
section shall not create an unsafe condition prohibited by the USBC.
Construction of Pre Engineered Modular 12'6" x 27 shelter requires a building permit. Plans
submitted shall be sealed by a Virginia Registered Design Professional
An electrical permit is required for the generator and any additional electric or alteration thereof.
Please note the requirements in Chapter 17 of the IBC for special inspections for this type of
structure. (soil, concrete, bolts, etc.)

VDOT conducted a review of the Shenandoah Mobile, LLC (Amherst Site) site
plan with a submittal date of April 26, 2018. Based on the review of the
drawings, the existing entrance from Route 803 is adequate for the proposed
tower site. Should the business ever expand in the future, the existing
entrance may need to be upgraded. Please ensure that all applicable agencies
have the most recent set of approved drawings.
We offer the following general comments:
• Our review and comments are general in nature. Should details have
been overlooked during plan review or conditions in the field exist such
that additional measures are warranted, such measures will be completed
to the satisfaction of the department.
• Materials used and methods of construction shall adhere to the current
observed VDOT Road and Bridge Specifications, Road and Bridge
Standards, Manual on Uniform Traffic Control Devices, and Land Use
Permit Special Provisions.
• All drainage will be carried within the right-of-way in ditch lines or
gutters along the street to a pipe or drainage easement.
• Any construction related changes to the approved plan must come
through the design engineer to VDOT for approval. Please allow a
minimum of 5 business days for VDOT review.
• A Land Use Permit shall be obtained before any work is performed on the
State's right-of-way. The permit issued by this office and may require
application fees, the salary & expenses of a State assigned inspector, and
surety bond coverage.

Dear Sir:
This letter is to confirm action taken by the Frederick County Board of Supervisors at
their meeting on March 14, 2018. Conditional Use Permit #09-17 was approved to
construct a 138-foot monopole Type Commercial Telecommunication Facility. Further
conditions associated with the approval of the Conditional Use Permit include the
following:
1. All review agency comments and requirements shall be camplied with at all times.
2. The tower shall be available for collocating personal wireless services providers.
3. A minor site plan shall be approved by Frederick County.
4. The tower shall be removed by the Applicant or property owner within twelve
(12) months of abandonment of operation.
5. In the event a telecommunications tower is not erected within t-vvelve (12) months
of the approval of this Conditional Use Permit, the CUP will be deemed invalid.
6. Any expansion or modification of this use will require a new Conditional Use
Pen -nit.
The Board of Supervisors found the waiver to the required setback acceptable, a motion
to recommend approval of the setback reduction of 69' to allow the tower to be 134' from
the identified property.

plan has been revised to address the Staff's comments. Please find the Staff's comments with our reply

granted. This site plan cannot be approved until the issues in this letter, as well as all issues
of the other review agencies, have been adequately addressed. Please review Staff s

This letter is to confirm action taken by the Frederick County Board of Supervisors at
their meeting on March 14, 2018. Conditional Use Pen -nit #09-17 was approved to
construct a 138-foot monopole Type Commercial Telecommunication Facility. Further
conditions associated with the approval of the Conditional Use Permit include the
following:
1. All review agency comments and requirements shall be complied with at all times.
2. The tower shall be available for collocating personal wireless services providers.
3. A minor site plan shall be approved by Frederick County.
4. The tower shall be removed by the Applicant or property owner within twelve

I have requested our A&E firm to send 2 — 24x36 size plans to your attention.
Included in this packet is the check to cover the fee, a copy of the site plan application,
a copy of the site application checklist, a copy of the CUP #09-17 approval letter and a
copy of the signed power of attorney. Mark had indicated that the original that was
submitted for the CUP was sufficient as long as it covered the site plan submission.
