The above -referenced site plan was approved on October 3, 2017. The site plan is approved for
approximately 2,546 square foot (SF) of indoor business area, approximately 10,429 SF for
outdoor display areas, a commercial entrance and ten (10) parking spaces for a landscaping/retail
nursey business in the RA (Rural Areas) Zoning District in the Opequon Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference,
and an approved copy must be kept on the construction site throughout the development process.
Once site development is complete, the owner(s) should contact this office to schedule an on -site
inspection. Do not hesitate to contact me if you have any questions or concerns.

Dear Mr. Klein:
We are in receipt of the Department of Planning and Development comments dated December 8, 2016,
and offer the following responses:
Review Comments
Comment 1- Site Plan Number:
The site plan reference number, SP #44-16 should be added to all sheets in the plan set.
Response: The site plan reference number has been added to all sheets (In Title Block).
Comment 2 — Previous Approvals:
Add "Previous Approvals, " and include Conditional Use Permit (CUP) #05-16. Please also provide a
signed letter (or acknowledge in the Review Agency Comments) from the Health Department confirming
the number of proposed employees and customers can be handled by the existing on -site septic system, as
required by Condition #1 of the aforementioned CUP. This may ultimately affect the total occupancy and
the amount of parking that can be provided on site.
Response: Added "Previous Approvals" which includes the CUP under project notes on sheet 2. The
existing on -site septic system is not used. A new septic system has been designed and approved by the
health department (See attached permit).
Comment 3-Disturbed Area:
Update the disturbed area calculation, as applicable, to reflect any new land disturbance (i.e. paved
parking, entry widening, commercial entrance, display areas etc.).
Response: Disturbed area updated sheet 2.
Comment 4-Use:
Revise the current use to "Vacant/Agricultural/Residential" and revise the proposed use to "Retail
Nursery/Landscaping Business" as consistent with the approved CUP.

conformance with the Zoning Ordinance requirements.

Comment 6-Parking:

Comment 7-Outdoor Lighting:
Clarify if any outdoor freestanding or building -mounted lighting will be provided and add a note
specifying it will meet the outdoor lighting standards requirements of the Frederick County Zoning
Ordinance. If no outdoor lighting is proposed, please add a note to this effect on Sheet 4.
Response: No additional lighting proposed, note added to sheet 2 and 4.
Comment 8-Landscaping:
On sheet 4 please provide calculations showing the required and proposed perimeter and interior
landscaping as required by Zoning Ordinance. Further a 36-inch tall evergreen screen or berm is
required for parking areas; see Staff notes on plan set. Please also include the required landscaping notes
regarding planting, maintenance and replacement on Sheet 4.
Response: See sheet 2 project note 3. Per Frederick County Code, Chap. 165 Part 202.01 (D.13) - No
parking lot landscaping required for this project (RA zoning, 10 parking spaces).
Comment 9-Transportation Improvements:
Rendering/cross-sections of the proposed commercial entrance should be provided in the plan set to be
reviewed by Staff and VDOT in order to fulfill compliance with agency review comments associated with
the CUP. Per the CUP, a commercial entrance would be required to the site from Route 277.
Response: Commercial entrance provided and VDOT approved, see cross -sections sheet 8.
Comment 10-Agency Approvals:
Comment sheets (approvals) are required from the following agencies: the Frederick County Inspections
Department, the Frederick County Fire Marshal, the Health Department, The Virginia Department of
Transportation (VDOT), and the Frederick County Engineer (Public Works).
Response: Approvals are attached with this submittal.

