Dear Gary:
The above -referenced site plan was approved on December 23, 2014. This site plan is approved for the
construction of 16,000 square foot retail and indoor recreation building (constructed in two phases)
located on Sulky Drive in the Back Creek Magisterial District. Required site improvements include the
following:
• Phase 1— Construction of a 4,000sf retail building.
• Phase 2—12,000sf building addition — indoor recreation.
• Construction of a total of 120 spaces to be constructed in two phases (including six handicap
accessible), including curb and gutter, striping and handicap access.
• Construction of three loading spaces, one screened dumpster, landscaping and lighting as shown
on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with five (5)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Buildings shall comply with The Virginia Uniform Statewide Building Code, 2012 International
Existing Building Code, and Section 303 - A,Assembly Use Group of the International Building
Code/2009.Other Code that applies are the International Energy Code, ICC/ANSI Al 17.1-09
Accessible and Usable Buildings and Facilities. Design plans submitted for permit application
shall be sealed by a Virginia Licensed Design Professional. Occupant load and fire egress plans
shall be indicated on sealed plans at time of submittal.
New assembly building shall meet height and area for the type of construction as allowed in
T503 with applicable increases. Building will require a full NFPA 13 system as detailed on
plans. Northeast wall of building is located 6' from property line. A One Hour Fire Rated Wall
assembly is required per T602. The wall assembly shall be rated for exposure to fire from both
sides (interior and exterior) as required per Section 705.5
All required egress shall meet ANSI Al 17.1-03 for slopes. 60% of all public entrances shall be
accessible. Vestibule or air lock is required for entrances opening into a space exceeding 3000 sq
ft. Maximum 1/2" threshold is allowed per ANSI Al 17.1-09
Walkways shall maintain a 1:20 slope. Curb ramps shall maintain a 1:12 slope.
Parking is provided in accordance with T1106.1(1) of the IBC. Where buildings have multiple
accessible entrances with adjacent parking, accessible parking spaces shall be dispersed and
located near the accessible entrance. A minimum of one van accessible parking and unloading is
required. Max slope of parking and unloading shall not exceed 2%. Signage for parking shall be
provided as required per USBC 1106.8
Parking area and sidewalk area appear to meet ANSI for slopes.
Retaining walls with greater than 3' of backfill require a building permit and may require
engineering.
Please note the requirements in Chapter 17 of IBC for special inspection requirements on the
type of structure.( Soils, concrete etc..).
12/4/14 added note for wall rating. Wall shall be designed with a fire assembly rated from
exposure from both the interior of the building and the exterior of the building. Each side shall
withstand a one hour protection. All fire rated designs shall be detailed and included with the
building permit application/review

Attached is a revised copy of the site plan and your comments addressed below.
1. The B-2 / M-1 label on the cover sheet has been corrected.
2. The building setback along I-81 has been changed to 50'. I could not find
any ordinance requiring a 25' setback for parking, so I left it at 10'.
3. The public access easement has been added in lieu of the cul-de-sac from
the MDP based on the plat by the Board of Supervisors as we discussed.
4. I have added a curb face to the sidewalk in front the standard parking
spaces. I have left the sidewalk level in front of the handicap spaces as we
discussed for improved accessibility.
5. The only loading space is by the dock. The drive-in door will be used
infrequently and is not a loading space per se. I have left the connection in
place because there are 30 spaces in that block and a second egress is
prudent in case a disabled vehicle blocks the main entrance.
6. The legal references for the easements have been added.
7. I have added a proposed 25' access easement on the adjoining property. If
the site plan is acceptable, I will dedicate this easement at the time I
prepare the waterline easement and public access easement for the turn
around.
8. I have added sidewalk and striping for the access from the Phase 2 parking
lot.
9. The dumpster has been removed from the front setback.
10. In lieu of shrubs for headlight screening, I am proposing a 36" opaque
fence. Please see detail on sheet 7.
11. A detail for the pole mounted light has been added to sheet 7.
12. The landscaping notes have also been added to sheet 7. (FYI, I always place
them on the cover sheet with other standard notes.

Dear Gary:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff's comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments:
1) Zoning District Boundaries. The coversheet shows the parcel as being split zoned
B2/M1, it appears this property is not split zoned.
2) Proiect Information. On the coversheet revise the following: the front setback (1-81)
needs to be 50', parking setback from 1-81 is 25'.
3) MDP Compliance. The site plan shows the cul-de-sac being modified, the site plan
needs to conform with the MDP. The cul-de-sac may be shifted to accommodate the
site, however portions cannot be removed.
4) Curb and Gutter. Flush parking and sidewalks are not permitted, "Concrete curbing and
gutters shall be installed around the perimeter of all parking lots. When stormwater
drains away from the curb, gutter pans shall not be required for parking areas that abut
buildings when sidewalks with turndown curbing are used. All curbing shall be a
minimum of six inches in height".
5) Loading Spaces. The loading spaces at the side of the building conflict with the exit for
the parking area, this access point should be eliminated. Also, stripe all loading spaces.
6) Easements. Provide the legal reference for all existing easements.
7) Access. Indicate if there is an access easement between this property and 75-A-11B and
if not it needs to be provided. The path that vehicles leaving this property and traveling
on to 11B needs to be shown (and meet ordinance requirements).
8) Pedestrian Access. Provide sidewalks and crosswalks from the parking lot located
across Sulky Drive to the building.
9) Dumpster Location. Dumpsters cannot be located within a front setback area.
10) Shrubs. Provide additional shrubs as indicated on sheet 7.
11) Lighting. On sheet 6, provide a detail for the pole mounted light (manufacture

12) Landscaping Notes. Notes need to be provided that state (1) all planting shall conform
with §165-203.01E of the Frederick County Zoning Ordinance (Plant selection, planting
procedure, and maintenance), and (2) any plant substitutions must be approved in
writing by the Frederick County Planning Department.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets and
at least five copies of the final plan for approval. Comment sheets are required from the
following agencies: the Virginia Department of Transportation, the Frederick County Inspections
Department, the Frederick County Engineer, Frederick County G.I.S., the Frederick County Fire
Marshal and the Frederick County Sanitation Authority.
