This Master Development Plan is acceptable. Before making any final comments this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Per a conversation with Lloyd Ingram from the Virginia Department of Transportation on 10129104, the applicant will be expected to address issues raised by VDOT during site plan evaluation. Frederick County Fire Marshal: Street signs shall comply with local Public Works standards. Municipal water supplies for firefighting shall comply with Frederick County Code section 90-4, fire hydrants shall be within 400 feet of all dwelling units as measured by centerline of the roadway surface. The private roadway and cul-de-sac widths may inhibit access of emergency vehicles and no on -street parking should be permitted. Fire Lane No Parking within 20 feet. Signs should be provided at each fire hydrant. Plan approval recommended. Frederick County Public Works: As stated in your notes, the entire subdivision shall drain through the stormwater management pond, unless a comprehensive study indicates no impact shall occur on adjacent properties. A comprehensive review shall occur at the subdivision plan submission. Frederick County Sanitation Authority: 1" review— approved. Frederick County Inspections Department: Manufactured Housing units shall comply with The Virginia Uniform Statewide Building Code, section 310, Use Group R (Residential) of the BOCA National Building Code/1996 and the Virginia Board of Housing and Community Development Manufactured Home Safety Regulations. Preliminary numbering has been assigned. Frederick County Department of Parks & Recreation: Plan appears to meet open space and recreational unit requirements. However, detailed information is needed prior to approval of the proposed shelter. Also, staff recommends the walking trail be a minimum of eight feet in width, meeting this department's minimum standards for hard surface trails. Frederick County Public Schools: Based on the information provided, it is anticipated that the proposed 41 single family homes will yield seven high school students, six middle school students and 16 elementary school students for a total of 29 new students upon build -out. This does not take into consideration any age restricted units since the application did not provide any specific number for those units. Significant residential growth in Frederick County has resulted in the schools serving this area to have student enrollments nearing or exceeding the practical capacity for a school. The cumulative impact of this project and others of similar nature, coupled with the number of approved, undeveloped residential lots in the area, will necessitate the future construction of new school facilities to accommodate increased student enrollments. The impact of this rezoning on current and future school needs should be considered during the approval process. Planning & Zoning: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location This property is located west of Martinsburg Pike (Route 11), 600 feet north of the intersection of Martinsburg Pike (Route 11) and Old Charles Town Rd (Route 761). C) Site History The original Frederick County zoning map (U.S.G.S. Stephenson Quadrangle) identifies the subject parcels as being zoned MH1. Thus, these properties pre -dated zoning districts and have always been zoned MH1. The Easy Living land currently contains 102 units. As proposed, the applicant intends to create 41 additional mobile home sites. The applicant has submitted this MDP as a means of facilitation of this expansion. E) Site Suitability & Project Scope Land Use Compatibility: The 11.642 acre sites are located adjacent to existing single family residential, mobile home community land uses. Comprehensive Policy Plan: The site of Easy Living Mobile Home Community is within the study limits of the Northeast Land Use Plan found in the 2003 Comprehensive Policy Plan. The Comprehensive Plan identifies these properties as being zoned MH1 and calls for no change to the current zoning in the area. The site is within the limits of the sewer and water service area. Historic Resources: The Frederick County Rural Landmarks Survey does not identify any potentially significant historic resources on the site of the proposed master development plan. Furthermore, according to the National Park Service's Study of Civil War Sites in the Shenandoah Valley of Virginia, the subject site is not included in any battlefield study area and does not contain any core battlefield resources. Environment: There is an intermittent stream located on site which the applicant plans to relocate. Appropriate permits will be issued prior to any wetland disturbance on this property. Excluding this stream, the subject site does not contain any known areas of environmental features. Environmental features include areas of floodplains, lakes or ponds, wetlands, natural waterways, riparian buffers, sinkholes, natural stormwater retention areas, and steep slopes. Transportation: Access to the site is proposed via an entrance off of Martinsburg Pike (Route 11). Martinsburg Pike is a major collector road and is planned for future improvement. [2003 Comprehensive Policy Plan, page 7-61. An existing three lane entrance off of Martinsburg Pike currently provides access to the development. The applicant proposes to make improvements to the entrance amounting to a 150' right turn lane and installation of a stop sign, per VDOT request. Specific improvements to Martinsburg Pike will be identified during Site Plan review. 0 0 MDP # 12-04, Easy Living Mobile Home Community February 11, 2005 Page 5 Existing mobile home communities may expand existing private streets only if approved by the Planning Commission and in accordance with the design standards of Section 165- 81 C (2) a and b. The decision whether or not the private streets will be permitted to expand is, therefore, a decision of the Planning Commission. In addition, it would be appropriate that the existing private roads leading into this proposed development be repaired in order to provide adequate access for all residents of the mobile home community. Landscaping, Buffers & Trails: This proposed preliminary master development plan provides an existing Category B full screen (50' woodland strip) along the northern property lines in order to screen this use from the property located to the north zoned M1 (Light Industrial) . However, staff has concluded that the existing woodlands do not meet the Category B requirements laid out in section 165.37 of the Frederick County Zoning Ordinance. Therefore, the applicant will be required to implement the necessary plantings and screening associated with the full screen provision. Wavier Requests: The applicant has requested waivers from the Planning Commission for sections 165- 31(C) & 165-81(C) 2 of the Frederick County Zoning Ordinance. Waiver # 1 The applicant is requesting a waiver to allow portions of a required riparian buffer to be located in the setbacks for 13 of the proposed 41 lots. See associated diagram for the scope and size of the areas requiring a waiver. 