Dear Mr. Butler:
This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of November 11, 1987:
Approval of Preliminary Master Development Plan #015-87 of Asbury Terrace, zoned
RP, 29.256 acres, for 85 single-family traditional housing lots, open space, VDOT
roads, and public utilities with the following revisions:
1. Change the road name Bushmill Drive.
2. Either enlarge the common area in Section 1, between Lots 7 and 8, to make
this open area more useable and reduce lots facing Route 659 or increase the
open space in the central portion of the development and eliminate the small
open space lot between Lots 7 and 8.
3. Open space requirements state that no more than 50% of open space be in steep
slopes. The proposed plan exceeds this requirement.
This property is located north side of Route 659 (Valley Mill Road), 0.10 miles
east of the intersection of Routes 656 and 659, in the Shawnee Magisterial
District.

MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Residential, agricultural and vacant land uses.
A-2 (Agricultural General) and RP (Residential Performance) zoning
PROPOSED USE AND IMPROVEMENTS: Single family traditional housing, open space,
VDOT roads and public utilities.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to the master
development plan. Before making any additional comments, a complete set of
subdivision plans will have to be submitted for our review.
Sanitation Authority - 1) need blow offs in Section II & III; 2) need G.Y.S.
in Section II; 3) need F.H. in Section I; 4) Move MH closer together in
Section I; 5) do sanitary sewer lines go to WRF trunkline; 6) where does
H2O line in Section I & III stop; 7) where is H2O connection made
Greenwood Fire Company - Move fire hydrant from Lot 71 to the intersection of
Route 659 and Ashbury Road. Move fire hydrant from Lot 60 to the
intersection of Ashbury Road and Camden Drive. Move fire hydrant from Lot 40
to the intersection of Route 659 and Providence Drive. Add one additional
hydrant at Lot 5.
Planning and Zoning - This plan is for single-family traditional lots with
open space and VDOT streets and public utilities. 85 single-family
traditional lots are proposed with the typical lot dimension of 80' x 125' or
10,000 square feet. Environmental requirements consist of woodlands and
steep slopes, all disturbance percentages are within the allowed minimums.
15% open is required and shown with 4.40 acres, most of which is located in
the center of this development. Recreational facilities are not required.
All dimensional requirements appear to be met. No bonus regulations have
been used. No buffering or screening is required. A homeowners' association
will be required to maintain the open space.

FINAL MASTER DEVELOPMENT PLANS
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to the master
development plan. Before making any additional comments, a complete set of
subdivision plans will have to be submitted for our review.
Sanitation Authority - 1) Need blow offs in Section II & III; 2) Need G.Y.S.
in Section II; 3) Need F.H. in Section I; 4) Move MH closer together in
Section I; 5) Do sanitary sewer lines go to WRF trunkline?; 6) Where does
H2O line in Section I & III stop?; 7) Where is H2O connection made?
Greenwood Fire Company - Move fire hydrant from Lot 71 to the intersection of
Route 659 and Ashbury Road. Move fire hydrant from Lot 60 to the
intersection of Ashbury Road and Camden Drive. Move fire hydrant from Lot 40
to the intersection of Route 659 and Providence Drive. Add one additional
hydrant at Lot 5.
Planning and Zoning - This plan is for single-family traditional lots with
open space and VDOT streets and public utilities. 85 single-family
traditional lots are proposed with the typical lot dimension of 80' x 125' or
10,000 square feet. Environmental requirements consist of woodlands and
steep slopes, all disturbance percentages are within the allowed minimums.
The 15% open space requirement has been exceeded with 5.4 acres, most of
which is located in the center of this development. Recreational facilities
are not required.

Asbury Terrace
At the time of the Preliminary Master Plan review, the staff suggested changes
concerning open space requirements. As suggested, the plan enlarges the open
space area between lots 6 and 7 providing a more useable area. Over 50% of the
open space will still be in steep slopes, although the non -steep portion of the
open space has been enlarged. The ordinance allows more than 50% of the open
space to be in steep slopes if a viable plan is approved by the Planning
Commission to make the area useful.
The Final Master Plan proposes to fill and grade 1.2 acres of open space to meet
this requirement. The staff's review of the calculations would suggest that in
fact less than an acre needs to be graded to meet the 50% requirement. Therefore,
it is the opinion of the staff that a viable proposal has been made to meet the
requirements of the ordinance. Over 18% open space has been provided.
It is the opinion of the staff that all requirements have been met.
TRANSPORTATION COMMITTEE RECOMMENDATIONS: No objections. The street pattern
appears satisfactory with current plans and developments.
STAFF RECOMMENDATIONS: Approval.
