Dear Ms. Gaddy:
The above -referenced site plan was approved on August 18, 2016. The site plan is approved for
minor site revisions and additions to the existing Taco Bell Restaurant located at 125 Welltown
Road in the Stonewall Magisterial District. Improvements include cooler addition, pavement
upgrades, replacement of the canopy and signage and landscaping upgrades.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions
or concerns.

Buildings shall comply with Virginia Rehabilitation Code, 2012, The Virginia Uniform
Statewide Building Code 2012 and section 303 - A,Assembly Use Group. Other Code that
applies is ICC/ANSI A 117.1-09 Accessible and Usable Buildings and Facilities and International
Energy Code 2012. Structural plans submitted for permit application shall be sealed by a
Virginia Licensed Design Professional.
Addition of freezer requires a building permit and design for exterior exposure to elements i.e
snow load, wind load etc.
Renovations shall comply with the Virginia Rehabilitation Code.
20% ANSI Rule Applies.
Handicap parking shall comply with ANSI A 117.1-09. Van accessible parking/unloading shall
have a minimum of 11' width with 5' unloading area or a minimum of 8' unloading area with
an 8' width. Car unloading area shall provide a minimum of 5' unloading area. Max slope of
parking and unloading area is 1:48
Relocation of Accessible parking shall maintain the required 2% slope for both the parking and
unloading areas. IBC 1106.6 requires HC parking to be located on the shortest accessible route
of travel from adjacent parking to the accessible building entrance. Approaches and door
clearances for main exit/entrance shall comply with ANSI A117.1-09. Maximum threshold
allowance is %". Landings shall not exceed 1":48" slope. Walkways shall not exceed 5% (1" in
20") slope.
Accessible transition from parking and accessible route shall comply with ANSI A117.1-09.
Curb ramps shall comply with Section 406 ANSI Al 17.1-09.
Please note the requirements in Chapter 17 of ICC for special inspection requirements on the
type of structure.( Soils, concrete ect..). Slabs with greater than 24" gravel or 8" earth requires
an engineer design.
Signs are required to have a permit.

Dear Ms. Gaddy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staff s comments listed below and then prepare a revised
site plan which adequately addresses each concern.
Review Comments:
1) Signature Block. Please move the signature block for the Zoning Administrator to the
coversheet.
2) Landscaping. On sheet 2 — add that the evergreen shrubs must be 36" tall — typically the
three gallon container shrubs don't meet the height minimum.
3) Lighting Plan. The coversheet references an electrical lighting plan — if modified or new
outdoor lighting is proposed for this site it needs to be submitted to this office for review
and approval.
4) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Health Department, and the
Frederick County Fire Marshal.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets and at
least five copies of the final plan for approval.

Response to Comment is A Special Limited Power of Attorney form has been completed
giving Rosa Gaddy authority to submit the Site Plan and complete the permitting process.
Response to Comment 2: A signature block has been provided on Sheet SPiol for the
Zoning Administrator, including the 5-year expiration language.
Response to Comment 3: The following information has been provided on the Sheet
SPioio. Property Identification Number (PIN), site address, building restriction lines,
and landscaped area. No new site signage is being added.
Response to Comment 4: Provided alternating evergreen shrubs (Boxwood and Carissa
Holly) along the parking lot facing Welltown Road.
Response to Comment 5: Landscape Notes on Sheet SPioi have been updated to include:
A. All planting shall conform with §1.65-203.0113 of the Frederick County Zoning
Ordinance (Plant Section, Planting Procedure, and Maintenance).
B. Any Plant substitutions must be approved in writing by the Frederick County
Planning Department.
C. The Landscape Schedule and Plan has been updated to reflect the Owner's plant
material preference.