Dear Elvira Nursery LLC :
This letter and the attached drawings, specifications and calculations dated April 07, 2017 constitute
your permit to install a sewage disposal system on the property referenced above. Your application for a
permit was submitted pursuant to §32.1-163.6 of the Code of Virginia, which requires the Virginia
Department of Health (VDH) to accept designs for onsite sewage systems from individuals licensed as
Professional Engineers (PEs). This law allows PEs to design onsite sewage systems that do not fully
comply with the Sewage Handling and Disposal Regulations (12 VAC 5-610-10 et seg) and requires
VDH to accept such designs provided they comply with standard engineering practices, performance
requirements set by the Board of Health, and certain horizontal setback requirements necessary to protect
public health and the environment. VDH hereby recognizes that the design submitted by Kepler, Randy,
P.E. complies with the requirements of the Code of Virginia and the Regulations for Alternative Onsite
Sewage Systems and grants permission to install the system as designed in the area shown on the
attached plans and specifications.
If modifications or revisions arc necessary between now and when the system is constructed, please
contact the PE who designed the system upon which this permit is based. Should revisions be necessary
during construction, your contractor should consult with the PE. The PE is authorized to make minor
adjustments in the location or design of the system provided that adequate documentation is provided to
the Frederick County - City of Winchester Health Department.
The PE that submitted the design for this permit is required by the Sewage Handling and Disposal
Regulations to conduct a final inspection of this sewage system when it is installed and to submit an
inspection report and completion statement to the Frederick County - City of Winchester Health
Department. The health department is not required to inspect the installation, but may do so at its sole
discretion. The sewage system may not be placed into operation until you have obtained an Operation
Permit from the Frederick County - City of Winchester Health Department. If your PE did not submit an
Operation and Maintenance Manual for review and approval with the plan package, then (s)he will be
required to do so prior to issuance of an Operation Permit.

This Construction Permit is null and void if site and soil conditions are changed from those shown on
your application or if conditions are changed from those shown on the attached plans and specifications.
VDI-I may revoke or modify any permit if, at a later date, it finds that the system would threaten public
health or the environment.
This permit approval has been issued in accordance with applicable regulations based on the
information and materials provided at the time of application. '['here may be ether local, state, or federal
laws or regulations that apply to the proposed construction of this onsite sewage system. The owner is
responsible at all times for complying with all applicable local, state, and federal laws and regulations. If

This permit expires November 03, 2018. This permit is not transferable to another owner or

• Your system must have a satisfactory inspection at the time of installation. This will be done by the
designer of your permitted system, a private OSE or PE. Your OSE or PE must submit a copy of the
inspection results, complete with an as -built diagram, to the Health Department.
• Please ensure that your contractor turns in a Completion Statement to the local Health Department after
installation.
• If your permit is for an alternative system, you must sign, have notarized, and record the attached Notice
of Recordation in your locality's land records. Please bring proof of this recordation to the local Health
Department
IF YOUR PERMIT IS FOR BOTH A SEPTIC SYSTEM
AND WELL YOU WILL ALSO NEED
• Your well must have satisfactory inspection results after installation. Please give the Health Department
several days notice to schedule this inspection before your Operation Permit will be requested.
• The Health Department must receive a copy of your water sample test result being negativelsatisfactory
for coliform bacteria. You are responsible for performing this test and ensuring the results are received at
the Health Department
• Please ensure that your Well Driller submits a Uniform Water Well Completion Statement or GW-2 to
the Health Department, including documentation of a proper well abandonment if required by permit
Allow 5 business days after the last piece of documentation is received for the Operation Permit to be
issued. To avoid delays, clearly label each piece of documentation with the property Tax Map number
and HDID number shown above and on your construction permit Please note that due to the individual
circumstances ojyour permit there may be additional required itents not covered by this checklist.

A VDOT review has been conducted for the Elvira Landscaping site plan with a revised signature date of August
23, 2017. Based off of the review of the drawings, all of the previous VDOT comments have been addressed
and the site plan is approved by our office. Please ensure that all applicable agencies have the most recent set
of approved drawings.
We offer the following general comments:
• This office needs two signature sets of the approved plans and one PDF for permitting purposes.
• Our review and comments are general in nature. Should details be overlooked during plan review or
conditions in the field exist such that additional measures are warranted, such measures shall be
completed to the satisfaction of the department.
• Materials used and methods of construction shall adhere to the current observed VDOT Road and
Bridge Specifications, Road and Bridge Standards, Manual on Uniform Traffic Control Devices, and Land
Use Permit Special Provisions.
• A preconstruction conference shall be held by the engineer and/or the developer with the attendance
of the contractor, various County agencies, utility companies, and VDOT prior to initiation of work.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
• Any construction related changes to the approved plan must come through the design engineer to
VDOT for approval. Please allow a minimum of 5 business days for VDOT review.
• A Land Use Permit shall be obtained before any work is performed on the State's right-of-way. The
permit is issued by this office and may require application fees, the salary & expenses of a State
assigned inspector, and surety bond coverage.