165-31 (Q: In residential developments, the areas of undisturbed environmental features described in section 165-31B shall be located in areas of open space. However, the Planning Commission may allow undisturbed areas to be included in the required setback and yard areas on residential lots when the extent, location, and disturbance of environmental areas make it impractical to place the undisturbed areas in common open space. In such circumstances, environmental easements, deeds of dedication, final subdivision plats, or other legal instruments approved by the Zoning Administrator shall be required to specify the restrictions to be placed on the environmental areas. Waiver # 2 The applicant is requesting a waiver to allow existing private streets to be extended to this new section in order to provide access to a state maintained road. 0 MDP # 12-04, Easy Living Mobile Home Community February 11, 2005 Page 6 165-81 C2: Private Streets in existing mobile home parks. The Planning Commission may allow new sections of existing mobile home parks, which are currently served by a complete system of private streets, to be provided with access using private streets. STAFF CONCLUSIONS FOR THE 02/02/05 PLANNING COMMISSION MEETING: This preliminary master development plan proposes to expand the existing mobile home community by up to 41 mobile homes on approximately 11.642 acres of land zoned MH1 (Mobile Home Community) District. Prior to administrative approval, it will be necessary for the applicant to provide an acceptable Category B buffer along the northern property line. In addition, the Planning Commission should render a decision regarding two wavier requests the applicant has requested. The first waiver deals with the expansion of private streets within this Mobile Home Community, per section 165-81(C) 2 of the Frederick County Zoning Ordinance. Second, the applicant is requesting a waiver from section 165-31(C), asking that the areas of undisturbed environmental be allowed to be located in the required setback and yard areas. All of these issues identified by staff, review agencies, as well as those issues brought forth by the Planning Commission, should be appropriately addressed prior to a recommendation to the Board of Supervisors. PLANNING COMMISSION SUMMARY & ACTION OF THE 02/02/05 MEETING: In response to questions from the Commission, the staff reported that there will not be an additional access to Rt. 11; the approval of the waiver merely allows the continuation of private streets within the existing mobile home park. Staff also reported that the trail system will not need to meet the Parks & Recreation Department's standard trail requirements for width and pavement because it is not a part of the required recreational units and because of its location within the riparian buffer. Members of the Commission asked the applicant about plans for providing water and sewer to the site, in light of the fact that the mobile home park currently has public water, but not public sewer. The applicant replied that the Sanitation Authority granted initial approval to provide the new units with public water and sewer. He noted that the existing mobile homes are served by individual drainfield sites, which are functioning properly; however, at this time, there are no plans to expand the sanitary sewer service to include the entire mobile home park. The applicant added that recently, the owners of the mobile home park participated in a cost -sharing program that helped to extend the sewer service to the new VDOT welcoming center. As part of that program, the owners received an opportunity to connect to the sewer service. Regarding the roads, the applicant explained that the existing internal roads will be upgraded and used to access the proposed new sites; VDOT will address the entrance area during the site plan stage of development. The applicant further added that the new sites are for lease and will not be sold. 0 0 MDP #12-04, Easy Living Mobile Home Community February 11, 2005 Page 7 There were no citizen comments regarding the proposed master development plan. Members of the Planning Commission noted that housing within certain economic environments seemed difficult to acquire and they believed this proposal met a need that existed within the community. Hope was also expressed that the owners of the property would continue to pursue converting the existing structures over to public water and sewer since it was now available and would be the environmentally sound way to continue. By a majority vote, the Planning Commission recommended approval of the master development plan with the following two requested waivers: 1) to allow portions of the required riparian buffer to be located in the setbacks for 13 of the proposed 41 lots; and 2) to allow existing private streets to be extended to the new, proposed section in order to provide access to a state - maintained road. This recommendation for approval was passed by the following majority vote: YES (TO APPROVE): Manuel, Triplett, Ours, Thomas, DeHaven, Morris, Unger, Watt, Straub NO: Gochenour (Note: Commissioners Kriz and Light were absent from the meeting.) Greetings. Thank you Mr. Chairman and members of the commission. II Summary. The Easy Living Mobile Home Community is a proposal to build 41 mobile home dwelling units on three parcels of land totaling 11.642 acres and zoned MHl. A location map of the property is shown on the projections screen to your left. The site is located within the Stonewall Magisterial District. It is located west of martinsburg pike (Rt 11), 600 feet north