In an effort to clarify the County's access requirements applicable to the above
referenced site, the County will allow for the secondary access across the RA (Rural
Areas) zoned property to Route 11 (Martinsburg Pike). This access route is considered
secondary for the site; primary access will be through the planned Ruthersford Industrial
Park road system immediately south of the FEMA site. This primary access route is
depicted and addressed in the approved proffer statement associated with the rezoning for
the property, as well as the approved Master Development Plan.

Subject: Rutherford's Farm, Route 11 Improvements - Service Entrance Comments
Thank you for the quick turn around on the plan revisions for the subject project, as discussed
with you at the on -site meeting March 13. The proposed revisions at the north Service
Entrance (as revised March 21, 2008) and at the intersection of Merchant St./Route 11 are
approved.
This leaves only the Permanent Pavement Marking and Sign Plan on sheet 20 to be completed
and approved by VDOT. The recommended lane configuration at the North Entrance is as
shown in the attached sketch. It may be necessary to include some guide signs to indicate the
north entrance is a service entrance, not for through traffic. For the area of the 8-foot paved
shoulder along Route 11 (station 310+00 to 312+75), the recommended widening is as shown
on the 2nd page of the attached sketch. This would provide a 4-foot gravel shoulder (where
ROW permits) and extending the aggregate layer to the side slope (to improve subgrade
drainage). We can discuss these items at the next on -site meeting on Thursday, March 27,
11:00 a.m.
The issue of U-turns to Route 11 northbound, for the properties along the east side of Route
11, will be addressed by future modifications to Nulton Lane and a possible connection to
Snowden Bridge Blvd.

Dear Evan:
Frederick County administratively approved the master development plan for Rutherford's Farm Industrial
Park on November 22, 2002. The master development plan is approved for the development of 154.4
acres of land in the Stonewall Magisterial District. The zoning of the approved industrial park consists
of 116.7 acres of M 1 (Light Industrial) District, 23.2 acres of B2 (Business, General) District, 14.5 acres
of B3 (Business, Industrial Transition) District, and 3.7 acres of RA (Rural Areas) District, the latter of
which is not proposed to be developed.
All proffered conditions associated with the rezoning of the property have been acknowledged in the
master development plan. Furthermore, all noted agency comments and concerns of the Planning
Commission and Board of Supervisors have been addressed.
Please find several copies of the approved master development plan with appropriate signatures for

Virginia Dept. of Transportation: The preliminary master development plan for this property
appears to have significant measurable impact on Route 11, Martinsburg Pike, and I-81 NBL, SBL
and access ramps, the VDOT facilities which would provide access to the property. Before
making any final comments, this office will require a complete set of site plans, drainage

calculations and traffic flow data from the I.T.E. Trip Generation Manual, Sixth Edition for
review. VDOT reserves the right to comment on all right of way needs, including right of way
dedications, traffic signalization, and off site roadway improvements and drainage. Prior to
construction on the State's right of way, the developer will need to apply to this office for issuance
of appropriate permits to cover said work.
Sanitation Authority: First review: show sewer easement on western boundary; show water and
sewer line location and size.
Fire Marshal: Fire and rescue access to be maintained at all times. `Fire Lane No Parking' signs
required at all fire hydrants, normal, and emergency access points. Fire hydrants are required
within 300 feet of all portions of any commercial building. Fire hydrants to be within three feet
of the curb.
Frederick County Inspections: No comment required at this time. Shall comment at the time
of site plan review.
County Engineer: We offer no comments at this time. A comprehensive review will be performed
at the time of site plan submission.
Historic Resources Advisory Board: Please see attached letter, dated 7118102.
Airport Authority: This proposed master plan does not appear to impact operations at
Winchester Regional Airport. As sites are developed, the airport requests prior review to ensure
developments will not impact operations.
Planning and Zoning:
Site History:
The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) depicts the six
parcels, which comprise the proposed master development plan, as part of the R-3 (Residential,
General) Zoning District. On October 8, 1980, parcels 43-A-96; 43-A-98; 43-A-99; 43-A-111;
and a portion of 43-A-97 were rezoned from R-3 to A-2, during a Comprehensive Downzoning.
The A-2 (Agricultural General) District zoning classification was modified to RA (Rural Areas)
District on February 14, 1990, during the comprehensive amendment to the county's Zoning
Ordinance. The R-3 (Residential -General) District zoning classification was modified to RP
(Residential Performance) District on February 14, 1990, during the comprehensive amendment
to the county's Zoning Ordinance; this action affected 43-A-100, and a portion of 43-A-97. On
April 22, 2002, the Board of Supervisors approved the rezoning of these parcels to include 116.7
acres of M1 (Industrial, Light), 23.2 acres of B2 (Business, General), and 14.5 acres of B3
(Business, Industrial Transition). In addition, the entire 154.4 acres of land was added to the IA
(Interstate Area Overlay) Zoning District.

