Dear Mr. Heck:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan will not be approved until the issues in this letter, as well as all issues of the other
review agencies, have been adequately addressed. Please review Staffs comments listed
below and then prepare a revised minor site plan which adequately addresses each concern.
Review Comments:
1) Site Plan Reference Number. Add the Site Plan reference number, #23-19.
2) Project Information. The following changes should be made to Sheet 2:
• Disturbed Area: Specify the total disturbed area for the site.
• Parking: Update the use to "Retail/Convenience Store," the requirement to
1 parking space per 200 SF, and the total number of spaces required to
"24."
• Loading Areas: Update the required loading spaces calculation to "Food
Stores/Retail" and the tabulation to 1 loading space per 10,000 square feet
(SF) per the Frederick County Zoning Ordinance § 1 65-202.02(A)(1).
• Signnage: Include details of the proposed sign, including required/provided
sign setbacks, height (I5-feet)and sign area (150 SF) allowed, and height
and sign area proposed. A note should be added that it is the intent of the
owner to reface the existing pole -mounted sign (and not increase the
existing height/SF), and that any new signage requires a separate building
permit.

3) Outdoor Trash Receptacles., On Sheet 5, add a note that the dumpster area
should be screened with a 6-FT tall board -on -board fence or wall per the
Frederick County Zoning Ordinance § 165-204.11(D)(4).
4) Landscaping & Screening. Per Frederick County Zoning Ordinance § 165-
201.01(13)(a) a 36-inch evergreen hedgerow is required to screen headlights from
adjacent properties and roadways; a screen is required for the parking spaces facing
west (Route 37 ramp). See staff markup on Sheet 14.
A note should be added to the plans that specifies conformance with Fredrick
County Zoning Ordinance § 165-203.01, and that any existing landscaping that does
not conform to the Zoning Ordinance requirements at time of occupancy may need
to be replaced.
5) Site Lighting. Two light fixtures lighting levels adjacent to the private
ingress/egress exceed the 5.0 footcandles allowed at any property line adjacent to a
road right-of-way under the Frederick County Zoning Ordinance § 165-
201.07(D)(4). The lighting level should be reduced, or the fixtures reoriented or
removed to prevent excessive lighting levels. See staff markup on Sheet 15.
Add a note to the Photometric Plan that all lighting will conform to Frederick
County Zoning Ordinance § 165-202.07.
Specify the mounting height for all lighting fixtures, not to exceed 25-FT.
6) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: Frederick County Building Inspections, the Frederick County Engineer
(Public Works), Frederick Water, the Virginia Department of Transportation
(VDOT), the Virginia Department of Health (VDH), and the Frederick County Fire
Marshal.
Additional Staff Recommendations:
7) Architecture & Design. Architectural renderings and/or building elevations
should be provided, as available, to accompany the project file.
8) Site Lighting. Staff recommends removal of the building -mounted lighting fixtures
on the rear of the structure, as there does not appear to be a building ingress/egress
or other security purpose and given the buildings close proximity to the Route 37
ramp.

the information contained on the plan addresses the above comments. Staff will also need

The above -referenced site plan was approved on August 26, 2019. The site plan is approved the
redevelopment of 1490 North Frederick Pike to a 4,800 square foot (SF) convenience store with fuel
pumps in the B2 (General Business) Zoning District in the Stonewall Magisterial District. Site
improvements also include landscaping, site lighting, re -facing an existing sign and parking.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan.
Attached are three (3) hard copies of the signed site plan by the Zoning Administrator. Please forward
these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should
be kept for future reference, and an approved copy must be kept on the construction site throughout
the development process. Further, once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or

A VDOT review has been conducted on the site plan for Holtzman Oil Corporation for a new gas station
convenience store off North Frederick Pike, Route 522 dated June 5, 2019 and as received by this office June
13, 2019. We have no objection to the site plan as no work is being shown on VDOT right-of-way. We strongly
recommend you consider shifting the first entrance approximately 100' north to align with the entrance across
the street. The first entrance as shown is too close to the signalized intersection and with the increase traffic
generated by this development, there is the potential at times for this entrance to be blocked and unusable
due to cars queued at the traffic signal.
Should any work be performed on the VDOT right-of-way, a Land Use Permit is required.

This Health Department has reviewed the request for Site Plan comments to redevelon an
existing site located at the Northwest corner of the intersection of North Frederick Pike
and Fox Drive: Tax Man #: 42-5-C 1. The proposal consists of the demolition of an
existing restaurant structure, to be replaced by a proposed convenience store. The
construction will apparently not impact any area outside of the boundazy of the existing
site. In addition, Frederick Water and Sanitary Authority will serve the new site. This

(Mercantile) Virginia Building Code/2015. Other codes that apply are ICC/ ANSI A117.1-2009 Accessible and
Usable Buildings and Facilities, National Fire Protection Agency 30 and International Fire Code 2015.

Building plans submitted for permitting for proposed canopy shall be designed by a registered design
professional licensed in the State of Virginia.
Installation of gas fueling equipment and fuel storage tanks shall be in accordance with the International Fire
Code 2015 & NPFA 30. Emergency fuel shut off is required within 100' of fueling station.
Grease interceptor is located outside of the building.
Handicap parking shall comply with ANSI A117.1-09. Van accessible parking shall have a minimum of
11' width with 5' unloading area or a minimum of 8' unloading area with an 8' width. Maximum 2%
slope required for parking and unloading.
Door entrances shall be provided with a landing. Maximum slope of landing is 2%. Question on landing
at door.
Maximum threshold at door shall not exceed'/2".
Walkways shall not exceed 5% slope. Slopes exceeding 5% shall be designed as ramps.
Ramps require handrails on both sides of the ramp. A landing shall be provided at the top and bottom of
the ramp.
Please note the requirements in Chapter 17 of VBC for special inspection requirements on the type of structure
(Soils, concrete etc.) Geotech report is required.

County Zoning Ordinance §165-202.07.
Specify the mounting height for all lighting fixtures, not to exceed 25-FT.
Response: Site lighting has been adjusted to meet the FCZO requirements and a

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan will not be approved until the issues in this letter, as well as all issues of the other
review agencies, have been adequately addressed. Please review Staff s comments listed
below and then prepare a revised minor site plan which adequately addresses each concern.
Review Comments:
1) Site Plan Reference Number. Add the Site Plan reference number, #23-19.
2) Proiect Information. The following changes should be made to Sheet 2:
• Disturbed Area: Specify the total disturbed area for the site.
• Parking: Update the use to "Retail/Convenience Store," the requirement to
1 parking space per 200 SF, and the total number of spaces required to
"24."
• Loading Areas: Update the required loading spaces calculation to "Food
Stores/Retail" and the tabulation to 1 loading space per 10,000 square feet
(SF) per the Frederick County Zoning Ordinance §165-202.02(A)(1).
• Signage: Include details of the proposed sign, including required/provided
sign setbacks, height (I5-feet)and sign area (150 SF) allowed, and height
and sign area proposed. A note should be added that it is the intent of the
owner to reface the existing pole -mounted sign (and not increase the
existing height/SF), and that any new signage requires a separate building
permit.
