The proposed revisions at the north Service Entrance (as revised March 21, 2008) and at the intersection of Merchant St./Route 11 are approved. This leaves only the Permanent Pavement Marking and Sign Plan on sheet 20 to be completed and approved by VDOT. The recommended lane configuration at the North Entrance is as shown in the attached sketch. It may be necessary to include some guide signs to indicate the north entrance is a service entrance, not for through traffic. For the area of the 8-foot paved shoulder along Route 11 (station 310+00 to 312+75), the recommended widening is as shown on the 2nd page of the attached sketch. This would provide a 4-foot gravel shoulder (where ROW permits) and extending the aggregate layer to the side slope (to improve subgrade drainage). We can discuss these items at the next on -site meeting on Thursday, March 27, 11:00 a.m. The issue of U-turns to Route 11 northbound, for the properties along the east side of Route 11, will be addressed by future modifications to Nulton Lane and a possible connection to Snowden Bridge Blvd. Should you need additional information, do not hesitate to call me or Mr. Stephen Baluch in the Winchester Office at 540-535-1829. Trip Generation Manual, Sixth Edition for review. VDOT reserves the right to comment on all right of way needs, including right of way dedications, traffic signalization, and off site roadway improvements and drainage. Prior to construction on the State's right of way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Sanitation Authority: First review: show sewer easement on western boundary; show water and sewer line location and size. Fire Marshal: Fire and rescue access to be maintained at all times. `Fire Lane No Parking' signs required at all fire hydrants, normal, and emergency access points. A comprehensive review will be performed at the time of site plan submission. Historic Resources Advisory Board: Please see attached letter, dated 7118102. Airport Authority: This proposed master plan does not appear to impact operations at Winchester Regional Airport. As sites are developed, the airport requests prior review to ensure developments will not impact operations. Planning and Zoning: Site History: The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) depicts the six parcels, which comprise the proposed master development plan, as part of the R-3 (Residential, General) Zoning District. On October 8, 1980, parcels 43-A-96; 43-A-98; 43-A-99; 43-A-111; and a portion of 43-A-97 were rezoned from R-3 to A-2, during a Comprehensive Downzoning. The A-2 (Agricultural General) District zoning classification was modified to RA (Rural Areas) District on February 14, 1990, during the comprehensive amendment to the county's Zoning Ordinance. The R-3 (Residential -General) District zoning classification was modified to RP (Residential Performance) District on February 14, 1990, during the comprehensive amendment to the county's Zoning Ordinance; this action affected 43-A-100, and a portion of 43-A-97. On April 22, 2002, the Board of Supervisors approved the rezoning of these parcels to include 116.7 acres of M1 (Industrial, Light), 23.2 acres of B2 (Business, General), and 14.5 acres of B3 (Business, Industrial Transition). In addition, the entire 154.4 acres of land was added to the IA (Interstate Area Overlay) Zoning District. Rutherford's Farm Industrial Park, MDP #04-02 Page 3 September 9, 2002 Comprehensive Policeman: The parcels are within the county's Sewer and Water Service Area (SWSA) and are a component of the Northeast Land Use Plan which was adopted by the Board of Supervisors on September 27, 2000. The parcels were also a component of the Route 11 North Corridor Plan which was adopted by the Board of Supervisors on January 8, 1997. Both land use plans proposed future commercial and industrial development within the area of these parcels; as well as the provision of a Developmentally Sensitive Area (DSA) overlay along Martinsburg Pike. The Northeast Land Use Plan also identifies a major collector road along the northern portion of the subject tract. This planned roadway would intersect with Martinsburg Pike and travel westerly towards I-81, and then angle towards the north. The applicant has made provisions to construct this planned roadway. Project Scope: The applicant has prepared a master development plan for the development of 154.4 acres of commercial and industrial land uses. The allotment of land in each zoning district and the general location of land is consistent with the approved rezoning. During the rezoning process, the applicant offered a number of proffer conditions, which were intended to help minimize the potential impacts of development. A summary of the most significant proffers is listed below: • Installation of a traffic signal light at the entrance of the industrial park when warranted by VDOT. • Installation of a traffic signal light at the southbound ramps of the Exit 317 interchange & Route 11 when warranted by VDOT. • Improvements to be made to Route 11 at the intersections of the two proposed entrances to the industrial park. The improvements shall be completed within one year of the first site plan approval, unless required during the first site plan. • Construction of a major collector road through the property, as planned for in the Frederick County Comprehensive Policy Plan. Each site plan in the development which would be located along or part of the proposed road would be responsible for building that particular segment of road. • Construction of a third southbound lane on Route 11 from the northern most entrance of the property to the northbound I-81 ramp of Exit 317. The