Comprehensive Policeman:
The parcels are within the county's Sewer and Water Service Area (SWSA) and are a component
of the Northeast Land Use Plan which was adopted by the Board of Supervisors on September 27,
2000. The parcels were also a component of the Route 11 North Corridor Plan which was
adopted by the Board of Supervisors on January 8, 1997. Both land use plans proposed future
commercial and industrial development within the area of these parcels; as well as the provision
of a Developmentally Sensitive Area (DSA) overlay along Martinsburg Pike.
The Northeast Land Use Plan also identifies a major collector road along the northern portion of
the subject tract. This planned roadway would intersect with Martinsburg Pike and travel westerly
towards I-81, and then angle towards the north. The applicant has made provisions to construct
this planned roadway.
Project Scope:
The applicant has prepared a master development plan for the development of 154.4 acres of
commercial and industrial land uses. The allotment of land in each zoning district and the general
location of land is consistent with the approved rezoning.
During the rezoning process, the applicant offered a number of proffer conditions, which were
intended to help minimize the potential impacts of development. A summary of the most
significant proffers is listed below:
• Installation of a traffic signal light at the entrance of the industrial park when
warranted by VDOT.
• Installation of a traffic signal light at the southbound ramps of the Exit 317
interchange & Route 11 when warranted by VDOT.
• Improvements to be made to Route 11 at the intersections of the two proposed
entrances to the industrial park. The improvements shall be completed within one
year of the first site plan approval, unless required during the first site plan.
• Construction of a major collector road through the property, as planned for in the
Frederick County Comprehensive Policy Plan. Each site plan in the development
which would be located along or part of the proposed road would be responsible
for building that particular segment of road.
• Construction of a third southbound lane on Route 11 from the northern most
entrance of the property to the northbound I-81 ramp of Exit 317. The
improvements shall be completed within one year of the first site plan approval,
unless required during the first site plan.
• Construction of an interpretive area with three historical signs in the location of
the old Rutherford's Farm House, along Route 11, near the old concrete steps
that now remain. The master development plan shows this area paved and with
landscaping and sidewalks.

Issues•
Staff s review ofthe subj ect master development plan does not highlight any substantial problems.
However, staff would like to point out the following concerns so they may be considered during
the review process:
1) Zoning District Buffers. The preliminary master development plan does not take
the buffer and screening requirements into consideration between the proposed
commercial uses and the existing residential properties located across Route 11.
The Zoning Ordinance requires that a Category "B" buffer be provided.
2) Preservation of Environmental Features. The master development plan provides
for the protection of existing woodlands, flood plains, and wetlands. All of these
protected environmental areas should be identified on the master development plan,
and preferably, placed in an environmental easement.
3) Flood Plain Disturbance. A proposed stormwater management pond is shown in
the flood plain of the subject property; however, the environmental analysis of the
master development plan indicates that no disturbance of flood plains is proposed.
The applicant should be prepared to explain the extent of disturbance to the flood
plain during the required public meetings. The disturbance of flood plains for
stormwater management purposes is permitted by the Frederick County Zoning
Ordinance, if approved by the Planning Commission. Details of any approved
disturbance of flood plains should be shown on the master development plan.
4) Sinkholes. The master development plan should include sinkholes in its analysis
of existing environmental features. If the intent is to provide a comprehensive soil
analysis for each individual site plan, then the master development plan should state
this.
5) Location of Proposed Collector Road. The location of the proposed major
collector road has been modified from the concept plan submitted during the
rezoning process. The relocation of the road places the burden of constructing the
road through the flood plain on the adjoining property. Furthermore, the new road
location would impact the layout of future development on this adj oining property.
STAFF CONCLUSIONS FOR 08-21-02 PLANNING COMMISSION MEETING:
The preliminary master development plan for Rutherford's Farm Industrial Park depicts appropriate land
uses and is consistent with the Zoning Ordinance and the Comprehensive Policy Plan. The preliminary
master development plan is also in accordance with the proffers of the rezoning. However, the applicant
needs to address the concerns identified by staff, and any concerns which are identified by the Planning
Commission, as a condition of favorable recommendation to the Board of Supervisors.

