Dear Mr. Lewis:
The above -referenced minor site plan was approved on January 3, 2017. The site plan is
approved for a new 35-foot (FT) tall telecommunications antenna on a 30 FT by 30 FT concrete
foundation in the Opequon Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with six (6) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions
or concerns.

2. A lighting note has been added to the General Notes. There is no lighting pro-
posed.

Structure shall comply with The Virginia Uniform Statewide Building Code and Section 312, use
group U (Utility and Miscellaneous) of The International Building Code 2012.
Per the Section 102.3 of the Virginia Uniform Statewide Building Code, 2012 edition,
Section 102.3 VUSBC exempts equipment, related wiring, and poles and towers supporting the related
wiring installed by a provider of publicly regulated utility service.....The exemption shall apply only if
under applicable federal and state law the ownership and control of the equipment and wiring is by the
service provider or its affiliates. Such exempt equipment and wiring shall be located on either public
rights -of -way or private property for which the service provider has rights of occupancy and entry;
however, the structures, including their service equipment, housing, or supporting such exempt equipment
and wiring shall be subject to the USBC. The installation of equipment and wiring exempted by this
section shall not create an unsafe condition prohibited by the USBC.
Construction the structural slab requires a building permit. Plans submitted shall be sealed by a
Virginia Registered Design Professional
Please note the requirements in Chapter 17 of the IBC for -special inspections for this type of
structure.(soil, concrete, bolts, etc.)

Dear Mr. Lewis:
Planning Staff has reviewed the above -referenced minor site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan will
not be approved until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff s comments listed below and then prepare a revised
minor site plan which adequately addresses each concern.
Review Comments:
1) General Notes. The following revisions should be made to Sheet 1:
• Add the site plan number (SP #47-16) to the cover sheet;
• Provide a total for the new land area disturbed as a result of the second communication
dish; and
• Note previous approvals, specifically SP #25-15.
2) Site Lighting. Clarify if there is any proposed outdoor lighting. Add a note that any future
site lighting will conform to the outdoor lighting requirements of the Frederick County
Zoning Ordinance and require a minor site plan.
3) Azency Approvals. Comment sheets (approvals) are required from the following agencies:
the Frederick County Inspections Department, and the Frederick County Fire Marshal.
After you have revised the minor site plan, please resubmit one copy via email so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets and at
least five copies, and one digital (PDF) copy of the final plan for approval. Do not hesitate to contact
me if you have any questions or concerns regarding this letter.
