Dear Mr. Dunlap:
The above -referenced site plan was approved on November 21, 2019. The site plan is approved for a
87,727+/- square foot (SF) self -storage facility in the M1 (Light Industrial) Zoning District in the
Stonewall Magisterial District. The plan also includes a future outdoor storage area, 90,730+/- SF, site
landscaping and site lighting.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan.
Attached are three (3) hard copies of the signed site plan by the Zoning Administrator. Please forward
these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should
be kept for future reference, and an approved copy must be kept on the construction site throughout
the development process. Further, once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or

Buildings shall comply with The Virginia Uniform Statewide Building Code Sections 311, S
Storage and Section 304, B-Business Use Groups of the Virginia Building Code/2015. Other
Code that applies is ICC Al 17.1-3-09 Accessible and Usable Buildings and Facilities and
International Energy Code 2015.
Proposed three story, 77,227 and a single story 10,500 self -storage facility shall meet height and
area per T506 with applicable increases. Both self -storage facilities require an NFPA 13 system.
Current site plan indicates only the three story is equipped. The single -story facility shall
provide a fire barriers to reduce the fire areas to less than 2500 square feet.
Accessible parking and unloading provided closest to main entrance of office. Accessible
parking and unloading area shall not exceed 2% slope (1:48). Accessible van space provided as
required. Parking is provided in accordance with T1106.1(1) of the IBC. Signage for parking
shall be provided as required per US BC 1106.8
Walkways shall maintain a 1:20 slope. Accessible curb ramps shall meet ANSI A 117.1-09,
Section 406.1.
Office area shall meet the requirements for the Virginia Energy Code. Public restrooms shall be
provided as required T2901. Plumbing and Mechanical systems shall meet the Virginia Plumbing
and Mechanical Codes 2015
All structural plans submitted for permit application shall be sealed by a VA Design Professional
Special inspection requirements of Chapter 17 of VBC shall apply to this type of structure.

A VDOT review has been conducted for the Winchester Self Storage site plan dated August 15, 2019. Based on
the review of the drawings, all of the VDOT requirements are addressed and the site plan is approved by our
office. Please ensure that all applicable agencies have the most recent set of approved drawings.
We offer the following general comments:
• Our review and comments are general in nature. Should details be overlooked during plan review or
conditions in the field exist such that additional measures are warranted, such measures shall be
completed to the satisfaction of the department.
• Materials used and methods of construction shall adhere to the current observed VDOT Road and
Bridge Specifications, Road and Bridge Standards, Manual on Uniform Traffic Control Devices, and Land
Use Permit Special Provisions.
• A preconstruction conference shall be held by the engineer and/or the developer with the attendance
of the contractor, various County agencies, utility companies, and VDOT prior to initiation of work.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
• Any construction related changes to the approved plan must come through the design engineer to
VDOT for approval. Please allow a minimum of 5 business days for VDOT review.
• A Land Use Permit shall be obtained before any work is performed on the State's right-of-way. The
permit is issued by this office and may require application fees, the salary & expenses of a State
assigned inspector, and surety bond coverage.

RENTAL AGREEMENT
Winchester Self Storage
This agreement dated , between
(hereinafter referred to as "TENANT") and Winchester Self Storage (hereinafter referred to as
"MANAGEMENT").
MANAGEMENT does hereby rent to TENANT storage unit number (_ x ) in a
building located at Milton Ray Drive, Winchester, VA 22603 to be used as storage for personal
or business property for the monthly rate of payable on the first (1st) day of each month
hereinafter. Rental payment is payable in advance.
MANAGEMENT acknowledges receipt of as per your receipt, including the first (1st)
month's rent (which has been prorated to the first (1st) day of next month where applicable). All
payments made to MANAGEMENT pursuant to the agreement shall be applied first to
administrative and late charges, then the balance to accrued and unpaid rent, this agreement
shall expire on the last day of each month and automatically renew for one (1) additional month,
SUBJECT TO THE CONDITIONS ON THE NEXT PAGE. If we have not received your
payment by day of the month, your gate access will be denied. However, we will not
charge a late fee and overlock your unit until day of the month. If your payment is not
received by the 15th of the month, we will process your unit for public auction. A returned check
is subject to a charge of

