Staff notes the following comments have not been addressed: • Setbacks. Label the 26' building restriction line (BRL) on Sheet CO3. • Site Lighting & Photometric Plan. A note should be added to the sheet specifying that all site lighting will conform to Section 165-201.07 of the Frederick County Zoning Ordinance and will be downcast and full cutoff. Additionally, details of the lighting features (building and/or pole mounted) to be installed on -site should be included on the site lighting & photometric plan page(s). • Landscaping & Buffering. A note should be added on sheet L01 stating that all landscaping and plantings will be in conformance with Section 165-203.01 of the Frederick County Zoning Ordinance. Staff acknowledges the required language regarding the plantings has been included but requests the ZO section number also be included should this language change in the future. Further specify in the plantings table that the screening/buffer shrubs (Juniper "Nicks Compact") should be in the height range of 18" to X" in cases where they are fulfilling screening of the parking lots they should be a minimum of 36" at time or plantings, and in cases where they are fulfilling buffer requirements they should be a minimum of 18" at time of plantings per the notes. When Planning & Development staff conducts the on -site inspection prior to issuance of final CO, we will want to see the plantings are the correct height. Plantings that do not fulfill the requirement will need to be replaced. A note should also be added to sheet L01 referencing the "existing 50-FT shared buffer easement centered on property line" between the subject property and the residential parcel to the rear of the lot (PIN #54-A-127B). The note should be as follows: "Easement Note: Existing 50-FT Shared Buffer Easement Centered on Property Line recorded in Instrument #050026511 (recorded August 10, 2005). In addition, please provide documentation of approvals from the following commenting Agencies — VDOT, Fire Marshalls Office, Public Works (County Engineer), and Building Inspections. At this time, administrative approval cannot be granted. This site plan will not be approved until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staff's comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: 1) Site Plan Reference Number. Add the site plan (SP) number, SP #51-16, to the plan set. 2) Signature Block. The location of the dumpster enclosure has been moved to be behind the proposed building line. 9) Transportation. Refer to the geotechnical report prepared by Building and Earth, dated January 4, 2017: The elevations and locations of the nine (9) borings should be correlated with the existing topographic conditions shown on sheet C-02. The bore hole locations have been added to sheet C-02. A note has been added under the general notes referencing the geotechnical report. 2. Refer to Appendix E in the stormwater calculations: The letter from Resource Environmental Solutions dated December 7, 2016 indicates the availability of 2.05 nutrient credits. Acknowledged. The nutrient credits required will be purchased after site plan approval. 3. Refer to Sheet C-02, Construction Sequence: A stormwater/land disturbance permit will be required from the Frederick County Public Works Department prior to any site construction including demolition. Acknowledged. A note stating this has been added under general demolition notes on Sheet CO2. A registration statement will be included with this submittal. 4. Refer to Sheet C-02, Demolition Note #DN-4: This note is very ambiguous considering the entire easement containing the gas and water liner is shaded thus requiring relocation according to the note. We suggest that these utility companies be contacted prior to initiating the site work bidding process to accurately locate the lines in question to prevent conflicts during construction. The results of this action could then be evaluated by the site designer to determine potential conflicts. The water and gas was located by miss utility but exact location/depth is unknown. We typically include this note to ensure that the contractor has an idea of where the existing utilities are and to verify in the field to determine that actual location/depth. We have contacted the utility companies to determine how the utilities will be relocated. The proposed water line will be offset 2' from the existing line and lowered as needed. The gas line is to be relocated as shown on the 2o1 submittal and is noted on the plans to be relocated by Washington Gas. 5. Refer to Sheet C-03: A portion of the proposed 10' wide concrete sidewalk is shown above existing utilities. The easement documentation should be reviewed to determine if there are any limitations associated with constructing a sidewalk above these utilities. No issues have been found with the waterline being located under the walking trail. The gas line is to be relocated to be 1' into the property within a 10' gas line easement. 6. Refer to Sheet C-03: The symbol for an ADA accessible sign has been placed at several locations within the proposed 10' sidewalk. Indicate if this symbol should have been a "3", concrete sidewalk, rather than a "7" as shown. This symbol was incorrectly labeled. The correct label number is 17 (paved asphalt trail), which has been revised for this submittal. 7. Refer to Sheet C-03, Water Notes and Gas Line: Refer to our previous comment #4, regarding relocating existing utilities. The water and gas lines shall be relocated based on conversations with the corresponding utility companies. 8. Refer to Sheet C-03, Site Layout Legend #9, Proposed Wall: Indicate what type of retaining wall is envisioned in the area shown along the north property line. Any wall above 3' will require a building permit. The proposed wall has been called out to be a segmental block retaining wall and a detail has been added to the site details sheet. 