The site plan is approved for construction of a 1,061,041 square foot (SF) e-commerce warehouse and distribution facility in the Stonewall Magisterial District. Required site improvements include the following: • Construction of a parking lot with 1,205 spaces (including 26 handicapped spaces) and 368 loading spaces, including curb and gutter, striping, handicap access and landscaping; • Construction of Business Boulevard; and • Buffering/screening and lighting as indicated on the site plan. All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including review agency comments from all relevant review agencies. Attached are five (5) copies of the signed site plan by the Zoning Administrator. Please forward these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction site throughout the development process. Comment 1: Business Boulevard is a future collector roadway, requiring sidewalks on either side of the of the road (or a 10-foot wide asphalt pedestrian trail). Staff acknowledges the MDP was approved prior to this requirement, however these facilities are now required. Please depict on the final submission. Response 1: We have provided a 10-foot wide asphalt pedestrian trail along Business Boulevard. Comment 2: The applicant should confirm how it intends to proceed in regards to VDOT approval of the transportation improvements; if a separate Roadway Improvement Plan is to be provided, a note to this effect should be added in the plan set. Or a revised site plan, reflecting the ultimate conditions of the roadways, entrances, circulation, etc. may be submitted once this issues are resolved with VDOT. Response 2: We have added a note that addresses the requirement for VDOT approval of separate plans for the remaining off -site transportation improvements. {See Sheet C-0011 Comment 3: Further specify if Northwest Buffer A (a Category C Type buffer) will include both a fence and berm, or one or the other. While time limitations have not allowed us the opportunity to complete a full review of the TIA, the mitigation proposed seems reasonable. Recognizing the proposed 1-81 northbound off -ramp dual right turn onto Rest Church Road is an uncommon traffic condition as related to driver expectation, we recommend coordination between VDOT and the developer to incorporate wayfinding signage into the roadway striping plans as part of the site development process. It is recommended that the left lane of the northbound off -ramp be signed to accommodate vehicles proceeding to northbound US 11, while the right lane can accommodate site traffic and southbound US 11 traffic. In addition we do not foresee any major issues with the proposed design of Business Boulevard and believed the proposed note is acceptable. We plan to have our formal review completed of the Business Boulevard plans early next week. VDOT looks forward to continual cooperation with the developer and Frederick County to ensure the success of this development. We appreciate you and Kim Petrucci taking the time to discuss permitting for this project. Ed is the Director of the Frederick County Department of Public Works and will be responsible for plan review, site inspections and final acceptance of any development on this site. As we discussed, about 7 acres of the total project area lie within Berkeley County WV. Because so much of the site development will occur in Frederick County, Ed and I proposed having Frederick County Public Works handle the plan review, permitting and inspections for the entire 107 acre parcel, including those 7 acres in West Virginia. Ed pointed out that since a majority of the site is in Frederick County it is taxed as being wholly in Frederick County. Allowing the entire site to be permitted within Frederick County would follow this precedent. The scope of improvements on the Berkeley County side is significantly reduced due to the presence of a possible jurisdictional stream and wetlands on that north end of the site. The site design will not disturb those potential Waters of the US. This significantly limits how much of the 7 acres can actually be disturbed. We identified on the concept plan a small portion of a parking to about 0.76 ac, of impervious area, which will be located in Berkeley County. And of course, there will be rading work to install that lot occurring north of the State line. But, other than temporary erosion control easures, no other permanent stormwater management facilities will be located in Berkeley County. Frederick County has agreed to review and permit the entire sitE as if located in Frederick County. Additionally, Frederick County will take responsibility for the inspe ion of all erosion control and stormwater management facilities to ensure maintenance and operability. They will also review as built plans of the permanent structures to verify proper installation and conformance with the approved design. Copies of all plan submittals made will be provided to you and Kim Petrucci, as well as signed copies of the approved plans. Further, Kim Petrucci will be notified