Member question - Developer Constructed Facilities Mark- I received this snippet from an e-mail earlier today — and the timing was perfect as it reaffirms what we spoke of on Friday. It would appear that, as we discussed last week, the County may bond FCSA infrastructure as part of the County's bonding process. Maybe we discus maintaining the bond as a maintenance bond for 12 months after contractor completes the improvements to confirm the quality of his work? -Eric Performance Bond for the developer and/or his contractor on the work o Fairfax Water relies upon the Fairfax County bonding process to cover water infrastructure improvements. The County includes public water system improvements in the calculation of the bond amount it requires of developers. • Labor/Material Payment bond for the developer and/or his contractor on the work Maintenance Bond good for one year after you accept the improvements o Most developer installed facilities are not final accepted until well after a year, so this has never been an issue for us. Developer's typically do not request final acceptance for water mains until they are trying to get off bond with the County for the entire project. In Fairfax this is typically over a year, if not several years after mains are placed in service. We have the ability to correct any issues through the punch list issued at that time. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments 1. Lot Consolidation. A lot consolidation needs to be approved and recorded for parcels 46 and 47 before the site plan can be approved. 2. Lighting Fixtures. A photometric plan needs to be provided with this site plan submission. 3. Project Notes. On sheet 2 address the following: • Show front setbacks for Martinsburg Pike as 50' Amoco Lane as 35'. • Side and Rear setbacks for the 132 need to be 0. • Parking calculations need to be updated — 1/400sf of enclosed floor area and 1/3,000sf of outdoor display area and 2 per service bay. • Provide the number of required spaces and the number of display spaces. • Provide the actual acreage of open space. 4. Signage. The site plan shows the existing sign remaining as is, this sign needs to be brought into compliance with current standards (setbacks, type, height). 5. Amoco Lane Entrances. The first entrance on Amoco Lane needs to align with the Sheetz entrance. 6. Sidewalk. A 5' sidewalk is required along the frontage of the site. 7. Zoning District Buffer. The rear buffer shown on the plan is not required, only a Category A (50' distance buffer) is required along the adjacent M1 zoned property. 8. Parking Requirements. All spaces that are required per the calculations must meet 107 North Kent Street, Suite 202 • Winchester, Virginia 22601-5000 Re: SP #01-16; Goldstar Motors North January 20, 2016 Page 2 ordinance regulations (islands, size, curb/gutter, headlight screening). Sheet 9 needs to delineate which spaces are display. 9. Dumpster Screening. Provide a detail for the dumpster gate, ensure the gate detail provides an approved opaque screening element. 10. Landscaping Plan. Remove the grading contours from the landscaping plan; also the plant size is 2" minimum caliper. 11. Landscaping Notes. Notes need to be provided that state (1) all planting shall conform with §165-203.01B of the Frederick County Zoning Ordinance (Plant selection, planting procedure, and maintenance), and (2) any plant substitutions must be approved in writing by the Frederick County Planning Department. 12. Agency Approvals. Approval comments are required from the following agencies: the Virginia Department of Transportation, the Frederick County Inspections Department, the Frederick County Engineer, the Frederick County Fire Marshal, the Frederick County Sanitation Authority and the Virginia Department of Health. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. The property (s) are zoned B-2 (Business, General). These property (s) was cited in 2009 for the same violations and was taken to General District Court. Facts Presented Staff inspected the property on March 31, 2015, and noted motor vehicles parked in the right-of- way along Amoco Lane. Staff also noted the expansion of the car lot to property PIN 43-A-47. The property owner was cited for violation of Code of Frederick County Section 165-202.01D (6) (a) parking within a right-of-way. The property owner was cited for violation of Code of Frederick County Section 165-802.01, expansion of the car lot onto PIN 43-A-47 The property owner signed the return request of certified mail for the Notice of Violation (NOV) on April 13, 2015. Staff also cited the tenant and received return request on the same date. On May 27, 2015, staff visited the property and noted the property was not in compliance on this date. Analysis Staff in reviewing the property for compliance Code of Frederick County in regards to Section (s) 165-202.011) (6) (a) and 802.01, found the property not in compliance as of May 27, 2015. Staff met with the property owner on April 7, 2015, to show the property owner what was needed to bring the property (s) in to compliance. This included a site plan approved by Frederick County. Staff talked via phone with owner about applying for a site plan, staff has yet to receive a site plan for review. Conclusion The property owner has failed to comply with the NOV the County should proceed with a criminal complaint for these violations. Case Update This case was heard on 1 Sept 15 for a violation of the Frederick County Zoning Ordinance. The General District Court allowed the defendant time to submit a site development plan to bring the property into compliance. The defendant was heard two (2) more times in General District Court for more time (7 Dec 15 & 8 Feb 16). The defendant submitted an application for site plan to Frederick County for review. This application was reviewed by Frederick County on 20 Jan 16. (Included). This site plan cannot be approved until these comments are addressed. Furthermore, all outside agency comments need to be addressed and completed. The typical turn around for site plan is 1- 3 months. The defendant is responsible to follow-up with agency comments. As of this date this has not happened. The site is not in compliance.
