plan indicating the area for future pavement is not to be used until that pavement is installed.

The above -referenced site plan was approved on June 24, 2015. The site plan is approved for
the construction of a rail extension and product unloading and staging area at the existing Trex
facility located at 3229 Shawnee Drive in the Back Creek Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with four (4) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the

Attached you will find one copy of the revised site plan for the referenced project. The review
comments have been addressed as follows:
1. Special Limited Power of Attorney Form.
Response - The completed form is attached.
2. Aerial Map.
Response - On sheet IA the subject project area has been labeled and outlined.
3. Paved Areas.
Response — A pavement section has been added on sheet 14.
4. Photometric Plan.
Response — The owner/developer has chosen not to install lighting at this time. A note stating
lighting will not be installed has been added on sheet 2.
5. Temporary Parking Area.
Response — This area was improperly labeled and should have been labeled as a temporary storage
area. The area will be used when rail cars are being loaded and unloaded to minimize the amount of
time the rail cars are on site and reduce the demerge payments to the railroad. The area also has
BMP benefits for the site.
6. Future Expansion/Outdoor Storage.
Response — A note has been added to sheet 3 indicating storage in the undeveloped areas will
require a new site plan approval.
Plan approvals from Public Works and the Fire Marshal are attached. Since the lighting was removed
from the plan and there were no foundations, Inspections was not asked to review the plan.

Dear Tim:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staffs comments listed below and then prepare a revised site
plan which adequately addresses each concern.
Review Comments:
1) Special Limited Power of Attorney Form. Please have the property owner sign the
attached Special Limited Power of Attorney Form prior to further review or approval. This
form should be notarized and completed to grant the applicant (you) with authorization to
represent them for this site plan.
2) Aerial Map. On sheet 1A highlight or label the subject area as indicated.
3) Paved Areas. Provide a paving detail for the material staging area and access road.
4) Photometric Plan. Indicate if any outdoor lighting is proposed with this rail expansion, if so
a photometric plan is required.
5) Temporary Parking Area. Indicate the need for the "temporary" area, if this is only for
construction it needs to be removed when the pavement is completed. Staging areas for
construction may be gravel; however permanent parking cannot be on gravel. If permanent
parking is proposed, a landscaping plan is also required.
6) Future Expansion/Outdoor Storage. Provide a note in the undeveloped area that outdoor
storage is prohibited (future expansions) without the approval of a new site plan.

SITE PLAN CHECKLIST
The Site Plan Checklist, shown below, lists the information which is required to be on each site plan. Site plans
which are incomplete or missing information will be returned to the applicant (s) for revision.
Project Information Section
(1)
A title that includes the name of the proposed or existing business and a subtitle which
describes the proposed development.
(2)
The name, address, and phone number of the land owner, developer, and designer.

(49) A space labeled "Approved by the Frederick County Zoning Administrator" for the
signature of the Zoning Administrator, approval date, and a statement that reads "site
plan valid for five (5) years from approval date."