of the time and location of the preconstruction conference so that a representative of Berkeley County can attend. We are currently entering the final stages of site design and will be making our initial applications for site plan review and approval in mid -November. The Master Development Plan for this property (MDP#03-05) was approved May 10, 2005. This development plan will complete the construction of Business Boulevard to Woodbine Road, make improvements to Woodbine Road and extend and relocate utility services as necessary to serve the proposed warehouse facility. The subject property consists of four existing parcels, two in Virginia (TM 34-A-4 & TM 33 ((A)) A-25) and two in West Virginia (TM #1-98 & #17-98.1). This project proposes to consolidate all four of the parcels into two lots, one on the west side of Business Blvd and the other to include the remainder of the M-1 zoned property. It is requested that the County allow that the Business Blvd right of way be dedicated prior to issuance of an occupancy permit for the proposed use. The total project site area is 108.0465 AC. The site plan proposes the disturbance of 95 acres. Water and sewer service will be extended from existing lines along Woodbine Road, on the south side of the project. An 8" sewer line will be provided on the east side of the structure and that line is intended to be dedicated to the FCSA. And 8" water line will be extended to a double check and backflow connection for fire service and a 3" water meter for domestic service. The onsite fire service line and fire hydrants will be served by an onsite tank and booster pump system. The fire service system downstream of the double check detector will not be dedicated to FCSA. The project also includes the extension of a 8" water line along the west side of the extension of Business Blvd from its current terminus at the west side of the project to Woodbine Road. Direct access to the project will be provided from the extension of Business Blvd. Three access points are proposed. Two full service commercial entrances for the car parking lots and building access. One other truck only access is provided at the south end of the site. Approximately 1,000 ft of onsite truck staging is provided from Business Blvd to the security gate. Business Blvd meets the VDOT GS-7 standards for a 30 mph design speed (posted 25 mph). A 36 ft wide 3 lane section within an 80 ft right of way is provided as required by the Master Development Plan. At Woodbine Road, a widening project to provide a 200 ft left turn lane at the Business Blvd intersection is proposed. Relocation of the existing overhead electric lines is required to implement the required widening and provide the 10 ft right of way dedication required by rezoning proffer. A traffic impact study was required by VDOT to support the extension of Business Blvd and to establish the traffic impact associated with the project. The preliminary findings of that study have been submitted to VDOT for review. It is requested that the VDOT acceptance of those findings and of the approval of the Business Blvd and Woodbine Road improvement plan be a condition of the occupancy permit for the structure. Electric Telephone and fiber optic services will be extended from existing service along Woodbine. These service line will be underground. The gas service is being extended from the Washington Gas main service line approximately 500 ft east of the site. Washington gas has agreed to extend service through the property east of the railroad, under the CSX line to the Woodbine Road right of way. The storm water from this site will be designed as required by the rezoning proffer. There will be three discharge points from the site. One is to the existing culvert along Woodbine road. This discharge serves primarily the 12 ac parcel west of Business Blvd and the commercial 3 ac parcel along US Route 11. The two other discharges serve the remainder of the Whitehall Commerce Center, including the commercial areas north of Business Blvd and will flow to culverts under the CSX railroad. The primary of these two discharges will be to the northern crossing located 250 ft from the property in Berkeley County. As allowed by the State Stormwater Management Regulations, since the stormwater management plan was the subject of a proffer and specifies the general location of ponds and discharges, and requires a regional approach to treat the entire Whitehall Commerce Center post development runoff, this project is grandfather and can be designed in accordance with the 2009 stormwater regulations. No part of the regional treatment and detention system has been designed or permitted to date. The County of Berkeley has agreed to cede the design, permitting and inspection responsibility for the detention system draining across the County line to Frederick County. While the project does anticipate disturbance of the Berkeley County portions of the site, which include approximately 7 ac, all detention and treatment will be accomplished within Frederick County.