of the intersection of martinsburg pike (Rt 11) and old challes town rd (Rt 761) 'T V kix-o- The proposed density of this townhouse development is 3.5 residential units per acre, which is less than the 8 units per acre allowed by the Zoning Ordinance. Proposed open space also exceeds minimum standards. The Zoning Ordinance requires 15% of the parcel in open space, 37% of open space is proposed. There are no potentially significant historical resources on the property. There is an intermittent stream located on site which the applicant plans to relocate. Appropriate permits will be issued prior to any wetland disturbance on this property. Excluding this stream, the subject site does not contain any known areas of environmental features. An existing three lane entrance off of Martinsburg Pike currently provides access to the development. The applicant proposes to make improvements to the entrance amounting to a 150' right turn lane and installation of a stop sign, per VDOT request. Specific improvements to Martinsburg Pike will be identified during Site Plan review. Existing mobile home communities may expand existing private streets only if approved by the Planning Commission and in accordance with the design standards of Section 165-81 C (2) a and b. The decision whether or not the private streets will be permitted to expand is therefore a decision of the Planning Commission. In addition, it would be appropriate that the existing private roads leading into this proposed development be repaired in order to provide adequate access for all residents of the mobile home community. This proposed preliminary master development plan provides an existing Category B full screen (50' woodland strip) along the northern property lines in order to screen this use from the property located to the north zoned M1 (Light Industrial) . However, staff has concluded that the existing woodlands do not meet the Category B requirements laid out in section 165.37 of the Frederick County Zoning Ordinance. Therefore, the applicant will be required to implement the necessary plantings and screening associated with the full screen provision. III. Closing Remarks. This preliminary master development plan proposes to expand the existing mobile home community by up to 41 mobile homes on approximately 11.642 acres of land zoned MH1 (Mobile Home Community) District. Prior to administrative approval it will be necessary for the applicant to provide an acceptable Category B buffer along the northern property line. In addition, the Planning Commission should render a decision regarding the expansion of private streets within this Mobile Home Community. II SUMMARY Easy Living Mobile Home Community is a Master Development Plan for an additional 41 mobile home units on three existing MHI (Mobile Home Community) parcels that totals 11.642 acres. The MHI Zoning Districtpermits this housing type as a by right use. -The site is illustrated on the projection screen to your left. As you can see, the property is located west of Martinsburg Pike (Rt 11), 600 feet north of the intersection of Martinsburg Pike and Old Charlestown Road. The property is located entirely within the SWSA. The gross density of the development would be 3.436 dwellings per acre. There will be 4.736 acres, or 40% open space. The applicant is proposing to provide a woodchip trail and a picnic shelter in order to meet the recreational requirements associated with this master developmentplan. The applicant is proposing to provide a category B full screen buffer (50' woodland strip) along all properties that are not associated with the existing mobile home park. However, staff have concluded that the existing woodlands do not meet the requirements laid out in section 167:-37 of the zoning ordinance, Therefore, staffwould recommend that the applicantprovide the necessary plantings to meet the category B screen. Section 165-81 (e) of the Frederick County Zoning Ordinance requires mobile home parks to have an approved water and sewage service provided through the use of public or community system.. All community systems shall be dedicated to a public authority. This master plan meets the requirements of the Frederick County Zoning Ordinance. The applicant is requesting two waivers from the planning commission in order to meet county requirements for this MDP. First, the applicant requests a waiver to allow portions of a required riparian buffer to be located in the setbacks for 13 of the proposed 41 lots. The diagram to your left shows where this buffer will be located compared to the location of the lots and setback lines. After visiting the site and examining the intermittent stream that requires this riparian# buffer, the areas surrounding this waterway slope upward a significant amount (625 to 650 elevation), as seen on the topographic map on your left. The areas in which the applicant is requesting the waiver would be significantly higher in elevation than those low lying C. areas that the riparian buffer attempts to protect through this section of the ordinance. Staf eels that if the Planning Commission granted this waiver it would not go against the intent of the o*ance. However, one lot that tozpplicant is proposing (shown on the screen to your left) locates its driveway through the riparian buffer, and thus must be removed from the master development plan prior to approval. Second, the applicant requests a waiver to allow existingprivate streets to be extended in order to provide access to this new section to a state maintained road. Staff feels that it would be appropriate that the existing private streets be repaired if this waiver is given. Please provide the date the preliminary MDP was prepared and list all revision dates, along with a brief description of why the plan was revised. 6) Approval Narrative. Please reword the approval narrative to indicate the date the Board of Supervisors authorized administrative approval of the MDP. For your information, the final approval of the MDP would ultimately be the date the plan is approved by the Director of Planning and Development and the County Administrator. 7) Copy Sizes. Please provide at least two full size copies of the MDP. The smaller size (1 lxl7) may be used for the future agendas of the Planning Commission and Board of Supervisors if all information is legible and clear.
