All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the

Buildings shall comply with The Virginia Uniform Statewide Building Code and Sections 311, S
Storage) and Section 304, B-Business of the International Building Code/2009. Other Code that
applies is ICC ANSI Al 17.1-3-03 Accessible and Usable Buildings and Facilities and 2009
International Energy Code.
Proposed 640 sq ft , B-Business; Office addition shall meet height and area as required per T503
for type of construction. Building shall comply with IBC/USBC 903.2.9 for sprinkler
requirements.
At least one parking area is required to be a Van Accessible space as required in USBC Sec
1106. A minimum of 8' parking is provided, therefore, a minimum of 8' of striped unloading is
required. Unloading area shall have a maximum 2% slope. Van accessible signage shall be
provided as required per USBC Sec 1106.8. Walkway and accessible route to main entrance
shall not exceed 5% slope. Accessible route through traffic area should be stripped or identified
Landing at doors shall not exceed 2%
At least 60% of all entrances shall be accessible. Landings at doors shall not exceed 1:48 slope
and thresholds shall not exceed '/2". Exit doors appear to be in compliance with location,
quantity, etc.
Building shall comply with 2009 International Energy Code. All systems shall be included in the
evaluation of the building performance.
All structural plans submitted for permit application shall be sealed by a VA Design Professional.
Please note the requirements in Chapter 17 of the IBC for special inspections for this type of
structure. (soil, concrete, bolts, etc.)

Buildings shall comply with The 2012 Virginia Uniform Statewide Building Code and the

An asbestos permit/inspection is required for buildings constructed prior to 1985
ANSI A117.1-09 20% rule applies. Twenty percent of the cost of construction for the addition
shall be spent toward Accessible features per ANSI Al 17.1-09 and the existing building code

RE: Recent Building Addition Experience
Dear Mr. Phelps:
Thank you for meeting with Brenda Garton and me on June 29, 2015 regarding your
recent experience securing site plan and building permit approvals to facilitate the
construction of a building addition to your Winchester Metals facility on Ebert Road.
Your letter dated June 22, 2015 certainly illustrated your frustration with the approval
process, and I am hopeful that our meeting calmed some of those frustrations. The
County is always looking to improve our communication, coordination, and process, and
will use your experience and comments to improve our services
Reflective of our discussion, as well as the discussion you had with our Building Official,
John Trenary, the county will continue to:
• Promote the use of our existing Technical Review Committee (TRC).
o As captured from our website - "The purpose of the Technical Review
Committee (TRC) is to allow all agencies involved in the review process
(i.e., site plans, master development, subdivision plans, etc.) an
opportunity to comment on requirements. This is to help streamline the
review process once a project has been submitted to the appropriate

review agencies for their comments and approval. Please note that this is
not a formal review process". I have attached a brochure about the TRC.
o Encourage commercial property owners, their engineers and contractors,
to utilize the TRC at a project's inception so that all county and property
owner representatives understand the intent of a project and associated
regulations.
o Utilize the TRC so as to minimize design conflicts between a project's
vision and the various state and local regulations. This coordinated effort
could also facilitate design revisions. Often state and federal regulations
(state building and fire prevention regulations, and the federal ADA
regulations) may be addressed, and value engineered through
coordinated planning, and the TRC offers an environment to foster the
discussion.
o Include the TRC opportunity on commercial building permit applications.
The TRC is already referenced in various development process application
packages including rezoning, subdivision, and site plan. As a result of our
discussion, the TRC opportunity has been added to commercial building
permit application packages.
• Offer on -site preliminary evaluations of existing buildings to discuss the various
state and local building regulations that will be applicable to a proposed
commercial addition.
• Encourage county staff to offer value engineering design suggestions that could
result in improvements to a project's design and costs. For example, identify
building materials that could be utilized so as to avoid additional regulatory
design features such as a firewall.
• Encourage county staff to offer alterative design solutions when a regulation
may appear unreasonable reflective of the scale of the planned improvement.
Many of the above initiatives are already in place, and have been for years. The key
improvement is to better inform property owners and their consultants, to promote
business development through a proactive approach of assisting and suggesting design
alternatives when appropriate.

