The master development plan is approved for the potential development of 67.7 acres in the M1 (Light Industrial) Zoning District within the Shawnee Magisterial District. This site is approved for industrial land uses as depicted on the plan. The master development plan appears acceptable provided there is a clear understanding that the right-of-way reservation noted along Route 37, for future Route 37 north bound off ramp, will be dedicated (without compensation) to VDOT within 180 days of written notice from VDOT or Frederick County. It is also understood the exact dimensions of the dedication have not been determined at this time. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Trip Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. Prior to construction on the State's right-of-way, the developer will need to apply to this office for issuance of appropriate permits to cover said work. Frederick County Fire Marshal: Plans approved as submitted. Frederick County Public Works: Your response letter dated July 5, 2007, has adequately addressed our previous review comments. Prior to submittal of any site plans associated with the proposed industrial development, please provide this office with copies of the geotechnical reports to verify that the onsite karst features have been properly addressed. Frederick County Inspections Department: No comment required at this time. Frederick County Sanitation Authority: 1" Review approved Health Department: The Health Dept. has no objection if adequate public water.and sewer is to be provided to serve the industrial park. GIS Department: Frogale Ct. was pre -approved and already in the system. Structure numbering will be assigned during the permitting and construction phase of development. Department of Parks and Recreation: No comment Planning & Zoniniz: A) Master Development Plan Requirement A master development plan is required prior to development of this property. Before a master development plan can be approved, it must be reviewed by the Planning Commission, Board of Supervisors and all relevant review agencies. Approval may only be granted if the master development plan conforms to all requirements of the Frederick County Zoning and Subdivision Ordinances. The purpose of the master development plan is to promote orderly and planned development of property within Frederick County MDP #09-07, Annandale Ad Industrial Park September 6, 2007 Page 3 that suits the characteristics of the land, is harmonious with adjoining property and is in the best interest of the general public. B) Location The subject property is located at the intersection of Shady Elm Road (Route 651) and Dawson Drive, adjacent to Route 37. C) Site History The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identifies this property as being zoned M-1 (Light Industrial). D) Site Suitability & Proiect Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The property is located within the Sewer and Water Service Area (SWSA). The Sewer and Water Service Area defines the general area in which more intensive forms of planned commercial and industrial development will occur. In addition, the Annandale Allied Industrial Park properties are located within the area encompassed by the Southern Frederick Land Use Plan. The Southern Frederick Land Use Plan envisions this area remaining industrial. The property is currently zoned M1 (Light Industrial) and therefore the development is in accordance with the goals of the Comprehensive Policy Plan. Transportation The Eastern Road Plan of the Frederick County Comprehensive Policy Plan identifies a new interchange planned for Route 37 at Shady Elm Road. This MDP provides a land reservation for the interchange which will be dedicated without compensation within 180 days of request from VDOT or Frederick County (note 12C). The Eastern Road Plan also identifies Shady Elm Road as an improved major collector road (urban four lane divided). This MDP will be providing improvements to Shady Elm Road which will upgrade the road to a pavement width of 36 feet and provide curb, gutter and sidewalks along the frontage of their property. As shown by Note 12E on the MDP at the intersection of Apple Valley Road and Route 11, the developer will be extending the eastbound right turn lane and extending the pavement markings for the northbound left turn lane to provide 450 feet of left turn storage. The properties within the Annandale Allied Industrial Park will be accessed off a new public street (Frogale Court). This new road will be the only access point onto Shady MDP 409-07, Annandale Ad Industrial Park September 6, 2007 Page 4 Elm Road, all other entrances are prohibited as indicated by note 12d on the plan. Pro ers — There are no proffers associated with this property. STAFF CONCLUSIONS FOR THE 09/05/07 PLANNING COMMISSION MEETING: The master development plan for the Annandale Allied Industrial Park depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. PLANNING COMMISSION SUMMARY & ACTION OF THE 09/05/07 MEETING: There were no public comments. No issues or areas of concern were raised by the Commission. The Planning Commission unanimously recommended approval. (Note: Commissioner Watt was absent from the meeting.) STAFF CONCLUSIONS FOR THE 09/12/07 BOARD OF SUPERVISORS MEETING: The master development plan for the Annandale Allied Industrial Park depicts appropriate land uses and appears to be consistent with the requirements of Article XVII, Master Development Plan, of the Zoning Ordinance. Therefore, the preliminary Master Development Plan for the Annandale Allied Industrial Park is in a form that is administratively approvable. All of the issues brought forth by the Board of Supervisors should be appropriately addressed by the applicant. The applicant is seeking- approval authorization of the preliminary muster development plan by the Board of Supervisors. The master development plan appears acceptable provided there is a clear understanding that the right-of-way reservation noted along Route 37, for future Route 37 north bound off ramp, will be dedicated (without compensation) to VDOT within 180 days of written notice from VDOT or Frederick County. It is also understood the exact dimensions of the