PLANNING COMMISSION SUMMARY & ACTION OF 08/21/02: The applicant came forward
and addressed each of the concerns raised by the Planning Staff during the meeting. Regarding the Zoning
District Buffers, the applicant stated that they have included the right-of-way distance within the buffer
which is allowed by the ordinance; therefore, they have shown a 100' buffer with landscaped screen along
the B2-zoned properties and a 200' distance separation across from the RP -zoned properties. Regarding
the Environmental Features and the Flood Plain Disturbance, the applicant stated that the percentage of
flood plain area to be disturbed by the storm water management facility will be shown on the plan; a
narrative will also be placed on the plan to indicate their commitment to amend the MDP for administrative
approval, to concur with the pending amendments to the County's woodlands ordinance. Addressing the
location of the Collector Road, the applicant stated that as a condition of Winchester and Western
Railroad's approval to cross their rail line, adjacent M1 land uses must have either shipping or receiving
that is rail -served. In order to meet this condition, the applicant stated that they shifted the road out
towards I-81 in order to make use of the M1 property; the collector road begins at a point on Rt. 11, it
will parallel I-81 as it traverses the property, and will end at the Rutherford's Farm property limits at the
Carroll property. Regarding the Sink Hole issue, the applicant introduced a geologist who was contracted
to conduct a reconnaissance of the property.
Mr. Garnet Williams, an environmental geologist with Engineering Consulting Services, briefed the
Commission on the geology of the site and pointed out identified areas of the Rutherford's Farm property
on a map. He stated that he would be very hesitant about calling these areas sink holes in the traditional
sense; he believed they were simply collapsed features with large solution channels, which are typically
located in areas where there is concentrated run-off. He advised the applicant to concentrate surface flows
and storm water detention ponds away from these areas both permanently and during construction. Mr.
Williams commented that for construction of roadways and low-rise commercial buildings overtop of
solution cavities, sink holes, and other karst-related features, the engineering solutions in the field are
relatively simple. The applicant stated their commitment to designing the storm water features away from
the identified areas and to place a narrative on the MDP stating that as individual site plans are submitted
that could possibly impact these areas, a geo-technical analysis will be conducted and approved by the
County's engineers, as a part of the site plan approval.
Two local citizens came forward to express concerns. The owner of adjacent Weber's Nursery was
concerned about contamination of his well water supplies for his business; he was concerned about traffic
congestion on Rt. 11 and suggested a second access to the property from the rear and allowing the
continuation of plans for Rt. 37; he was concerned that light interference would prohibit his ability to
produce a poinsettia crop; he was concerned about the visibility of the site traveling north and screening
for adjacent residences. The other citizen, a resident along Martinsburg Pike, was concerned about adding
to the existing traffic congestion and he wanted assurance that the new property owner would adhere to
the proffers submitted by the previous owner during rezoning.
Commission members believed the preliminary MDP depicted appropriate land uses and was consistent
with the Zoning Ordinance and the Comprehensive Policy Plan, and was in accordance with the proffers
of the rezoning. The Commission unanimously recommended approval with the stipulation that the
applicant address all the concerns identified by the Planing Staff as a condition of favorable
recommendation to the Board.