i CONDITIONS
1. Tenant further covenants with Management that at the expiration of terms of this Lease, peaceable possession of the premises
shall be given to the Management, in as good condition as they are now, normal wear, Inevitable accidents and loss by fire
excepted; and the Tenant agrees not to let, sublet, or assign the whole or any part of the premises without written consent of the
Management. Tenant agrees not to affix shelving or other articles to the walls, ceiling or doors. Tenant must provide his own lock
and keep unit locked at all times, using only one lock per unit door hasp.
2. Tenant shall not place or keep In the premises explosives, flammable liquids, contraband or other goods prohibited by the law
and agrees to abide by any rules promulgated by Management governing the use of these premises. Tenant shall not permit
damage to the premises and shall indemnify and hold Management harmless from any claim or cause of action arising out of
Tenant's use of the premises. Tenant assumes responsibility for any loss or damage to property stored by Tenant in the premises
and may or may not elect to provide insurance coverage for the same. MANANGEMENT DOES NOT MAINTAIN INSURANCE FOR THE
BENEFIT OF TENANT, WHICH IN ANY WAY COVERS ANY LOSS WHATSOEVER THAT TENANT MAY HAVE OR CLAIM BY RENTING THE
STORAGE SPACE OR PREMISES AND EXPRESSLY RELEASES MANAGEMENT FROM ANY LOSSES AND/OR DAMAGES TO SAID
PROPERTY CAUSED BY FIRE, THEFT, WATER, RAINSTORMS, TORNADO, EXPLOSION, RIOT, RODENTS, CIVIL DISTURBANCES,
INSECTS, SONIC BOOM, LAND VEHICLES, UNLAWFUL ENTRY, MILDEW, OR ANY OTHER CAUSE WHATSOEVER, NOR SHALL
MANAGEMENT BE LIABLE TO TENANT AND/OR TENANT'S GUEST OR INVITES OR AGENTS WHILE ON OR ABOUT MANAGEMENT
PREMISES.
3. All leases expire on the last day of each month. The management may terminate said lease at his option If Tenant is not in full
compliance with the terms of this Lease, subject to Management's approval. TENANT'S FAILURE TO VACATE THE PREMISES
OR REMOVE THEIR LOCK ON THE LAST DAY OF THE MONTH AUTOMATICALLY RENEWS THE LEASE FOR ONE (1)
MONTH.
4. Tenant agrees to give Management ten (10) days written notice of his Intention to vacate his storage unit. THERE ARE NO
PRORATED RENT REFUNDS IN THE EVENT THE UNIT IS VACATED BEFORE THE LAST DAY OF THE MONTH. If the unit is
vacated on or after the first of the month, a full month's rent is due.
5. Rental payments are due on the first (1st) of each month without demand. Payments made after day _ of the month are
subject to a Late Charge. Mailed payments must be postmarked by day _ of the month to avoid the Late Charge. If
rental payments are not paid In full within five (5) days of; the due date, Including Late Charge, and/or Returned Charge, of
Miscellaneous Charge, the Management may, at his option, declare the Tenant in default. No notice need be given of default.
MANAGEMENT DOES NOT SEND OUT BILLINGS FOR MONTHLY RENTAL CHARGES.
6. The Management may, at his option, take possession of the goods In the Storage Unit on or after day _ of the month if full
payment is not received by the date. Taking possession of the goods shall consist of over -locking the Storage Unit door
to prevent Tenant's access to the Storage Unit until all rental, late fees and miscellaneous charges are paid in full.
7. The personal property In Storage Unit may be sold to satisfy the lien if Tenant is in default. Management shall have a lien on all
personal property stored within each Storage Unit for rent, labor, or expenses reasonably incurred in the sale, pursuant of Virginia
General Statues. All moving, storage and/or sales costs associated with sale of goods shall be borne by Tenant. After a lien against
the personal property in the unit arises, ONLY A PAYMENT IN THE FULL AMOUNT OF THE LIEN WILL BE ACCEPTED TO
SATISFY LIEN, PARTIAL PAYMENTS WILL NOT STOP ANY AUCTION PROCEDURES OR LEGAL ACTIONS.
8. The Management may, at his option, REMOVE THE TENANT'S LOCK AT TENANT'S EXPENSE TO APPRAISE STORED
GOODS FOR SALE. The administrative charge for lock cutting Is . Management may at this time move property to
another location to be stored and Tenant agrees to be solely liable for any damage, loss or expenses incurred by his action. And the
parties agree that Management shall have a lien upon all personal property stored in the unit to secure payment of this charge, as
well as all other charges owed to Management. If the rental account Is brought current, the Management shall remove its
lock. IT IS THE TENANT'S RESPONSIBILITY TO REPLACE HIS LOCK AT THE TIME OF PAYMENT TO INSURE THE
SECURITY OF HIS STORAGE UNIT AND TO SECURE HIS STORAGE UNIT BY A LOCK (only one lock per unit door hasp).
AT ALL TIMES, MANAGEMENT WILL NOT SUPERVISE USE OF UNIT IN ANYWAY. THE SAFETY OF ITEMS STORED BY THE
TENANT IS THE RESPONSIBILITY OF THE TENANT.
9. In the event Management is required to obtain the services of an attorney to enforce any of the provisions of this Lease, Tenant
agrees to pay in addition to the sums due hereunder, an additional amount as and for attorney's fees and cost incurred.
10. Management will have the right in the event of an emergency to enter, the storage unit with what ever reasonable force is
necessary. They may at their discretion, deny access to premises in case of inclement weather or emergencies. ' '
11. A returned check Is subject to a charge of , which shall be considered part of the rental. Unit shall be In default and
overlocked by Management, until amount of the returned check, returned check charge, and any additional charges due are paid in
full. Payment must be made by money order or certified check.
12. The Monthly Rental rate, deposit amount, late charge, cut -lock, and returned check charge are each subject to Increase on day
_ of each month. Tenant shall be given thirty (30) days written notice of such increases and this Lease shall be deemed to be so
altered if the Tenant continues his occupancy beyond the effective date of the increase. Notice shall be deemed given when
Management deposits first-class mail, postage prepaid to Tenant at address given on this Lease or official change of address.
Tenant shall apprise Management of any change in his/her mailing address In writing within twenty (20) days of such
change. A new Lease does not have to be executed for any new rental rate Increases.
13. All tenants In default or tenants having prior returned checks, must pay by money order. All tenants must pay by check/money
order, unless paying In person.
14. Any right granted herein to Management may be exercised by Management's Rental Agent or other representative or agent.
15. The covenants herein contained shall extend to and be binding upon the parties hereto, their heirs, executors, administrators
and assigns.