It is important to note that communication is vital to the success of any organization,
public or private. While the county is open to communication, in commercial
development settings the county generally only has an opportunity to communicate
with a property owner's contractor and engineer; rarely do commercial property owners
contact the county directly. So what results is a communication channel between the
county and contractor/engineer, but no communication between the county and
commercial property owner. We expect that a property owner and his
contractor/engineer will communicate about the project, its progression, hurdles, and
alternatives to improve the outcome. The county will continue to be available to listen
and learn from a property owner's experiences and conversely, share with the property
owner avenues for value engineering savings and benefits.
Thank you again for sharing your experience with us, and assisting us improve our
development review and building permit process.

Technical Review Committee
The Technical Review Committee
(T.R.C.) convenes on the first and third
Thursday of each month. Any and all
projects to be included on the TRC
agenda shall be submitted to Rhonda
Sargent, of the Public Works Department
at 540-665-5643 (extension 3) no later
than noon Monday the week of the
scheduled meeting.
The purpose of the TRC is to allow all
agencies involved in the review process
(i.e., site plans, master development,
subdivision plans, etc.) an opportunity to
comment on requirements. This is to help
streamline the review process once a
project has been submitted to the
appropriate review agencies for their
comments and approval. Public works is
responsible for contacting the review
agencies.
This is not a forma/review process.

This may be a can of worms I'll wish I hadn't opened but I feel I must tell this
story because the experiences I've had the past year in Frederick County need serious
attention. I'm not alone. Many I've spoken with have shared my experiences but, maybe
in order to not cause a stir, have just accepted this reality and moved on. I'm not willing
to do that in the community I grew up in, now live and work and am raising a family.
Our eompany is celebrating 40 years; business this year and I spent 1.0 ,years on the
(former) Economic Development Commission helping to formulate strategies to recruit
new business to this area. That is the foundation I come from in the following remarks.
Please understand my intention is not to solely complain, (although that is a component),
but to ask that you as the leaders of this community seek to make sure this isn't the
normal course of business in Frederick County any more. I apologize for the length in
advance but the full story takes some time. I will say the following in advance to prevent
anyone from becoming defensive or accusing me of anything other than presenting facts.
One, at no time was anyone on county staff rude, or overtly difficult to work with. Two,
our contractor is an established entity with years of commercial and residential
experience here and in the surrounding areas (as far as Washington, DC).
In February of 2014, we made a decision to add a small office addition for some
of our estimators because their workspace had become worn out, dated, and
unproductive. We came up with a 640 sq ft design, 16' x 40' to add to our existing
warehouse. Just a shell, metal roof and sides, a few windows and doors, concrete floor
and lights. No interior walls, no plumbing, basically a glorified walk-in closet. As I
write this letter 16 months later, we are just now getting footers in the ground. What
happened between then and now would be the basis of a good comedy if it weren't true.
We had an initial quote of $68,000 for the project. We decided that fit our budget
and got approval from the bank to finance it. We were hoping to be in .before fall. When
our contractor event to apply for permits, he found out we needed a site plait for this
project because of it being on commercial property. We had a master development plan
from some years prior so we were able to do a minor site plan to make sure we met
setback requirements, etc. Add unexpected engineering fees and 3 weeks or so here, mid
August. The plan was done and submitted by mid -October. On October 311 asked for
status, nothing new had happened with our plan. Then, early November we found out the
comments from the fire marshall's office about the building not meeting requirements for
a hydrant location within 300 feet of all corners of the building. They were correct, it did
not. We're about 4 miles or so from Clearbrook Fire department and I don't know in our
40 years in business if we've ever managed to need their services considering we work in
concrete or metal buildings in a steel fabrication and processing business where our
product is hard to catch on fire even if we tried, but in Frederick County, apparently code
is code.