RE: Rutherford's Farm Industrial Park -Interpretative Signs
Dear Mr. Smith:
The Frederick County Historic Resources Advisory Board (HRAB) considered the referenced proposal
during their meeting of July 16, 2002. Specifically, the HRAB reviewed the developer's proposal to include
the three interpretative signs proffered in the Rutherford's Farm rezoning application within the Virginia
Civil War Trails Program (VACWT). It is the developer's intent to utilize Dr. Brandon Beck of the Civil
War Institute at Shenandoah University to provide the historical information for each sign, commemorating
the old Rutherford's Farm House, the Battle of Rutherford's Farm, and the Battle of Second Winchester.
The HRAB determined that it was acceptable for Dr. Brandon Beck and the VACWT Program to develop
the language and text of the three interpretative signs.
The HRAB also had comments regarding the proposed pull -off area where the interpretative signs would be
placed. The HRAB suggested that the developer be sensitive to the visitor experience of.the interpretative
area. Specifically, the HRAB suggested strategic landscaping, including native plants, to further enhance
the interpretative area against the development that will occur. within the industrial park adjacent to the
interpretative area.

The Winchester Star
Three prominent business-
men in the Winchester area
joined forces to purchase Fred-
erick County's newest zoned in-
dustrial land.
The Rutherford's Farm In-
dustrial Park will have the
backing of the county's largest
landowner, C. Robert Solen-
berger of Fruit Hill Orchards,
and John S. Scully and John B.
Schroth of Colony Realty.
Schroth is a Winchester city
councilman.
The group formed Ruther-
ford's Farm LLC to purchase
the 154-acre future industrial
park and business land on July
10 for about $2.4 million, ac-
cording to records of the pur-
chase at Frederick County Cir-
cuit Court.
The property is located at
the Interstate 81/U.S' 11 North
interchange (Exit 317). It was
purchased from Richard R.
Duncan, Janet D. Riddick, and
Turner Enterprises LLC in
three main parcels.
While each of the three for-
mer property owners sold their
land for $10 in cash, a deed of
trust for $1.6 million and two
notes of trust for $400,000 each
bring the total sale to $2.4 mil-
lion.
According to the latest
records from the Frederick
County Commissioner of the
Revenue Office, the parcels are
valued at about $1.1 million.
Scully did not want to com-
ment on the details of the sale,
but said Rutherford's Farm
LLC would be marketing the
land as industrial and business
property.
Solenberger referred all
questions to Scully, and
Schroth could not be reached
for comment.
'],he county Board of Super-
visors approved the land's re-
zoning in April while praising
the potential development for
the number and significance of
the conditions and proffers in-
cluded in the rezoning.
R.J. Turner, the real estate
broker for the property and a
former owner of about 8.9 acres
included in the sale, said the
land would be attractive to in-
dustry and motorist -oriented
businesses because of its loca-
tion adjacent to I-81, and be-
cause the Winchester and

significance of the property
before its rezoning, come up
with the wording for the
signs.
The pull -off was a condi-
tion of the rezoning Smith
said would cost the develop-
ers about $65,000.
While the HRAB had
some concerns about the de-
sign of the pull -off and
wanted to make it look nice,
Smith said the Virginia De-
partment of Transportation
would have the ultimate au-
thority on the design of the
site.
"That's scary," was the
reply of the HRAB's archi-
tectural historian, Maral
Kalbian.
The three interpretive
signs will address the signif-
icance of the Second Battle
of Winchester, the Battle of
Rutherford's Farm, and the
Rutherford's Farm house.
The site has already been
approved as part of the Vir-