improvements shall be completed within one year of the first site plan approval, unless required during the first site plan. • Construction of an interpretive area with three historical signs in the location of the old Rutherford's Farm House, along Route 11, near the old concrete steps that now remain. The master development plan shows this area paved and with landscaping and sidewalks. Rutherford's Farm Industrial Park, MDP #04-02 Page 4 September 9, 2002 Issues• Staff s review ofthe subj ect master development plan does not highlight any substantial problems. However, staff would like to point out the following concerns so they may be considered during the review process: 1) Zoning District Buffers. The preliminary master development plan does not take the buffer and screening requirements into consideration between the proposed commercial uses and the existing residential properties located across Route 11. The Zoning Ordinance requires that a Category "B" buffer be provided. 2) Preservation of Environmental Features. The master development plan provides for the protection of existing woodlands, flood plains, and wetlands. All of these protected environmental areas should be identified on the master development plan, and preferably, placed in an environmental easement. 3) Flood Plain Disturbance. A proposed stormwater management pond is shown in the flood plain of the subject property; however, the environmental analysis of the master development plan indicates that no disturbance of flood plains is proposed. The applicant should be prepared to explain the extent of disturbance to the flood plain during the required public meetings. The disturbance of flood plains for stormwater management purposes is permitted by the Frederick County Zoning Ordinance, if approved by the Planning Commission. Details of any approved disturbance of flood plains should be shown on the master development plan. 4) Sinkholes. The master development plan should include sinkholes in its analysis of existing environmental features. If the intent is to provide a comprehensive soil analysis for each individual site plan, then the master development plan should state this. 5) Location of Proposed Collector Road. The location of the proposed major collector road has been modified from the concept plan submitted during the rezoning process. The relocation of the road places the burden of constructing the road through the flood plain on the adjoining property. Furthermore, the new road location would impact the layout of future development on this adj oining property. STAFF CONCLUSIONS FOR 08-21-02 PLANNING COMMISSION MEETING: The preliminary master development plan for Rutherford's Farm Industrial Park depicts appropriate land uses and is consistent with the Zoning Ordinance and the Comprehensive Policy Plan. The preliminary master development plan is also in accordance with the proffers of the rezoning. However, the applicant needs to address the concerns identified by staff, and any concerns which are identified by the Planning Commission, as a condition of favorable recommendation to the Board of Supervisors. Rutherford's Farm Industrial Park, MDP #04-02 Page 5 September 17, 2002 PLANNING COMMISSION SUMMARY & ACTION OF 08/21/02: The applicant came forward and addressed each of the concerns raised by the Planning Staff during the meeting. Regarding the Zoning District Buffers, the applicant stated that they have included the right-of-way distance within the buffer which is allowed by the ordinance; therefore, they have shown a 100' buffer with landscaped screen along the B2-zoned properties and a 200' distance separation across from the RP -zoned properties. Regarding the Environmental Features and the Flood Plain Disturbance, the applicant stated that the percentage of flood plain area to be disturbed by the storm water management facility will be shown on the plan; a narrative will also be placed on the plan to indicate their commitment to amend the MDP for administrative approval, to concur with the pending amendments to the County's woodlands ordinance. Addressing the location of the Collector Road, the applicant stated that as a condition of Winchester and Western Railroad's approval to cross their rail line, adjacent M1 land uses must have either shipping or receiving that is rail -served. In order to meet this condition, the applicant stated that they shifted the road out towards I-81 in order to make use of the M1 property; the collector road begins at a point on Rt. 11, it will parallel I-81 as it traverses the property, and will end at the Rutherford's Farm property limits at the Carroll property. Regarding the Sink Hole issue, the applicant introduced a geologist who was contracted to conduct a reconnaissance of the property. Mr. Garnet Williams, an environmental geologist with Engineering Consulting Services, briefed the Commission on the geology of the site and pointed out identified areas of the Rutherford's Farm property on a map. He stated that he would be very hesitant about calling these areas sink holes in the traditional sense; he believed they were simply collapsed features with large solution channels, which are typically located in areas where there is concentrated run-off. He advised the applicant to concentrate surface flows and storm water detention ponds away from these areas both permanently and during construction. Mr. Williams commented that for construction of roadways and low-rise commercial buildings overtop of solution cavities, sink holes, and other karst-related features, the engineering solutions in the field are relatively simple. The applicant stated their commitment to designing the storm