So we began investigating installing a hydrant within the guidelines of the county
so we could proceed with our 640 sq foot building. We're now into mid -November.
More engineering. A hydrant costs around $12,000. But it has to be located a certain
way. In our case that meant adding roadway, or digging a lot of ditch, burying piping,
etc. (even though propane trucks and other heavy trucks traverse that part of the property
regularly, a fireman hauling a hose or a fire truck cannot) Several thousands of dollars
either way. We had accepted that this was just the added costs we'd have to absorb until
the FCSA got involved. After finding out that the water to the new hydrant had to come
through meters which had to be in buried water vaults, we just stopped. This was
December. The costs started to get so astronomical as to make us just decide the project
wasn't worth it. Looking back, the added costs to us above our original estimate were
closing in on $75-$90,000. More than double our initial cost estimate and we're not even
sure we got all of it added in. The FCSA issues would require a separate letter entirely.
We decided in January of 2015 to just reloi;ate the office to the backside of our
warehouse where we had an existing fire hydrant. Horrible location for logistical and
customer service reasons but, problem solved, so we thought. At some point during this
new proposal, the notion that customers would be accessing this 640sq ft space came up
(I honestly don't know specifically where this arose, not that we ever hid that fact) which
meant our facility had to be ADA compliant. We had an existing ADA compliant
bathroom in our shop but to get there meeting the ADA requirements from our office
would've required the sacrifice of vital production space, so we chose to just add a
bathroom in the new office. Add about $7,000 here not to mention the cost of ADA
parking spaces. (I know this is a federal requirement but it just adds to the hilarity of this
story).
Even though we have an existing roadway around the back of our building for
truck traffic, apparently our road still needed to be widened to accommodate whatever
new traffic we'd be getting, average maybe 2 vehicles/day going a maximum of 10-12
miles/hr.
We also found out that fire code says we'd need a fire wall between the existing
building and the new office. Again, an existing metal building that houses a metal
fabrication shop with concrete floors had to have a fire wall when connected to a metal
sided building with a concrete floor, housing people (who I have to assume are not
.flammable.) Also, we had to put.2 layers of 5/8" drywall as fire retardant below the truss
and above our proposed drop ceiling (the truss being the only wood, it was under a metal
roof, against a metal sided wall). Getting this engineered and explained to the
satisfaction of inspections added another 3 or so weeks to our project starting. Our
builder showed more patience than most should be expected to display. Of course in the
fire -wall we needed an access door to our shop which needed a 3 hour rating (again
because we're 4 miles from a fire department) which added another $2,000 or so.
Finally, after many months, we had the pre -construction meeting on -site for our
640sq ft office with all subs (basically everyone said hello to each other for 20 minutes
while the inspector and our builder looked at prints) and had permits in hand. This was
toward the end of May, 2015. After the final tally, our project now will cost us about
$�128,000 or $60,000 more than our planned spend. We've decided to proceed because
we value the comfort of our employees and customer experience enough that we felt it
was worth it. Construction began June 8, 2015. This project was never going to

create/add jobs for us or add so much property value that the county was going to reap
the benefits. It was just something for us to improve the quality of the environment for
our staff and customers. What we instead ended up with was a project that almost
WINCNFsran doubled in cost, took 15 months just to move the first piece of dirt and is now a joke
METALS= amongst those of us that have been involved in this from the beginning.
Suggested solutions? Here's a few:
• LEAN training via LFCC for staff in planning, inspections, etc to learn to
spot unnecessary steps in processes and streamline it entirely
• Customer service training for said staff and a reminder how a county is
funded, by taxpayers and businesses who choose to exist within its borders
• At the beginning of a project, there needs to be a single place where a
customer (a non -developer) can go to know all the things that have to be
done on their project. A 20-30 minute meeting with
planning/fire/inspection in March of 2014 would've saved us a year's
worth of headaches and probably thousands of dollars
• Proactive rather than reactive staff. As soon as this project started hitting
roadblocks, someone from staff should've taken the initiative to visit our
site, find solutions to help us get this building built rather than just waiting
for us to send thing in and rejecting/altering/etc. Our engineers and
builders were hand delivering things to the county offices toward the end,
it seems like this was a huge waste of time. Sadly, this probably seemed
normal to staff so nobody even thought anything was wrong
• The initial approach by staff MUST be, "how can I help you make this
happen" but from the outside it feels more like "jump through my hoops
or it's not going to happen."
• Be the opposite of the DMV
• When I hear of a large project being "fast -tracked," it makes my blood
boil. What does that mean? How do I get on that list? Why wouldn't all
projects be fast -tracked?
As I was writing this letter, I found out that a project near us received a waiver on
its requirement to have a fire hydrant. This waiver saved that project $150,000. That
person fought/complained and staff visited the site and granted the waiver. Why did they
have to even do that? Why not just visit the site right away? A visit to our site probably
would've saved us too but that was never mentioned and, wanting to just get this thing
done and not ruffle feathers, we didn't ask. I'm glad for my colleague, but we paid the
price. I know another project that got squashed when they found out about the fire
hydrant, metered -vault issue. This guy was going to invest about $10 million in a
manufacturing plant. He's looking elsewhere. I wonder how many other stories out there
we don't even know about.
Thank you for your time reading this letter. It is one I wish I'd never had the urge
to write. If you can believe it, I've actually kept it short. I didn't go into our rezoning
experience from the mid-2000's or what it took to get permits to demolish an old house.
Not specifically mentioned are the weeks of non -communication from staff back to our
contractor or engineers. It goes without saying that if we ran our business this way, we
wouldn't exist anymore. For now you've lost a former cheerleader of this county's