: The Administrator may allow the construction of recreational
facilities or roads in the floodplain.
(2) Lakes and ponds. Lakes, ponds and impoundments shall remain
undisturbed. The Administrator may allow the removal of a lake,
pond or impoundment if it is in a poor state of repair, if it is
unsafe or if it serves no useful retention, environmental or
recreational purposes.
(3) Wetlands. No disturbance of wetlands is allowed, except that the
Administrator may allow disturbance of small areas for purposes
of conservation, recreation, utilities or roads.
(4) Sinkholes. No disturbance of sinkholes is allowed other than
filling with -natural materials. No substances or objects, other than
natural fill materials, shall be placed in sinkholes. Sinkholes shall
only be filled with innocuous materials that will not contribute to
groundwater pollution.
(5) Natural stormwater retention areas. No more than 10% of natural
stormwater retention areas on a site shall be disturbed. Natural
stormwater retention areas may be replaced with the approval of
the Administrator by artificial stormwater facilities if the total
storage capacity of the site, as well as within each drainageway,
is maintained. Natural stormwater retention areas which are
floodplains, wetlands, lakes or ponds shall not be disturbed or
replaced.
(6) Steep slopes. No more than 25% of steep . slopes (25% or
greater) shall be disturbed or regraded. The Administrator may
allow the disturbance of additional small areas where that
disturbance will alleviate potential health or safety problems and
will not significantly denigrate the overall environmental quality of
the site. The Board of Supervisors may allow the disturbance of
larger areas of steep slopes in shopping centers, office parks,
industrial parks and R5 residential recreation communities. In

B2 & B3: 50' front setback from arterial highways (Route 11 & I-81);
35' front setback from collector or minor streets (all proposed roads);
0' side and rear setbacks.
4) Current & Proposed Use. In the "Project Information" section of the MDP, please provide what
the current uses of the properties are, and what the proposed uses of the properties are.
5) MI Zoned Property Why is the acreage for the M1 (Light Industrial) land 116.8 acreas, when the
rezoning was approved for 116.7 acres?
6) Additional Adjoining Lot & Buffer. Please include 43-A-101 to the list of adjoining properties.
This lot is the small RP lot, located between the two separate portions of B2 property. Also of
importance, a Category "C" buffer is required between this lot and the M1 property directly to the
north. The Category "B" buffer shown is insufficient at this location.
7) Proposed Collector Road & Development Plan Layout. Why has the location of the proposed
collector road been altered from the preliminary plan used during the time of the rezoning? Staff
is concerned about the new location of the proposed road because it appears to minimize the
potential use of land on the two adjoining lots zoned M2 (Industrial, General), and also on the
property of Rutherford's Farm. From a speculative point of view, the new location of the proposed
road would also make the future extension of this road much more expensive because the road
would have to be constructed through the widest area of flood plain. Furthermore, the new location
of the proposed road would pass the expense of constructing the road through the flood plain onto
the adjoining properties to the north of the lot.
8) Proffer Statement. Staff has four comments regarding the proffer statement shown on Page 1 of
3. First, please show the signatures of the proffer statement. Second, please provide a note with
the proffer statement which explains how the numbers and letters of the proffer statement are
shown on Page 3 of 3. Third, the MDP labels a road other than the proposed collector road as the
road proffered in C4. Please relocate this label over the proposed collector road which will traverse
the property. Fourth, please provide a receipt which shows that the proffered monetary payment
of $10,000 has been paid to the Treasurer of Frederick County. The language of this proffer
indicates that this monetary payment would be paid after the rezoning of the subject property was
approved.
9) Transitional Landscape Buffer. Please provide detailed information regarding the proposed
transitional landscape buffer along Route 11. Specifically, please provide a typical segment of the
buffer, including the species of plants to be used and their size at the time of planting.

10) Landscaping & Buffer Details. Please provide more detailed information regarding the proposed
buffers and screens. This information should show atypical segment of each proposed buffer &
screen, the size of proposed plants at the time of planting, and the species of plants to be used for
each screen.
11) Interpretative Area & Signs. Please provide detailed information regarding the proposed
interpretative area and the locations of the proposed interpretative signs. Please note that because
the interpretative area will have parking, appropriate landscaping should be provided. Based on
the Zoning Ordinance's requirements for parking lots, one tree is required for interior landscaping;
plus, one tree is required for every 40 feet of perimeter for perimeter landscaping.
12) Historical Resource Identification. Please show and label where all historic structures and sites
are located on the site.
13) Sinkholes. Please provide the location of all existing sinkholes; and include sinkholes in the
environmental features tabulation on page 2 of 3.
14) Woodland Disturbance. Please provide information regarding how the disturbance of woodlands
will be monitored during the development process. I suggest that you provide a statement on the
MDP to the effect that the disturbance of woodlands for the entire Rutherford's Farm Industrial
Park shall be monitored during the review of each individual site plan to ensure that no more than
25% of woodlands are disturbed. Please also make an attempt to provide all preserved woodlands
in areas of open space. I suggest that you consider providing an area of open space along I-91 to
preserve these woodlands. This area would also provide a beneficial screen between the Interstate
and the Industrial Park.
15) Phasing. Please provide information regarding the proposed phasing of development. Will the
construction of the entrance and first segment of the proposed collector road be developed first?
16) Dedication of Proposed Collector. Road. Please clarify, on the MDP, when the r-o-w for the
proposed collector road will be dedicated, and to whom the road will be dedicated.
17) Projected VPD. Please provide the projected vehicle trips per day for the two proposed entrances.
Please address these comments and resubmit for further review. Once you have obtained all agency
comments, this MDP may be scheduled for a Planning Commission meeting. Please do not hesitate to