dedication have not been determined at this time. Before making any final comments, this office will require a complete set of site plans, drainage calculations and traffic flow data from the I.T.E. Try Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all right-of-way needs, including right-of-way dedications, traffic signalization, and off -site roadway improvements and drainage. C) Site History The original Frederick County Zoning Map (U.S.G.S. Winchester Quadrangle) identifies this property as being zoned M-1 (Light Industrial). D) Site Suitability & Project Scope Comprehensive Policy Plan: The Frederick County Comprehensive Policy Plan is an official public document that serves as the community's guide for making decisions regarding development, preservation, public facilities and other key components of community life. The primary goal of this plan is to protect and improve the living environment within Frederick County. It is in essence a composition of policies used to plan for the future physical development of Frederick County. [Comprehensive Policy Plan, p. 1-1] Land Use Compatibility: The property is located within the Sewer and Water Service Area (SWSA). The Sewer and Water Service Area defines the general area in which more intensive forms of planned commercial and industrial development will occur. In addition, the Renaissance Commercial Center properties are located within the area encompassed by the Southern Frederick Land Use Plan. The Southern Frederick Land Use Plan envisions this area remaining industrial. The property is currently zoned M1 (Light Industrial) and therefore the development is in accordance with the goals of the Comprehensive Policy Plan. Transportation The Eastern Road Plan of the Frederick County Comprehensive Policy Plan identifies a new interchange planned for Route 37 at Shady Elm Road. This MDP provides a land reservation for the interchange which will be dedicated without compensation within 180 days of request from VDOT or Frederick County (note 12C). The Eastern Road Planalso identifies Shady Elm Road as an improved major collector road (urban four lane divided). This MDP will be providing improvements to Shady Elm Road which will upgrade the road to a pavement width of 36 feet and provide curb, gutter and sidewalks along the frontage of their property. As shown by Note 12E 'on the MDP at the intersection of Apple Valley Road and Route 11, the developer will be extending the eastbound right turn lane and extending the pavement markings for the northbound left turn lane to provide 450 feet of left turn storage. The properties within the Annandale Allied Industrial Park will be accessed off a new public street (Frogale Court). All of the issues brought forth by the Planning Commission should be appropriately addressed prior to a recommendation to the Board of Supervisors. It appears an already problematic intersection (Route 11 and Apple Valley Road) is further impacted by our project. It seems logical that the interchange at Route 37 and Apple Valley Road would alleviate these issues. While I understand that this interchange is only a concept at this point in time, it is an expensive concept for the developer after agreeing to set aside approximately 2.5 acres of land to accommodate this interchange at a value in excess of $100,000 per acre. The turn lane mentioned below is currently 500' in length so we are only talking about 150' feet of additional turn lane. However, there are some substantial utility poles in the way of this lane extension which would drive up the cost of this improvement. Keep in mind that this is an MDP, not a rezoning and that the developer has already agreed to widen Apple Valley Road to 36', add curb and gutter and sidewalk to approximately 1700' of frontage in addition to the aforementioned right-of-way reservation. For the Route 11/Apple Valley Rd 2014 Design year PM scenario, a 3% of truck traffic will change the overall intersection from LOS D to LOS E. In addition, certain movements will drop from LOS D to LOS F. The property has grown by about 18 acres as a result of a BLA between our client and GE. Also enclosed are the comment sheets from FCSA, Health Dept., GIS, Building inspections and the Fire Marshall. The GIS department required a name for the proposed roadway which we have added to the MDP (after clearing the name with GIS). VDOT has no remaining issues with the MDP except for the geometry of the R/W reservation and as soon as I receive the preliminary designs from Mr. Bishop I will adjust it accordingly. A TIA has been prepared for the project and submitted to VDOT separately and is still under review. The public works department had just two minor comments (I've included a copy of our comment response letter) and I would anticipate approval from them shortly. An Interparcel connection should be provided to the remainder of the GE property to the north. Response: The developer has purchased a portion of the GE property (via BLA) not currently in use by GE and therefore we do not see a need for an interparcel connector (as discussed in previous meetings with the County and VDOT). I should point out that the "pond" that shows up on the topography is no longer a functioning pond as the embankment was breached some time ago (judging by the mature vegetation in that area). A wetlands investigation was performed by ECS on the site and no wetlands were found. In the event that the pond was originally intended to manage flow from Route 37 (VDOT could not verify this and it wasn't shown on the plans we have seen for 37) we will be directly runoff from 37 to our proposed pond for management. 2. Comment: It appears that the proposed stormwater management facility includes a point source discharge. Depending on the actual proximity to the property line, the creation of a point source discharge at this location may necessitate the acquisition of an offsite drainage easement from the CSX Railroad. Response: Acknowledged. We are working with CSX to construct a spur on this site as well. The proposed pond is design to reduce the 100-year storm event to a flow that will safely pass through the existing box culvert within the railroad embankment without topping the railroad.
