Dear Tim:
The above -referenced site plan was approved on May 15, 2015. The site plan is approved for
revisions to Site Plan #25-06 for Carroll Construction approved on July 26, 2007. Revisions
include the addition of an asphalt plant to the office/warehouse complex at the Carroll
Industrial Park located on Ebert Road in the Stonewall Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any
questions or concerns.

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff's comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments:
1. Maximum Heiaht. On sheet 4A show the proposed height of the asphalt plant and the
maximum height for the future silos.
2. Setback Update. Parking setbacks for this property are now 10', update from 25'.
3. Ordinance References. Update all zoning ordinance references (see sheet 6).
4. Current Use. The coversheet shows the current use as "contractor office and material
storage"; revise to show vacant.
5. Liahtina. The site plan needs to show any lighting proposed with the asphalt plant.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets and
at least five copies of the final plan for approval. Comment sheets are required from the
following agencies: the Frederick County Inspections Department, the Frederick County
Department of Public Works (County Engineer) and the Frederick County Fire Marshal.

The comments from the Frederick County Planning Department regarding the
above -referenced project have been appropriately addressed on the revised site plan documents
that accompanies this letter. The comments have been addressed as follows:
Department of Planning and Development:
1. The silo and asphalt plant heights have been shown on Sheet 4A, as requested.
2. The parking setback has been revised.
3. The reference to the landscaping section in the code has been revised.
4. The current use on the cover sheet has been revised, as directed.
5. The lighting layout, schedule, light detail, and related illumination has been
added to Sheet 6A.
All comments have been addressed completely in accordance with your review and our
recent discussions. Please review the revised plans for compliance and advise me as to your
satisfaction for approval.

Buildings shall comply with The 2012 Virginia Uniform Statewide Building Code and Section
306 — F-Factory Use Group. Other Code that applies is ICC/ANSI Al 17.1-09 Accessible and
Usable Buildings and Facilities.
Buildings/structures shall comply with height and area as allowed in T503 with applicable
increases. Buildings or equipment(s) on permanent foundations require permits and inspection.
Retaining walls and silos require permits.
Plans submitted for permitting for this project shall be designed by a Register Design
Professional.
Fuel tanks, if utilized, require permits.
Restrooms shall be provided within 500' of travel distance as required per Chapter 29
IBC/USBC 2012

Dear Mr. Lewin,
I have received your variance to excuse the addition of one fire hydrant regarding the
portable asphalt manufacturing plant located at 300 Ebert Road. The Frederick County
Fire Prevention Code states `in areas developed with industrial or commercial
development(s), there shall be a hydrant within 300 feet of all portions of any
structure", however after our site visit on June 101", measuring the existing fire hydrant
at a distance of 374 feet, taking in account the portability of the asphalt plant and
considering the cost to install a fire hydrant, I am granting the variance excusing the
requirement of an additional fire hydrant.