The following represents Dice Engineering, PLC responses to your comments provided via
letter concerning the Winchester Self Storage site plan review. Review comments are shown
in bold italics. I am responding on a point -by -point basis to correlate with your comments.
1. Site Plan Reference. Add the site plan reference number, SP #28-19, to the Cover
Sheet. The County site plan reference number (#28-19) has been added to the Cover
Sheet, and also is included at the lower right corner of all sheets (see sheets C-01 to C-
23).
2. Self -Storage Facilities. Add a note to Sheet C-01 specifying the self -storage
facility will be in conformance with Frederick County Zoning Ordinance §165-
204.18 requirements for self -storage facilities. Provide a copy of the self -storage
facility lease agreement for the project file per §165-201.18 (G). The referenced
note has been added (see Project Note #25, sheet C-01). The lease agreement has not
been generated by the Owner yet; this document will be provided to the Planning Dept.
for the file once it is available.
3. Project Information and Notes. The following revisions on Sheet C-01:
Previously Approved Plans. Add a reference to Rezoning Applications (REZ)
#17-06 and #03-17 and Master Development Plans (MDP) #04-02 and #14-06.
Include a copy of the most recent proffers statement and Generalized
Development Plan (GDP) on a subsequent sheet (REZ #03-17 proffer statement
attached). The references to the previously approved plans are provided (see
Project Information, sheet C-01). The most recent proffers and GDP are provided
(see sheet C-21).
Address. Provide the street name, Milton Ray Drive. Staff acknowledges a
street address may not be assigned until building permits are submitted.