August 2014. Building permit applied for. Applicant- Lodge Construction — was advised that a minor site
plan would be required for the industrial use.
August 2014. In response to an inquiry from Josh Phelps, and through various exchanges via telephone
and e-mail, Planning (Eric Lawrence) advised Mr. Phelps that indeed a minor site plan would be required
to construct a proposed office addition along the front right of existing building. Setbacks were
discussed, and concluded that while close, the addition appears to meet setback requirements.

April 2015. Inspections (Amy Feltner) met on site with contractor. Discussed requirements of building
code. Amy learned of the wood frame construction the contractor planned to use; raised firewall
requirements. Amy suggested the contractor consider a metal addition to minimize firewall
requirements. Contractor indicated that the addition would be an office accessible to customers, and
that parking would be established. Amy suggested that contractor contact Planning as the site plan did
not account for parking. Appeared ADA requirements were being addressed by engineer.
April 2, 2015. Planning (Candice Perkins) provides comment to Pennoni:
"the contractor came in for their permit and they stated to Inspections that it will be for an office. Now
that's fine, but it's open to the general public and they stated they wanted parking spaces back
there. Parking was never discussed regarding the addition, they will need to add that to the site plan".

Couple of points :
1. For over 20 years the county has required that all exterior points on a commercial building be
within 300 ft. of a fire hydrant. Initially via County Code, and then in 2012 county adopted
Virginia Statewide Fire Prevention Code
2. Fire Marshal may, and has, provided waivers to the 300ft when circumstance deems it
appropriate. Recently an asphalt plant on Ebert Road (close proximity to Winchester Metals)
received the waiver. Reasoning behind the waiver was that the site already has 2 hydrants yet
limited buildings. And the new use was an asphalt plant with clear access. Most importantly,
FCSA requirements for the new hydrant would have cost $130,000 to bring a hydrant 70 ft.
closer to meet the 300ft distance requirement.
3. Fire Marshal simply determines where hydrants need to be located to meet distance/service
access requirements. FCSA establishes construction and equipment requirements to maintain
adequate flows and line pressure.
4. Winchester Metal's site plan/building permit requirements are being held to the same standards
as everyone else. If contractor/engineers were on top of things, they should have been aware
that a site plan was needed. Ordinance clearly states that there is no commercial or industrial
construction without an approved site plan.
5. There is no approved Master Plan for the Winchester Metal property. Pennoni drafted one a
couple of years ago but it was never formally submitted (Planning still has it in draft form).
6. The site plan application never showed the addition as an office, it showed warehouse
addition. From my understanding the customer service office conversation was brought up to
inspections during an onsite inspection and that's when the ADA issue came up. The revised site
plan to accommodate the parking was allowed without fee, to make the site compliant.
7. If Pennoni or the applicant had questions they could have scheduled a TRC where everyone
could have talked about the project. All local engineers (Pennoni and Painter -Lewis included)
have used TRCs. Property owners can also schedule TRC's, his contractor could have scheduled
a TRC.

All,
This may be a can of worms I'll wish I hadn't opened but I feel I must tell this
story because the experiences I've had the past year in Frederick County need serious
attention. I'm not alone. Many I've spoken with have shared my experiences but, maybe
in order to not cause a stir, have just accepted this reality and moved on. I'm not willing
to do that in the community I grew up in, now live and work and am raising a family.
O,ar compa-ny is celebrating 40 vears in business this year and I spent 10 years on the
(former) Economic Development Commission helping to formulate strategies to recruit
new business to this area. That is the foundation I come from in the following remarks.
Please understand my intention is not to solely complain, (although that is a component),
but to ask that you as the leaders of this community seek to make sure this isn't the
normal course of business in Frederick County any more. I apologize for the length in
advance but the full story takes some time. I will say the following in advance to prevent
anyone from becoming defensive or accusing me of anything other than presenting facts.
One, at no time was anyone on county staff rude, or overtly difficult to work with. Two,
our contractor is an established entity with years of commercial and residential
experience here and in the surrounding areas (as far as Washington, DC).
In February of 2014, we made a decision to add a small office addition for some
of our estimators because their workspace had become worn out, dated, and
unproductive. We came up with a 640 sq R design, 16' x 40' to add to our existing
warehouse. Just a shell, metal roof and sides, a few windows and doors, concrete floor
and lights. No interior walls, no plumbing, basically a glorified walk-in closet. As I
write this letter 16 months later, we are just now getting footers in the ground. What
happened between then and now would be the basis of a good comedy if it weren't true.
We had an initial quote of $68,000 for the project. We decided that fit our budget
and got approval from the bank to finance it. We were hoping to be in before fall. When
our contractor event to apply for permits, he found out we needed a site plan for this
project because of it being on commercial property. We had a master development plan
from some years prior so we were able to do a minor site plan to make sure we met
setback requirements, etc. Add unexpected engineering fees and 3 weeks or so here, mid
August. The plan was done and submitted by mid -October. On October 311 asked for
status, nothing new had happened with our plan. Then, early November we found out the
comments from the fire marshall's office about the building not meeting requirements for
ahydrant location within 300 feet of all corners of the building. They were correct, it did
not. We're about 4 miles or so from Clearbrook Fire department and I don't know in our
40 years in business if we've ever managed to need their services considering we work in
concrete or metal buildings in a steel fabrication and processing business where our
product is hard to catch on fire even if we tried, but in Frederick County, apparently code
is code.

So we began investigating installing a hydrant within the guidelines of the county
so we could proceed with our 640 sq foot building. We're now into mid -November.
More engineering. A hydrant costs around $12,000. But it has to be located a certain
way. In our case that meant adding roadway, or digging a lot of ditch, burying piping,
etc. (even though propane trucks and other heavy trucks traverse that part of the property
regularly, a fireman hauling a hose or a fire truck cannot) Several thousands of dollars
either way. We had accepted that this was just the added costs we'd have to absorb until
the FCSA got involved. After finding out that the water to the new hydrant had to come
through meters which had to be in buried water vaults, we just stopped. This was
December. The costs started to get so astronomical as to make us just decide the project
wasn't worth it. Looking back, the added costs to us above our original estimate were
closing in on $75-$90,000. More than double our initial cost estimate and we're not even
sure we got all of it added in. The FCSA issues would require a separate letter entirely.
We decided in January of 2015 to just relocate the office to the backside of our
warehouse where we had an existing fire hydrant. Horrible location for logistical and
customer service reasons but, problem solved, so we thought. At some point during this
new proposal, the notion that customers would be accessing this 640sq ft space came up
(I honestly don't know specifically where this arose, not that we ever hid that fact) which
meant our facility had to be ADA compliant. We had an existing ADA compliant
bathroom in our shop but to get there meeting the ADA requirements from our office
would've required the sacrifice of vital production space, so we chose to just add a
bathroom in the new office. Add about $7,000 here not to mention the cost of ADA
parking spaces. (I know this is a federal requirement but it just adds to the hilarity of this
story).
Even though we have an existing roadway around the back of our building for
truck traffic, apparently our road still needed to be widened to accommodate whatever
new traffic we'd be getting, average maybe 2 vehicles/day going a maximum of 10-12
miles/hr.
We also found out that fire code says we'd need a fire wall between the existing
building and the new office. Again, an existing metal building that houses a metal
fabrication shop with concrete floors had to have a fire wall when connected to a metal
sided building with a concrete floor, housing people (who I have to assume are not
flammable.) Also, we had to put.2 layers of 5/8" drywall as fire retardant below the truss
and above our proposed drop ceiling (the truss being the only wood, it was under a metal
roof, against a metal sided wall). Getting this engineered and explained to the
satisfaction of inspections added another 3 or so weeks to our project starting. Our
builder showed more patience than most should be expected to display. Of course in the
fire -wall we needed an access door to our shop which needed a 3 hour rating (again
because we're 4 miles from a fire department) which added another $2,000 or so.
Finally, after many months, we had the pre -construction meeting on -site for our
640sq ft office with all subs (basically everyone said hello to each other for 20 minutes
while the inspector and our builder looked at prints) and had permits in hand. This was
toward the end of May, 2015. After the final tally, our project now will cost us about
$128,000 or $60,000 more than our planned spend. We've decided to proceed because
we value the comfort of our employees and customer experience enough that we felt it
was worth it. Construction began June 8, 2015. This project was never going to

create/add jobs for us or add so much property value that the county was going to reap
the benefits. It was just something for us to improve the quality of the environment for
our staff and customers. What we instead ended up with was a project that almost
WINCNMan doubled in cost, took 15 months just to move the first piece of dirt and is now a joke
METALS= amongst those of us that have been involved in this from the beginning.
Suggested solutions? Here's a few:
• LEAN training via LFCC for staff in planning, inspections, etc to learn to
spot unnecessary steps in processes and streamline it entirely
• Customer service training for said staff and a reminder how a county is
funded, by taxpayers and businesses who choose to exist within its borders
• At the beginning of a project, there needs to be a single place where a
customer (a non -developer) can go to know all the things that have to be
done on their project. A 20-30 minute meeting with
planning/fire/inspection in March of 2014 would've saved us a year's
worth of headaches and probably thousands of dollars
• Proactive rather than reactive staff. As soon as this project started hitting
roadblocks, someone from staff should've taken the initiative to visit our
site, find solutions to help us get this building built rather than just waiting
for us to send thing in and rejecting/altering/etc. Our engineers and
builders were hand delivering things to the county offices toward the end,
it seems like this was a huge waste of time. Sadly, this probably seemed
normal to staff so nobody even thought anything was wrong
• The initial approach by staff MUST be, "how can I help you make this
happen" but from the outside it feels more like "jump through my hoops
or it's not going to happen."
• Be the opposite of the DMV
• When I hear of a large project being "fast -tracked," it makes my blood
boil. What does that mean? How do I get on that list? Why wouldn't all
projects be fast -tracked?
As I was writing this letter, I found out that a project near us received a waiver on
its requirement to have a fire hydrant. This waiver saved that project $150,000. That
person fought/complained and staff visited the site and granted the waiver. Why did they
have to even do that? Why not just visit the site right away? A visit to our site probably
would've saved us too but that was never mentioned and, wanting to just get this thing
done and not ruffle feathers, we didn't ask. I'm glad for my colleague, but we paid the

hydrant, metered -vault issue. This guy was going to invest about $10 million in a
manufacturing plant. He's looking elsewhere. I wonder how many other stories out there
we don't even know about.

to write. If you can believe it, I've actually kept it short. I didn't go into our rezoning
experience from the mid-2000's or what it took to get permits to demolish an old house.
Not specifically mentioned are the weeks of non -communication from staff back to our
contractor or engineers. It goes without saying that if we ran our business this way, we
wouldn't exist anymore. For now you've lost a former cheerleader of this county's

In looking at the materials you forwarded, and at the attached plat from 2009, 1 can conclude two things:
1- A minor site plan will be required to establish a building office addition you so desired (40x16).
2- Setbacks maybe an issue. This addition will need to beat least 25-feet from the property line. In looking at the
plat (attached), you don't have much distance to build in.
So, you need to determine that you will still comply with the 25-foot setback requirement after the addition is
constructed; suggests that the existing building needs to be at least 42 feet from property line to accommodate the
planned addition. Once you ascertain that you have adequate distance to accommodate the addition, you will need to
create a minor site plan. I am not finding a site plan in my files, so you may need to start from scratch if you don't have
one for your internal use.
I've copied Candice Perkins should you have questions about what elements need to be included on the minor site
plan. Candice manages the county's site plan process.

REMARKS: Perimeter Continuous Wall Footings Inspection:
- The perimeter, continuous wall footings for the above -referenced project were inspected on this
date. The footings were excavated to the appropriate dimensions and depth in accordance with the
approved building plans, as prepared by this office. The soil subgrade was solid, found to be
satisfactory for use, and provided proper frost protection. The reinforcing steel and connecting
dowels were in place and were resting on metal chair supports for pouring. The contractor was
instructed to clean some soft soil material that had fallen into the bottom of the excavation and
epoxy a couple of loose dowels to ensure that the footings were installed as designed. The loose
material was removed and the dowels were properly installed by the contractor.
- The perimeter, continuous wall footings were approved on this date.