9. Refer to Sheet C-04, Mite Improvements: Indicate if permission has been obtained to implement the offsite improvements proposed for the Episcopal Church property. Permission to grade on the church property has been denied therefore the layout has been revised so that no disturbance will occur on the church property. Correspondence with VDOT has taken place to verify that the new layout will be approved. 10. Refer to Sheet C-05, Existing Contours: The existing contours shown on sheet C-02 should be legibly reflected on this grading plan. The contours have been darkened to make the easier to see and additional contour labels have been added. 11. Refer to Sheet C-05, General Grading Note #3: The VSMP permit shall be obtained from Frederick County Public Works. This note has been revised. 12. Refer to Sheet C-04 and C-05, Inline Drain # 10.1: It appears that the top of the proposed inline drain # 10.1 will be constructed approximately 18" above finished grade. Indicate if this is the actual intent of the design. The top of the structure is correct at 705.50. The building finished floor is at 706.5, the ground at the outside of the wall is at 706.0, and the ground slopes half a foot over 10', therefore the top of the inlet is at 705.5. The proposed grading contour has been labeled to correctly show the proposed grading. VDOT — Timothy Rhodes: • Please provide the current VDOT General Notes on the cover page. The notes have been added to the cover sheet. • Please remove the CG-6 reverse curb from the plan. VDOT does not have a Standard Reverse Curb. The curb can be warped at the flow line as indicated on the CG-I 1 Detail, note 9. All references to CG-6 reverse have been removed and changed to standard CG-6. • Please provide a typical section of the entrance and roadway to include roadway cross slope, lane widths, pavement design, curb and gutter placement, buffer strip and sidewalk/trail. An additional "entrance cross section profile" has been added to sheet C14 of the plans. • Please include the distance to the nearest entrance in each direction. These dimensions can be found on sheet C11 of the plans. • On sheet CO3, the legend indicates that #23 is calls for a 12" wide painted gore bar. Please revise to 24" painted gore bar spaced with 12' between each stripe. See PM-3 from VDOT Road and Bridge Standards for detail. The legend has been revised as specified. • Please be sure all details included are as shown in VDOT Road and Bridge Standards. This includes the CG-6. Also, please include the PM-3 Standard Detail. The correct details have been used for CG-2 and CG-6. The PM-3 detail has been added to sheet C14. • We have reviewed the Auto -Turn exhibits for the WB-50. These exhibits show the entrance accommodates this type of delivery truck. Should this development proceed and go to construction, we will put a stipulation in the land use permit for the entrance that no vehicles larger than WB-50 be permitted to access the facility. If this restriction is violated or issues arise with delivery vehicles having difficulty ingress and egressing the facility, modifications to the entrance will be required. Acknowledged. VDH: No comments Frederick County Inspections: 1. Building shall comply with The Virginia Uniform Statewide Building Code and section 309, use group M (Mercantile) of the Virginia Building Code/2012.Other codes that apply are ICC/ ANSI Al 17.1-2009 Accessible and Usable Buildings and Facilities and the Virginia Energy Code. Acknowledged. See the building plans for building information. 2. New M-Mercantile Building shall meet height and area per T503 with allowable increases. Building location to property line is less than 30' but greater than 20'. Proposed building is single story which is allowed in M-Mercantile. Reference the building plans for the construction type. The building has been located as it was determined to be acceptable by variance #14-16 by the Frederick County Board of Zoning Appeals (BZA) on October 18, 2016. No runoff shall discharge over the pedestrian walkway. 4. Handicap parking shall comply with ANSI A 117 .1-09. Van accessible parking shall have a minimum of 11 'width with 5' unloading area or a minimum of 8' unloading area with an 8' width per Section 502 ANSI. Maximum 2% slope required for parking and unloading. Accessible parking appears to be in compliance with ANSI A 11 7 .1-09. Accessible route to entrance appears to be in compliance. Vestibule required on main entrance if opening into space larger than 3000 sq ft. Door approach to main entrance and doors in series shall comply with ANSI A 117.1-09. Acknowledged. Please see architectural plans for specific building features. 5. Please note the requirements in Chapter 17 of USBCABC for special inspection requirements on the type of structure (Soils, concrete etc.) Compaction/soil bearing/soil testing shall be required for placement of new store. Please see the geotechnical report provided by others. 6. Geotechnical investigation required per Section 1803. Please see the geotechnical report provided by others. Site Plan Preparation The site plan must be prepared by a certified engineer, architect, or surveyor licensed in the Commonwealth of Virginia, and shall meet all the requirements of the Frederick County Code. Site plans must show all the information specified on the site plan checklists. 