Dear Mr. Kepler:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan may not be approved until the issues in this letter, as well as all issues of the
other review agencies, have been adequately addressed. Please review Staff s comments
listed below and then prepare a revised site plan which adequately addresses each
concern.
Review Comments:
1) Site Plan Number. The site plan reference number, SP #44-16 should be added
to all sheets in the plan set.
2) Previous Approvals: Add "Previous Approvals," and include Conditional Use
Permit (CUP) #05-16. Please also provide a signed letter (or acknowledgment in
the Review Agency Comments) from the Health Department confirming the
number of proposed employees and customers can be handled by the existing on -
site septic system, as required by Condition #1 of the aforementioned CUP. This
may ultimately affect the total occupancy and the amount of parking that can be
provided on site.
3) Disturbed Area. Update the disturbed area calculation, as applicable, to reflect
any new land disturbance (i.e. paved parking, entry widening, commercial
entrance, display areas etc.).
4) Use. Revise the current use to "Vacant/Agricultural/Residential" and revise the
proposed use to "Retail Nursery/Landscaping Business" as consistent with the
approved CUP.
5) Setbacks. On Sheet 2, please provide the proposed/existing building, parking and
sign setbacks, to show conformance with the Zoning Ordinance requirements.

6) Parking. Revise the required/proposed parking as applicable with comment 2
above, and as consistent with the revisions made to Sheet 4. Please refer to Staff s
email dated November 17, 2016 specifying how the parking should be delineated
based on Zoning Ordinance requirements. Please provide this breakdown on
Sheet 2.
7) Outdoor Lighting. Clarify if any outdoor freestanding or building -mounted
lighting will be provided and add a note specifying it will meet the outdoor
lighting standards requirements of the Frederick County Zoning Ordinance. If no
outdoor lighting is proposed, please add a note to this effect on Sheet 4.
8) Landscaping. On Sheet 4 please provide calculations showing the required and
proposed perimeter and interior landscaping as required by the Zoning Ordinance.
Further a 36-inch tall evergreen screen or berm is required for parking areas; see
Staff notes on plan set. Please also include the required landscaping notes
regarding planting, maintenance and replacement on Sheet 4.
9) Transportation Improvements. Renderings/cross-sections of the proposed
commercial entrance should be provided in the plan set to be reviewed by Staff
and VDOT in order to fulfill compliance with agency review comments
associated with the CUP. Per the CUP, a commercial entrance would be required
to the site from Route 277.
10) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County
Fire Marshal, the Health Department, the Virginia Department of Transportation
(VDOT), and the Frederick County Engineer (Public Works).
After you have revised the site plan, please resubmit one (1) copy (via email) so that Staff
may verify the information contained on the plan addresses the above comments. Staff
will also need all approved review agency comment sheets and at least five (5) copies of
the final plan, including a digital copy via PDF, for approval. Do not hesitate to contact

Randy, the number of parking spaces should be determined by the SF of the space, please refer to the parking required for retail
nurseries and general offices (1 per 400 SF of enclosed floor area,1 per 3,000 SF of out -side display area;1 per 250 SF of office).
Please submit as you see fit but provide a breakdown of how the SF will be utilized by offices, etc. If the required number of spaces is
under 10, gravel parking may be utilized; if it exceeds 10 spaces it will need to be paved. For paving we would accept double prime and
seal if Edwin would like spaces in excess of 10 that would trigger the required paving. VDOT will ultimately decide if the entrance/drive
will need to be paved as it relates to Route 277.
Further, I would reiterate my earlier comment about providing a letter from the Health Department specifying if the current septic
system can handle the anticipated use of residents, employees, and customers. We will want to see verification before we will approve
the site plan.

Tyler, I have the fee check and will be sending it down.
Regarding the asphalt. The client is trying to get this started up with minimum costs. He is willing to do what is needed
but if can would like to keep work to a minimum. The number of parking spaces was the client's wish but not a
requirement. If we knock back the number of spaces to 9 can we keep the other areas as gravel? Most of the 9 spaces
around the buildings are already asphalt.
