Dear Mr. Roderick:
The above -referenced site plan was approved on April 28, 2016. The site plan is approved for revisions
and additions to an existing restaurant site (former Texas Steakhouse) located at 120 Front Royal Pike in
the Shawnee Magisterial District. Improvements include a drive thru window addition and minor rear
building additions, outdoor patio area and minor parking revisions.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to
contact me if you have any questions or concerns.

Buildings shall comply with The Virginia Uniform Statewide Building Code 2012 and Virginia
Rehabilitation Code 2012. Other Code that may apply are ICC/ANSI Al 17.1-09 Accessible and
Usable Buildings and Facilities and international Energy Code 2012. Structural plans submitted
for permit application shall be sealed by a Virginia Licensed Design Professional.
Existing Restaurant remodel shall conform to the requirements of the Virginia Rehabilatation
Code for new use. Renovations to the existing structure requires a building permit. An asbestos
inspection is required on renovations to existing buildings constructed prior to 1985.
Additions to the existing building shall not create any extension of nonconformity in the code or
make any nonconformity worse. Additions to the building shall be addressed as separate fire
areas or a sprinkler system may be required.
Main entrances into areas larger than 3000 sq tt require a vestibule per USBC/International
Energy Code.
Handicap parking shall comply with ANSI A117.1-09. Van accessible parking/unloading she
have a minimum of I V width with 5' unloading area or a minimum of 8' unloading area with
an 8' width. Car unloading area shall provide a minimum of 5' unloading area. Max slope of
parking and unloading area is 1:48
IBC 1106.6 requires HC parking to be located on the shortest accessible route of travel from
adjacent parking to the accessible building entrance. Approaches and door clearances for main
exit/entrance shall comply with ANSI A 117.1-09. Landings shall not exceed 1 ":48" slope.
Walkways shall not exceed 5% (1" in 20") slope.
Existing handicap parking has been removed Please identify the location of the handicap
accessible parking. Please ident fy the accessible route from the parking/unloading area to
the curb ram and provide elevation marks along accessible walkway to main entrances)
Please note the requirements in Chapter 17 of ICC for special inspection requirements on the
type of structure.( Soils, concrete ect..).
Signs are required to have a permit.

Dear Mr. Roderick:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff's comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments:
1) Signature Block. A signature block needs to be provided for the Zoning
Administrator, along with the five year expiration language.
2) Photometric Plan. Indicate the type of lighting present on the site (wall
pack/building or pole mounted). Provide a note that states all lighting must be full
cutoff.
3) Project Information. Provide the following: property identification number (PIN),
site address, building restriction lines (minimum and provided), landscaped area
(minimum and provided), and signage references.
4) BRL's. Show the BRL's on the plan — please note that the BRL's for Route 50 and
Route 522 are both 50'.
5) Landscaping. Evergreen (36" at time of planting) shrubs need to be provided along
the parking spaces that face Route 50 and Route 522 as indicated. Label the number
of existing deciduous trees on the site.
6) Dumpster Area. Label the dumpster area — please note that this area needs to be
fully enclosed with a 6' board on board fence or masonry enclosure.
7) Handicap Spaces. Show the location of the handicap accessible spaces.
8) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County Fire
Marshal and the Virginia Department of Health.

NARRATIVE STATEMENT February 17, 2016
Gentle Harvest, LC purchased PIN # 64-A-1C with the intent to continue
employing uses acceptable to current zoning regulations for Zone B-2, namely that of
`restaurant'. Said property is located on the southwest corner lot at the intersection of
Front Royal Pike and Millwood Pike. Currently, the property is developed for a
restaurant use, though no tenant exists; the previous tenant was Texas Steakhouse.
The existing structure will be preserved, with minimal building expansion areas.
Expansion areas will include —120 SF along the front and —250 SF in the rear, and will
not further encroach upon setbacks; existing structure encroaches into front 35' setback
by approximately 8'. As a part of this Minor Site Plan, we are proposing limited
pavement re -striping, to accommodate a drive-thru lane meeting minimum requirements
set forth in County Code.
In addition to minor building expansion areas and pavement restriping, the landowner
proposes to incorporate an outdoor multi -purpose area. The proposed multi -purpose area,
which will likely serve pedestrians and seated patrons, will incorporate delineation and
separation from parking / drive aisles in the form of bollards, fencing, or the like.
