The above -referenced minor site plan was approved on August 11, 2016. The minor site plan is
approved for parking and site improvements at 173 Brick Kiln Road in the Stonewall Magisterial
District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved
minor site plan, including review agency comments from all relevant review agencies. I am
providing you with three (3) copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for
future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions

Mr. Klein,
The owners have finally authorized me to address your comments and
resubmit. The Fire Marshal, Inspections and Public Works have approved the plans. I
still need your approval as well as VDOT's. Attached is a revised copy of the site plan
and your comments addressed below.
1. The project information has been corrected per your comment.
2. The site plan number "#22-16" has been labeled.
3. The parking setback for the spaces is a little over 29' (10' required). Hoever,
the cover sheet shows 10' since the County has also applied this to storage
areas and the new fences is 10' off of the right of way line.
4. On sheet 2, a 36" opaque fence is called out for headlight screening. I have
also labeled the 6' fence around the storage yard to be opaque and provided
a board on board detail at the bottom of sheet 2.
5. While there aren't plans to construct a dumpster pad, a location has been
identified in case they ever do.
6. A note has been added to indicate no outdoor lighting is planned at this
time. See the bottom of sheet 2.
7. Agency comments - Awaiting VDOT's approval.

A VDOT review has been conducted for the Brick Kiln, LC Site Plan with a signature date of
August 5, 2016. Based off of the review of the Drawings, all of the previous VDOT comments
have been addressed and the Site Plan is approved by our office. Please ensure that all
applicable agencies have the most recent set of approved Drawings.
We offer the following general comments:
. Our review and comments are general in nature. Should details be overlooked during
plan review or conditions in the field exist such that additional measures are warranted,
such measures shall be completed to the satisfaction of the department.
. Materials used and methods of construction shall adhere to the current observed VDOT
Road and Bridge Specifications, Road and Bridge Standards, Manual on Uniform Traffic
Control Devices, and Land Use Permit Special Provisions.
. A preconstruction conference shall be held by the engineer and/or the developer with
the attendance of the contractor, various County agencies, utility companies, and VDOT
prior to initiation of work.
. All drainage is to be carried within the right-of-way in ditch lines or gutters along the

street to a pipe or drainage easement.
. Any construction related changes to the approved plan must come through the design
engineer to VDOT for approval. Please allow a minimum of 5 business days for VDOT
review.
A Land Use Permit shall be obtained before any work is performed on the State's right-
of-way. The permit is issued by this office and may require application fees, the salary
& expenses of a State assigned inspector, and surety bond coverage.

Dear Mr. Oates:
Planning Staff has reviewed the above -referenced minor site plan to determine if
administrative approval can be granted. At this time, administrative approval cannot be
granted. This minor site plan is denied until the issues in this letter, as well as all issues
of the other review agencies, have been adequately addressed. Please review Staff s
comments listed below and then prepare a revised minor site plan which adequately
addresses each concern.
Review Comments:
1) Project Information. Provide the following: a reference to maximum height
permitted by the Zoning Ordinance (60 feet) and a reference to previously
approved site plans (SP#18-84) for the property.
2) Minor Site Plan. Please include the current minor site plan number, SP #22-16.
3) Parking Setback. On sheet 2 of 4, the minimum parking setback should be 10
feet (FT) from minor roadways; please confirm the parking area is no less than 10
FT from Brick Kiln Road.
4) Landscaping and Fencing. On sheet 3 of 4, please depict perimeter landscaping
(in addition to the shade trees already being provided) as required by the Zoning
Ordinance, which specifies a 3 foot tall evergreen hedge, fence or berm to prevent
headlights from shining on public rights -of -way and adjoining properties. Further
specify board -on -board fencing should be provided around the parking and gravel
storage areas.
5) Dumpster Facility. Please depict the proposed location of dumpster receptacles
on -site.
6) Outdoor Lighting. Indicate if any outdoor lighting is proposed on the site, if so
provide details. If no lighting is being provided provide a note to that effect.
7) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County
Fire Marshal, the County Engineer and the Virginia Department of

Transportation (VDOT).
After you have revised the minor site plan, please resubmit one copy so that I may verify