Site plan coorespondence history
June 25, 2015
August 2014. Building permit applied for. Applicant- Lodge Construction — was advised that a minor site
plan would be required for the industrial use.
August 2014. In response to an inquiry from Josh Phelps, and through various exchanges via telephone
and e-mail, Planning (Eric Lawrence) advised Mr. Phelps that indeed a minor site plan would be required
to construct a proposed office addition along the front right of existing building. Setbacks were
discussed, and concluded that while close, the addition appears to meet setback requirements.
October 10, 2014. Site plan submitted to Inspections for review.
October 29, 2014. Site plan approved by Inspections.
October 2014. Site plan submitted to Fire Marshal for review
October 2014. Fire Marshal's Office (Ken Scott) issued comment; fire hydrant exceeded 300ft distance
from addition
October 14, 2014. Site Plan submitted to Planning for review.
October 20, 2015. Planning (Candice Perkins) provides site plan review comment to Pennoni. "I have
reviewed the plan and don't have any comments. I need approval comments from Inspections and the
Fire Marshal prior to approval of the plan."
January 21, 2015. Applicant's engineer (Pennoni) revises site plan to relocate building to rear of
building, adjacent to existing fire hydrant.
January 26, 2015. Site plan submitted to Fire Marshal's Office (Ken Scott).
January 28, 2015. Fire Marshal's Office (Ken Scott) approved site plan.
February 23, 2015. County approves 1st site plan (SP#38-14). Enables a building addition on rear of
building. No parking nor fire hydrant relocation provided.
April 2015. Inspections (Amy Feltner) met on site with contractor. Discussed requirements of building
code. Amy learned of the wood frame construction the contractor planned to use; raised firewall
requirements. Amy suggested the contractor consider a metal addition to minimize firewall
requirements. Contractor indicated that the addition would be an office accessible to customers, and
that parking would be established. Amy suggested that contractor contact Planning as the site plan did
not account for parking. Appeared ADA requirements were being addressed by engineer.
April 2, 2015. Planning (Candice Perkins) provides comment to Pennoni:
"the contractor came in for their permit and they stated to Inspections that it will be for an office. Now
that's fine, but it's open to the general public and they stated they wanted parking spaces back
there. Parking was never discussed regarding the addition, they will need to add that to the site plan".
May 14, 2015. Site plan submitted to Inspections.
May 15, 2015. Inspections provided comments on site plan.
May 15, 2015. Site plan submitted to Fire Marshal.
May 21, 2015. Fire Marshal's Office (Ken Scott) approved site plan.
May 27, 2015. Site Plan submitted to Inspections for approval.
May 27, 2015. Inspections (John Ternary) approved site plan

Couple of points :
1. For over 20 years the county has required that all exterior points on a commercial building be
within 300 ft. of a fire hydrant. Initially via County Code, and then in 2012 county adopted
Virginia Statewide Fire Prevention Code
2. Fire Marshal may, and has, provided waivers to the 300ft when circumstance deems it
appropriate. Recently an asphalt plant on Ebert Road (close proximity to Winchester Metals)
received the waiver. Reasoning behind the waiver was that the site already has 2 hydrants yet
limited buildings. And the new use was an asphalt plant with clear access. Most importantly,
FCSA requirements for the new hydrant would have cost $130,000 to bring a hydrant 70 ft.
closer to meet the 300ft distance requirement.
3. Fire Marshal simply determines where hydrants need to be located to meet distance/service
access requirements. FCSA establishes construction and equipment requirements to maintain
adequate flows and line pressure.
4. Winchester Metal's site plan/building permit requirements are being held to the same standards
as everyone else. If contractor/engineers were on top of things, they should have been aware
that a site plan was needed. Ordinance clearly states that there is no commercial or industrial
construction without an approved site plan.
5. There is no approved Master Plan for the Winchester Metal property. Pennoni drafted one a
couple of years ago but it was never formally submitted (Planning still has it in draft form).
6. The site plan application never showed the addition as an office, it showed warehouse
addition. From my understanding the customer service office conversation was brought up to
inspections during an onsite inspection and that's when the ADA issue came up. The revised site
plan to accommodate the parking was allowed without fee, to make the site compliant.
7. If Pennoni or the applicant had questions they could have scheduled a TRC where everyone
could have talked about the project. All local engineers (Pennoni and Painter -Lewis included)
have used TRCs. Property owners can also schedule TRC's, his contractor could have scheduled
a TRC.
