The above -referenced site plan was approved on September 1, 2015. The site plan is approved
for the revisions and additions to the Trilogy at Lake Frederick Recreation Center located at 140
Bald Eagle Drive in the Opequon Magisterial District (original plan #81-05). Revisions include the
following:
• Revisions to the parking layout and additional parking to serve the pickle ball courts.
• Construction of eight pickle ball courts, outdoor amphitheater, dog park, ramada,
gardens, and trails as shown on the plan.
• Landscaping and lighting as shown on the plan.
• Docks and piers on the lake as shown (additional approvals from VGDIF required).
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any
questions or concerns.

DGIF APPROVAL NOTICE
Dear Ms. McKeown:
The Department of Game and Inland Fisheries (DGIF) has reviewed the site plan dated 7/27/2015 and
Sheets 20 and 20A of 21 of the Landscaping Plan dated 7/31/2015 and 8/11/2015, respectively, for the
above -referenced project and approves the work proposed on property that is owned by DGIF to
construct site improvements only for clubhouse access to the proposed fishing pier in accordance with
those documents. Permanent structures on DGIF property other than pedestrian walkways to the pier and
the pier itself are not permitted and the amphitheater shall be modified as needed so it is not built on
DGIF property. Note that the erosion and sediment control plan and stormwater management plan
associated with work on DGIF property shall be reviewed and approved by DEQ or the local authority for
a VSMP General Permit for Construction.
DGIF has not reviewed nor approved the fishing pier details, public access and parking, nor other
requirements associated with the public fishing pier; however, the developer is required to provide a
public fishing pier and public access in accordance with the Memorandum of Agreement (MOA) between
DGIF and the developer. Prior to construction, the fishing pier and associated site plan will require DGIF
approval and a state issued building permit and need to comply with the latest edition of the Virginia
Uniform Statewide Building Code and DGIF standards. The MOA and associated bond for work on DGIF
property shall be maintained for the duration this project and for future development around Lake
Frederick.
In a meeting on 8/26/2016 between DGIF and Dyric Snyder, the project manager for Shea Homes, Mr.
Snyder agreed to work closely with DGIF to satisfy the requirements of DGIF to provide a public fishing
pier that would enhance angler access on Lake Frederick.

Response: Site plan sheets have been added to the plan. See sheets 5A-5C.

Project Information — Provide a project overview table that shows all site requirements (reference the
table on sheet 2 of the approved 2006 plan)
Response: A project summary table (similar to the one on the 2006 plan) has been added to sheet 2.
3.
Parking Spaces — All parking spaces that do not have curb and gutter are required to have wheel stops,
these have not been shown on the plan for existing spaces (were shown on the approved site plan)
Response: Wheel stops have been added to all parking spaces that do not have curb and gutter. See
sheets 6 & S.
4.
Sidewalk — Extend the sidewalk as indicated on sheet 8
Response: Sidewalk on the west side of Bald Eagle Drive is proposed with the Phase 1 Section 2A
plan. It has been added to our plan as an existing sidewalk. This will provide a pedestrian connection
from Rachel Carson Drive. See sheet 8.
5.
Landscaping Plan Calculations — Provide landscaping calculations for the interior, perimeter and linear
road frontage requirements
Response: Landscape Calculations have been provided (See response letter from IN21T). See sheet 19.
6.
Landscaping Notes — On Sheet 1-0.0 provide the following notes: (1) all planting shall conform with Sec
165-203.01E of the Frederick County Zoning Ordinance (Plant Selection, planning procedure, and
maintenance), and (2) any plant substitutions must be approved in writing by the Frederick County
Planning Department

Response: The manufactures cutsheet and pole details have been added to the plan. See sheet 21A.
A note has been added to state that all lighting must be full cut off fixtures. See sheets 21 & 21A. A
table has been provided that shows the average, maximum, and minimum foot candle values for the
site. See sheet 21.

Other parking areas are meant to have full access to the adjacent open space / lawn /
activity areas. If we call out an "Evergreen Hedge" in all of these areas, we are defeating
the design intent and restricting free -flow access to these programming elements.
Additionally, the grade differential along Rachel Carson, should provide sufficient screening
to any parking areas without an "evergreen Hedge."

Dear Emily:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff's comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments
1. Site Plan Sheet. An overall site plan sheet is needed that shows the details (minus
grading, etc), please refer to the site plan sheet from the approved 2006 plan.
2. Proiect Information. Provide a project overview table that shows all site requirements
(reference the table on sheet 2 of the approved 2006 plan).
3. Parking Spaces. All parking spaces that do not have curb and gutter are required to
have wheels stops, these have not been shown on the plan for existing spaces (were
shown on the approved site plan).
4. Sidewalk. Extend the sidewalk as indicated on sheet 8.
5. Landscaping Plan Calculations. Provide landscaping calculations for the interior,
perimeter and linear road frontage requirements.
6. Landscaping Notes. On sheet L0.0 provide the following notes: (1) all planting shall
conform with §165-203.01B of the Frederick County Zoning Ordinance (Plant selection,
planting procedure, and maintenance), and (2) any plant substitutions must be
approved in writing by the Frederick County Planning Department.
7. Evergreen Shrubs. Shrubs are required along the parking spaces as indicated on sheet
19.
8. Lighting Plan. On the photometric plan the following is needed: manufactures
cutsheets for all fixtures, a table that shows average maintained lighting levels for the
site, pole details, statement that all pole and building mounted lighting must be full cutoff
fixtures.