water features away from the identified areas and to place a narrative on the MDP stating that as individual site plans are submitted that could possibly impact these areas, a geo-technical analysis will be conducted and approved by the County's engineers, as a part of the site plan approval. Two local citizens came forward to express concerns. The owner of adjacent Weber's Nursery was concerned about contamination of his well water supplies for his business; he was concerned about traffic congestion on Rt. 11 and suggested a second access to the property from the rear and allowing the continuation of plans for Rt. 37; he was concerned that light interference would prohibit his ability to produce a poinsettia crop; he was concerned about the visibility of the site traveling north and screening for adjacent residences. The other citizen, a resident along Martinsburg Pike, was concerned about adding to the existing traffic congestion and he wanted assurance that the new property owner would adhere to the proffers submitted by the previous owner during rezoning. Commission members believed the preliminary MDP depicted appropriate land uses and was consistent with the Zoning Ordinance and the Comprehensive Policy Plan, and was in accordance with the proffers of the rezoning. The Commission unanimously recommended approval with the stipulation that the applicant address all the concerns identified by the Planing Staff as a condition of favorable recommendation to the Board. (Note: Commissioners DeHaven and Light abstained; Commissioner Watt was absent from the meeting.) Specifically, the HRAB reviewed the developer's proposal to include the three interpretative signs proffered in the Rutherford's Farm rezoning application within the Virginia Civil War Trails Program (VACWT). It is the developer's intent to utilize Dr. Brandon Beck of the Civil War Institute at Shenandoah University to provide the historical information for each sign, commemorating the old Rutherford's Farm House, the Battle of Rutherford's Farm, and the Battle of Second Winchester. The HRAB determined that it was acceptable for Dr. Brandon Beck and the VACWT Program to develop the language and text of the three interpretative signs. The HRAB also had comments regarding the proposed pull -off area where the interpretative signs would be placed. The HRAB suggested that the developer be sensitive to the visitor experience of.the interpretative area. Specifically, the HRAB suggested strategic landscaping, including native plants, to further enhance the interpretative area against the development that will occur. within the industrial park adjacent to the interpretative area. The Rutherford's Farm In- dustrial Park will have the backing of the county's largest landowner, C. Robert Solen- berger of Fruit Hill Orchards, and John S. Scully and John B. Schroth of Colony Realty. Schroth is a Winchester city councilman. The group formed Ruther- ford's Farm LLC to purchase the 154-acre future industrial park and business land on July 10 for about $2.4 million, ac- cording to records of the pur- chase at Frederick County Cir- cuit Court. The property is located at the Interstate 81/U.S' 11 North interchange (Exit 317). It was purchased from Richard R. Duncan, Janet D. Riddick, and Turner Enterprises LLC in three main parcels. While each of the three for- mer property owners sold their land for $10 in cash, a deed of trust for $1.6 million and two notes of trust for $400,000 each bring the total sale to $2.4 mil- lion. According to the latest records from the Frederick County Commissioner of the Revenue Office, the parcels are valued at about $1.1 million. Scully did not want to com- ment on the details of the sale, but said Rutherford's Farm LLC would be marketing the land as industrial and business property. Solenberger referred all questions to Scully, and Schroth could not be reached for comment. Please include 43-A-101 to the list of adjoining properties. This lot is the small RP lot, located between the two separate portions of B2 property. Also of importance, a Category "C" buffer is required between this lot and the M1 property directly to the north. The Category "B" buffer shown is insufficient at this location. 7) Proposed Collector Road & Development Plan Layout. Why has the location of the proposed collector road been altered from the preliminary plan used during the time of the rezoning? Staff is concerned about the new location of the proposed road because it appears to minimize the potential use of land on the two adjoining lots zoned M2 (Industrial, General), and also on the property of Rutherford's Farm. From a speculative point of view, the new location of the proposed road would also make the future extension of this road much more expensive because the road would have to be constructed through the widest area of flood plain. Furthermore, the new location of the proposed road would pass the expense of constructing the road through the flood plain onto the adjoining properties to the north of the lot. 8) Proffer Statement. Staff has four comments regarding the proffer statement shown on Page 1 of 3. First, please show the signatures of the proffer statement. Second, please provide a note with the proffer statement which explains how the numbers and letters of the proffer statement are shown on Page 3 of 3. Third, the MDP labels a road other than the proposed collector road as the road proffered in C4. Please relocate this label over the proposed collector road which will traverse the property. Fourth, please provide a receipt which shows that the proffered monetary payment of $10,000 has been paid to the Treasurer of Frederick County.
