Building shall comply with The Virginia Uniform Statewide Building Code and section 303, use group A -
Assembly for Business, Section 304, if less than50 people) of the International Building Code/2012..
Other codes that apply are ICC/ ANSI Al 17.1-2009 Accessible and Usable Buildings and Facilities and
International Energy Code.
Removal of existing dwelling requires a demolition permit and will require an asbestos inspection prior to
removal.
Retaining walls require a building permit and engineered building plans.
New building shall meet height and area per T503 with allowable increases.
Grease trap provided outside the building for kitchen/cooking as required.
Handicap parking shall comply with ANSI A117.1-03. A minimum of one van accessible space is
required per 1106.5 IBC 09. Van accessible parking shall have a minimum of I I' width with 5'
unloading area or a minimum of 8' unloading area with an 8' width per Section 502 ANSI. Maximum
2% slope required for parking and unloading. Accessible parking and unloading to main entrance appears
to be in compliance.
60% of all entrances shall be accessible and all required exits shall be accessible.
Accessible parking signage for van shall include $500 fine. See USBC Section 1106.8
Please note the requirements in Chapter 17 of BOCA for special inspection requirements on the type of
structure ( Soils, concrete etc.) Compaction/soil bearing/soil testing shall be required for placement of
new store.
Signs require a building permit, as well as awnings attached to the new store. Engineer design required
for canopy signage and awnings.

Dear Patrick:
Planning Staff has reviewed the above -referenced site plan to determine if
administrative approval can be granted. At this time, administrative approval cannot be
granted. This site plan is denied until the issues in this letter, as well as all issues of the
other review agencies, have been adequately addressed. Please review Staff's
comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
1) Lot Consolidation. A lot consolidation for the three parcels needs to be
completed prior to the site plan being approved. Show the new lot configuration
on the site plan.
2) Signage. On sheet 3 under the notes, the signage size/height needs to be revised
to show 12' tall/50sf in size. Also, if freestanding signage is proposed the
location needs to be shown on the plan.
3) Easements. Show the legal reference for all easements, including the ROW for
Martin Drive.
4) Setbacks. On sheet 3 under the project summary, the front setback (Route 7)
needs to show 50'.
5) Parking Calculation. The calculation used is for retail, it appears this use should
be a combination of restaurant use and retail use.
6) Retaining Height. Label the height of the retaining wall on sheets 3 and 6 since
it is also being used for headlight screening.
7) Lighting. Provide details for all proposed fixtures (manufactures cutsheets) and
a pole detail (in addition to the foundation).

After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment
sheets and at least five copies of the final plan for approval. Comment sheets are
required from the following agencies: the Virginia Department of Transportation, the
Frederick County Inspections Department, the Frederick County Engineer, the Frederick
County Fire Marshal, the Frederick County Sanitation Authority and the Virginia
Department of Health.