this industrial park indicates one crossing of the Winchester and Western Railroad by. an industrial road
designed to Virginia Department of Transportation standards. It is my understanding that this at grade
crossing may occur provided that the design meets the minimum sight line requirement of 50', the crossing
is signalized with flashing lights, and natural drainage is not impeded on either side of the railroad
mainline. You advised me that safety gates would not be required for the at grade crossing; however, any
industrial development that utilized this crossing for access must use rail siding for shipping or receiving as
a condition of approval and the industrial development must be in the Winchester Switching District.
Permitting approval for the industrial road at grade crossing is granted by Rail Asset Management Services
(RAMS).

This is a follow-up to the Planning Commission hearing on November 7, 2001. Because of the
past year's battle over industrial development and the importance of approaching this rezoning
correctly, I am suggesting the following be incorporated in the process:
1. Because of the high visibility of this site and the first view of Winchester from the north,
special care needs to be incorporated in the planning and three dimensional planning.
2. The planning should include the 107 acre M2 Carroll property, Zuckerman's, and the former
chemical facility along Ebert Rd., all in a coordinated traffic, utility, sewer, landscaping and
architectural plan.
3. A one to two acre Rutherford Civil War Memorial Park should be incorporated in the plan
near the Rutherford site as an asset to the development.
4. Because of the potential ugliness of industrial development when no standards are established
at the start, I would recommend that design standards for materials, colors, building height,
set backs, lay down areas, docks, signs, etc. be developed prior to start of construction. This
site begs for a new approach - an INDUSTRIAL CAMPUS approach, not a Stonewall
Industrial "Park" approach and should include the business type buildings in the standards.
5. Because of the serious traffic problems at the 1-81 and Rt. 11 interchange, which we are all
aware of, it may be possible during an up -front planning effort to move the whole entrance to
the total 257 acre site north and avoid the whole problem at the I-81 Interchange. Master
Development planning, if done early, may resolve this critical issue and everyone wins.

enter into and execute a signalization agreement prior to the first site plan
approval of said Industrial Park.
b.) A traffic signal will be installed by the applicant when warranted by VDOT at
the southbound ramps of the 317 interchange and U.S. Route 11 in the
configuration and design as approved by VDOT. The applicant shall enter
into and .execute a signalization agreement prior to the first site plan approval
of said Industrial Park.
2.) Intersection Improvements
Intersection improvements at the proposed two entrances will be installed and
paid for by the applicant. The existing multi -lane system on U.S. Route 11 will
be extended north to the intersection of the proposed County Comprehensive Plan
Collector Road. All left and right turn lanes and pavement transitions north and
south of proposed County Comprehensive Plan Collector Road on U.S. Route 11
will be installed and paid for by the applicant. The improvements shall be
completed within one year of the first site plan approval and prior to the second
site plan approval for the Rutherford's Farm Industrial Park. If all or part of the
intersection improvements are required for the first site plan of the Rutherford's
Farm Industrial Park, they shall be made part of and constructed with this first site
plan.
3.) Right of Way Dedication
a.) The applicant hereby agrees to dedicate right of way to the Commonwealth of
Virginia along U.S. Route 11 adjacent to the property as determined by
VDOT. This right of way dedication shall be recorded prior to the approval of

