Dear Mr. Wyatt:
It has been brought to my attention that the Apple Ridge HOA may not be acting in accordance with the
subdivision's Deed of Dedication, originated November 3, 1987. When the Apple Ridge Subdivision was
approved by the County, this Deed of Dedication was created as required by the Frederick County
Subdivision Ordinance.
The Deed of Dedication accomplishes many things: dedicates streets and roadways to the County,
establishes covenants and use restrictions, and creates the property owners association (HOA). The HOA
is charged with enforcing the covenants and use restrictions, setting the assessment levels and collecting
same, and maintaining common open space. These are only a few of the HOA's responsibilities. The
Deed of Dedication also outlines the membership in the HOA, and voting rights.
As President of the Apple Ridge Homeowners Association, you are responsible for seeing that the HOA
conforms to the Deed of Dedication and association bylaws. I encourage you, and the elected Board
members, to strive toward compliance with the Deed of Dedication and bylaws. It is important, and
legally required, to comply with the established and adopted covenants governing the Apple Ridge
development.

This letter is to confirm the Frederick County Planning Commission's action at
their meeting of August 5, 1987:
Approval of Final Master Development Plan #004-87 of Apple Ridge Subdivision for
119 single-family cluster lots located on the north side of Route 657 (Senseny
Road) in the Shawnee Magisterial District.
Your master development plan has been given final approval. All conditions of
the approval set by the Planning Commission must be met. Before any excavation
or land disturbance is undertaken, a land disturbing permit must be obtained and
before construction, a building permit must be obtained.
If you have any questions regarding your, plan, please do not hesitate to call
this office.

of Opequon Creek
MAGISTERIAL DISTRICT: Shawnee District
ADJACENT LAND USE AND ZONING: Vacant and residential land zoned A-2 (Agricultural
General) and RP (Residential Performance).
PROPOSED USE AND IMPROVEMENTS: 119 single-family cluster lots with streets and
open space.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to the master
development plan. We will need a complete set of plans prior to malting any
final comments.
Sanitation Authority - Water and sewer layout is in accordance with standards
except lots 33-39 and 85-93 are,not available to sewer lines. Concept for
the servicing of these lots should be shown.
Greenwood Fire Company - Hydrants should be along main roads at the
intersections of off roads. This will allow us to use an 8 inch water main,
which should give a much better water flow than the 4 inch main on side
streets. Other than this, we should be OX.
Planning and Zoning - The final master plan proposes 119 single-family
cluster lots with 8.1 acres of open space. The plan describes approximately
two acres of woodlands, 7.5 acres of steep slopes, and an 0.2 acre pond. The
plan conforms with limitations on disturbance of these areas. The required
amount of open space is shown on the plan. No recreational facilities are
required. The average lot size will exceed 9,000 square feet. No bonus
factors are included. Senseny Road is a collector and buffers are required
along that road. The normal 100 foot buffer is shown along most of the
frontage. The section of frontage to the west of the entrance road shows a
reduction in the buffer to 70 feet with partial screening as allowed by the
ordinance.
Additional information on sewer and water lines has been provided to meet the
Sanitation Authority's comments. The proposed road layout shows three
potential access points for surrounding properties. All ordinance
requirements have been met. The Final MDP is drawn in accord with the
approved Preliminary MDP.
STAFF RECOMMENDATIONS: Approval, with buffer reduction for the Senseny Road
collector road.