to the number of parking spaces depicted on subsequent sheets. Due to some
building and layout changes, the parking counts have been revised accordingly.
Consequently, there are now 19 parking spaces shown, and those are listed as
provided under the parking calculations (Project Note #10, sheet C-01).
o Signs. Update Note #22 referencing the allowed freestanding monument style
sign height to 12'. The referenced note is revised to state that the maximum sign
height is 12' (see Project Note #22, sheet C-01).
4. Parking Areas. Specify the dimensions of provided parking spaces on Sheet C-
05. Specify if curb and gutter (minimum 6" height) is to be provided around the
proposed parking area, or if it is the intent of the designer to provide low -impact
development (§165-202.01(3)(c)). The parking space dimensions (typical space is 10'
x 18') are provided (see sheet C-05). A note is added stating that no curb and gutter is
proposed and low -impact development will be incorporated into the stormwater
management design (see Note #1, sheet C-05).
5. Buffers. Add a note specifying that no buffer is required between the M1 use and
adjacent B2 (General Business) uses south of the existing railroad tracks, citing
the exemption specified in §165-203.02(D)(9). A note is added referencing the buffer
exemption between M1 and B2 zoning (see Note #1, sheet C-08).
S. Outdoor Storage. On Sheet C-05, specify the square footage (SF) for the
proposed "Future Storage". The area of the future storage is now provided (see
sheet C-05).
7. Site Lighting. A photometric plan, which includes all free-standing and building -
mounted fixture details and minimum, maximum, and average illumination levels,
should be provided for review by Staff. Notes specifying that all lighting will
conform to Section §165-201.07 of the Frederick County Zoning Ordinance and will
be downcast and full cutoff should also be included. The lighting plan with fixture
types, mounting heights, and typical fixture details is now included (see sheets C-22 and
C-23).
8. Agency Aaarovals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County
Fire Marshal, the Virginia Dept. of Transportation, Frederick County GIS, Frederick
Water, and the Frederick County Engineer (Public Works). Please find attached the
approved comment sheets received to date. The remaining approved comment sheets
will be provided once obtained.

We offer the following general comments:
• Our review and comments are general in nature. Should details be overlooked during plan review or
conditions in the field exist such that additional measures are warranted, such measures shall be
completed to the satisfaction of the department.
• Materials used and methods of construction shall adhere to the current observed VDOT Road and
Bridge Specifications, Road and Bridge Standards, Manual on Uniform Traffic Control Devices, and Land
Use Permit Special Provisions.
• A preconstruction conference shall be held by the engineer and/or the developer with the attendance
of the contractor, various County agencies, utility companies, and VDOT prior to initiation of work.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
• Any construction related changes to the approved plan must come through the design engineer to
VDOT for approval. Please allow a minimum of 5 business days for VDOT review.
• A Land Use Permit shall be obtained before any work is performed on the State's right-of-way. The
permit is issued by this office and may require application fees, the salary & expenses of a State
assigned inspector, and surety bond coverage.

can be granted. At this time, administrative approval cannot be granted. This site plan cannot be
approved until the issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staffs comments listed below and then prepare a revised site
plan which adequately addresses each concern.
Review Comments:
