ijo3 0 HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA DKO38PG0299 THIS BOUNDARY LINE ADJUSTMENT AGREEMENT FOR FORT BRADDOCK HEIGHTS, SECTION 2, made and dated this 3rd day of May, 1995, by and between JENI COMPANY, a Virginia corporation, of the one part, hereinafter referred to as Declarant, and COUNTY OF FREDERICK, VIRGINIA, of the other part, hereinafter referred to as County. WHEREAS, Declarant is the owner of Lots 16, 17 and 21, Fort Braddock Heights, Section 2, Gainesboro Magisterial District, Frederick County, Virginia, having acquired the same, along with other properties, by deeds from Tibow, a Virginia general partnership, dated May 5, 1994 and May 11, 1994 and recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 818 at Page 1811 and Deed Book 819 at Page 679, respectively; and WHEREAS, Declarant desires to adjust the boundary lines of the aforesaid lots in order to facilitate the construction of dwelling houses thereon; and WHEREAS, County previously approved subdivision plats for Fort Braddock Heights, Section 2, said subdivision plats being recorded in the aforesaid Clerk's Office in Deed Book 741 at (Page 396 and Deed Book 785 at Page 1569; and WHEREAS, County has no objection to said boundary line adjustments as proposed. NOW, THEREFORE, WITNESSETH: That for and in (consideration of the premises,and the benefits which will laccrue by reason of this agreement, the parties hereto do make the following boundary line adjustments, to -wit: That Lots 16, 17 and 21 of Fort Braddock Heights, Section 2, as shown on that certain final plat for boundary line adjustment between HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA DIN 3 8 No", 0 3 0 0 Lots 16, 17 and 21, Fort Braddock Heights, Section 2, made by S. W. Marsh, L.S., dated April 28, 1995, attached hereto and by reference made a part hereof, shall constitute the new boundaries of said lots, the boundary line adjustments relating to the rear property lines of each of the aforesaid lots. .County, by its signature hereto, joins in to evidence its consent and to approve the boundary line adjustments as heretofore referred and as set forth on the aforesaid plat attached hereto. Virginia - 22601 0 Please be advised as follows concerning the subject subdivision: • In accord with the City's policy for County water and sewer extensions, the Utilities Committee approved serving the County portion on August 25, 1987. Prior to extensions, the County of Frederick must agree to let the City extend said mains, and City Council will also need to approve the extensions. • Per meeting with Dove and Associates on November 18, 1987, the following changes have been noted and are acceptable to the City. The 4" water line in the western most cul-de-sac has been changed to an 8" line, and a new fire hydrant is being installed between Lots 25 and 26. • Conceptually, water and sewer extensions are okay. Final design changes will be required prior to the construction. • Hanes built on Lots 7, 8, 30, 31, and 32, above elevation 900, will have static pressure between 25 and 35 psi. This may necessitate the installation of private booster pumps. • For yor information, City review of the proposed subdivision was initiated on November 18, 1987. City action and approval on that portion of the subdivision located within Winchester will not be complete until at least February of 1988. OF PLANNING PROCEDURE RESOLUTION AND BUILDING WHEREAS, the City of Winchester presently has a policy, adopted J 13, 1976, and revised August 9, 1983, prohibiting sanitary sewer extensions in Frederick County; and, WHEREAS, with the completion of the new regional wastewater plant sufficient capacity will be available for the City to serve certain areas outside the Winchester City Limits, provided said service area is approved by the Frederick County Board of Supervisors. NOW, THEREFORE, BE IT RESOLVED: The policy prohibiting sanitary sewer extensions in Frederick County is repealed, and the staff is directed to follow the following procedures for water and sewer main extensions in Frederick County: (1) Any individual, developer, business or industry desiring to extend water and sewer mains to serve property in Frederick County must have written evidence from the Frederick County Sanitation Authority that the Sanitation Authority does not intend to serve the area for which City service is being requested. (2) The City staff will review the area to be developed to determine the feasibility of providing service. Said review will also address the impact of the development on the City's capacities at its water plant and at the regional wastewater facility. (3) Each development will be considered on its own merit, with the staff making a recormendation for approval or disapproval to the Utilities Committee. If the Utilities Committee vetoes the request, the procedure is ended; approval of the extensions permits movement to the next step. (4) The request for water and sewer main extensions is submitted, by the individual, developer, business, or industry, to the Frederick County Board of Supervisors. The Frederick County Board must grant unconditional approval for the City to extend its mains into the County. OF PLANNING + AND BUILDING C;� WHEREAS, the City of Winchester presently has a policy, adopted 13, 1976, and revised August 9, 1983, prohibiting sanitary sewer extensions in Frederick County; and, WHEREAS, with the completion of the new regional wastewater plant sufficient capacity will be available for the City to serve certain areas outside the Winchester City Limits, provided said service area is approved by the Frederick County Board of Supervisors. NOW, THEREFORE, BE IT RESOLVED: The policy prohibiting sanitary sewer extensions in Frederick County is repealed, and the staff is directed to follow the following procedures for water and sewer main extensions in Frederick County: (1) Any individual, developer, business or industry desiring to extend water and sewer mains to serve property in Frederick County must have written evidence from the Frederick County Sanitation Authority that the Sanitation Authority does not intend to serve the area for which City service is being requested. (2) The City staff will review the area to be developed to determine the feasibility of providing service. Said review will also address the impact of the development on the City's capacities at its water plant and at the regional wastewater facility. (3) Each development will be considered on its own merit, with the staff making a reccarmendation for approval or disapproval to the Utilities Committee. If the Utilities Committee vetoes the request, the procedure is ended; approval of the extensions permits movement to the next step. (4) The request for water and sewer main extensions is submitted, by the individual, developer, business, or industry, to the Frederick County Board of Supervisors. The Frederick County Board must grant unconditional approval for the City to extend its mains into the County. (5) If Frederick County approves the extension, the request will be forwarded to the City Council for consideration.