the U.S. Route 11 construction plans prepared for the Rutherford's Farm Cn
Industrial Park as noted in Proffer C2 (Intersection Improvements) and Proffer
C5 (Route 11 and Northbound I-81 Ramp Improvements).
b.) The applicant hereby agrees to dedicate right of way to the Commonwealth of
Virginia along Interstate 81 as shown on Interstate 81 Improvement Study
VDOT Project No. 0081-968-F11, PE-100 MP 305 to West Virginia State
Line Frederick County, dated November 1998 (specifically noted on Sheet 24
of said study). The right of way dedication shall be recorded prior to the
master development plan approval for Rutherford's Farm Industrial Park.
4.) Comprehensive Plan Road Construction
The applicant hereby agrees to coordinate, set aside right of way, and construct
the portion of the major collector road traversing on the land herein to be rezoned
and developed and as outlined in the Frederick County Comprehensive Plan
Northeast Land Use Study adopted by the Frederick County Board of Supervisors
on September 27, 2000.
Said collector road will be incorporated in and constructed with each site plan
submission that is adjacent to or part of the site plan.
5.) Route 11 and Northbound I-81 Ramp Improvements
The applicant will construct a third southbound lane on US Route 11 from the
northern most entrance of the applicant's property to the northbound I-81 ramp of
Exit 317. These improvements will include a 12' wide lane of approximately 600
linear feet in length to serve as a continuous right turn lane for the northbound
entrance ramp of the Exit 317 interchange. Additionally, the applicant will
construct turning radius improvements at the entrance ramp to ensure a smooth
transition. The improvements shall be completed within one year of the first site
plan approval and prior to the second site plan approval for the Rutherford's Farm
Industrial Park. If all or part of the intersection improvements are required for the
first site plan of the Rutherford's Farm Industrial Park, they shall be made part of
and constructed with this first site plan.
D.) Historic Resource
1.) Interpretative Signs
The applicant hereby proffers to provide an interpretive area in the location of the
old Rutherford's Farm House along U.S. Route 11 and more particularly at the
location of the old concrete steps that now remain. An easement of sufficient size
will be provided for a pull -off area and viewing. Three interpretative plaques will
be provided. They are as follows:

The interpretative plaques will contain language and pictures acceptable to the
Frederick County Historic Resources Advisory Board.
All work performed for the pull -off area will meet the minimum standards of
Virginia Department of Transportation and Frederick County Ordinances in
respect to Highway pull -off and safety. Ground maintenance of the interpretative
area will be performed by the Rutherford's Farm Industrial Park Association
under a separate continuous approved permit issued by VDOT.
2.) Landscaping
A transitional landscape buffer will be provided along U.S. Route 11 from
Interstate 81 traveling north to the Comprehensive Plan collector road and
transmission power line easement. This landscape easement will be 15' in width
and will consist of a low earthen mound of 2-3' in height with plantings of ground
covers, flowers, and grasses. Indigenous trees such as redbud, oaks, cedars, etc.
will be incorporated along said landscape easement in a cluster mass fashion to
provide a naturally planted look. The maintenance of said landscape buffer will be
the responsibility of the Rutherford's Farm Industrial Park Association and will be
installed with the first commercial development adjacent to said easement.
3.) Industrial Park Name
The applicant hereby proffers the naming of the Industrial Park to:
"Rutherford's Farm Industrial Park"
E.) Lighting
Building mounted lights and pole -mounted lights will be of a downcast nature and
shielded and directed away from adjacent properties surrounding the proposed
project. Lighting plans will be submitted as a separate attachment for review and
approval by the Frederick County Planning Department prior to installation.
F.) Signage
1.) Within the M1 (Light Industrial) Zoning District, the applicant hereby proffers
that all freestanding business signs shall be monument -style not to exceed 12' in
height.
2.) Within the IA (Interstate Area Overlay) Zoning District, the applicant hereby
proffers to limit the total number of signs to three.

G.) Recycling Proffer

The undersigned owners of the above -described property hereby voluntarily proffer
that in the event rezoning application # 07-01 is approved, and the property is