2. Technical Review Committee The Technical Review Committee (TRC) allows applicants to discuss site plan concepts and design issues with all relevant review agencies prior to a formal submission of a site plan application. Applicants are not required to meet with the TRC; however, the TRC serves as a mechanism that helps streamline the site plan review process by providing instant feedback on potential design issues. The TRC is open to anyone who wishes to present a concept or site plan design; however, meeting with the TRC does not substitute for individual agency reviews that are necessary for a site plan approval. The Technical Review Committee meets every first and third Thursday of each month. The cut- off date for all agenda items occurs at 12:00 p.m. on the Monday prior to the subsequent meeting date. Agency Comment Period: The applicant must circulate copies of the site plan to applicable review agencies for comments. The attached comment sheets for each review agency must be completed and submitted with the required number of copies of the site plan. The required number of site plans needed is specified on each comment sheet. It is suggested that applicants contact the Department of Planning and Development to determine which agency review comments are required. Each applicable review agency will review the site plan to determine if it has all the necessary information within two working days. The site plan checklist included in this package specifies the information required to be shown on or attached to a site plan. If all the information is complete, the appropriate agency will review and provide comments within 15 working days from the time the site plan is submitted to them.* If information is missing or incomplete, the site plan will not be accepted for review and returned to the applicant. Approvals must be achieved from the applicable review agencies prior to the site plan being approved by the Planning Department. *Note: Reviews conducted by the Virginia Department of Transportation may take up to 60 days. B. Application Submission and Review Fee: The submission of a site plan application begins when the Department of Planning and Development receives a site plan for comment review. At the time the Department of Planning and Development accepts a site plan for comment, the applicant must also submit a completed application form (pages 9 and 10) and the review fee. Review fees are specified on the attached Development Review Fee Schedule. 4. Final Site Plan Approval A site plan will receive final approval once all required information and approved review agency comments are submitted to the Department of Planning and Development. All final site plans are approved administratively by the Zoning Administrator. A. All pending site plans submitted for approval will be placed on the Planning Department's Applications Action Summary. B. During the review by the Department of Planning and Development, the Zoning Administrator may determine that a site plan shall be reviewed by the Planning Commission due to the scale, intensity, or potential impacts of the proposed development. In this case, the site plan will be included on the agenda of the next regular meeting of the Planning Commission. It will be the responsibility of the applicant to ensure that all required materials are complete and filed with the Planning Department at least 12 working days prior to the regular meeting of the Planning Commission in order for the site plan to be placed on this agenda. 5. Construction Activity Limited construction activity is permitted prior to final site plan approval. This allows applicants to move ahead and prepare the site while approval is pending. Applicants may apply for the following permits: A. Land Disturbance Permit: This permit is issued by the Frederick County Department of Public Works once a grading plan has been submitted and reviewed by the Frederick County Engineer. The cost of this permit is indicated on the attached Development Review Fee Schedule. The County Engineer may be contacted Monday through Friday from 8:00 a.m. to 5:00 p.m. at (540) 665-5643. B. Footing Foundation Permit: Applicants may apply for a footing foundation permit prior to final site plan approval. This permit may be obtained at the applicant's risk. Any revisions specified by the final site plan may affect footing foundations already set in place. Two copies of an engineered footing foundation drawing shall be submitted to the Department of Building and Inspections. The Plans Review Specialist will review and approve a Footing Foundation Permit once adequate footing details, basement details (if necessary), and groundwork details are provided. The Plans Review Specialist can be contacted Monday through Friday from 8:00 a.m. to 4:00 p.m. at (540) 665-5650. r 6. Final Certificate of Occupancy Once all site development is complete, the applicant must contact the County Planner in charge of the site plan review to schedule an inspection of the site. The inspection is necessary to ensure that all requirements shown on the approved site are complete. A final or temporary certificate of occupancy permit will be issued once the required improvements are complete or adequately bonded with Frederick County. 7. Bonding If all improvements depicted on an approved site plan have not been completed the property owner can bond the incomplete items if deemed appropriate by the Zoning Administrator. When the improvements are permitted to be bonded the applicant must complete the Monetary Guaranty Estimate Worksheet. This worksheet needs to be completed and affixed with an engineer's seal, and provided to the Planning Department for review. Once the review of the worksheet has been completed and the amount approved by the Planning Department, the developer/owner will need to establish an Irrevocable Letter of Credit, a Performance Bond or cash for the monetary guarantee. r- DEC 272016 Document Approval Form PLEASE REVIEW THE ATTACHED DOCUMENT.
