Roughly 28 acres of RP land remains to be developed (outlined in yellow). The developer has reserved this land for development to coincide with construction of Warrior Road. We would appreciate your opinion as to the validity of this plan in the preparation of plats and plans for this last section under the administrative approval policy of Frederick County. The administratively approved master plan will show three changes namely, 1) the addition of a 40' dedication to Warrior Road, 2) the owner intends to increase the size of certain lots which will result in less lots recorded than indicated in the approved master plan and 3) the developer has made arrangements with the developer of Fredericktowne, Section III (Fredericktowne Company land) for the extension of gravity sewer to the site which will eliminate the need for a sewage lift station. Your determination that these items can be approved administratively, upon submission of the revised MDP meeting your regulations, would be appreciated. The proposed 25"X16" pipe, arch size, is no longer available. The standard size is now 24"X18". nd should be provided at the end of the Village Lane 2. A temporary turn arou construction. 3. A Standard CD-2 should be placed at Station 3+50 (±) Village Lane. 4. Ditches will be reviewed during construction to determine if additional erosion control measures are necessary. 5. The radii for flares at street intersections should be a minimum of 50'. 6. We are attaching one set of plans and drainage computations marked with our comments in red. A permit must be applied for and approved before doing any work on the State's right-of-way at the intersection of Route 647. A standard VDH&T stop sign will be required. r �� h li to prevent 7. Base stone must be placed a foot wider than the proposed pavement on all streets. Box 2104 Winchester, Virginia 22601 Dear Chuck: In response to your letter transmittal dated June 12, 1984 and your preliminary plans as requested, we have reviewed and our comments are as follows: 1. The radius at the major street intersections should be 50' with an absolute minimum 45'. Exception would be the cul de sac streets could be a minimum of 40'. 2. The radius of the cul de sac's should be a minimum of 40' to accomodate turning movements of snow plows and school buses. 3. The water and sewer lines must be located outside of the proposed pavement and the laterals be installed before the final pavement is constructed. 4. The bulb type street oposite Lots 207 & 208 on Polypay Place is not acceptable and would not be maintained as part of the street right of way. 5. The typical section for cul de sac streets appears satisfactory with the exception a minimum 8" depth is recommended for the aggregate base material. Due to the anticipated traffic on Albin Drive and Village Lane in excess of 500 VPD, Bituminous Concrete B-3 with I-2 or S-5 surface treatment is recommended in lieu of prime and double seal. Tests by the VDH&T and the Materials Section will be required to make a more accurate determination of the pavement design. 6. Our recommendations so far as drainage is concerned are very limited since we did not have the benefit of the drainage design and computations. We do anticipate the need for drainage easements at various locations. I am returning a set of plans with our recommendation marked in colored pencil. Developer will have to extend lines. FINAL MASTER DEVELOPMENT PLAN #002-84 Albin Village LOCATION: Southeast side of State Route 647, northeast of Stephens City. MAGISTERIAL DISTRICT: Opequon ADJACENT LAND USE AND ZONING: Open space, agricultural, and residential land use an agricultural and residential zoning. PROPOSED USE AND IMPROVEMENTS: 219 single-family detached housing lots, open space, and state -maintained roads. REVIEW EVALUATIONS: Highway Department - See attached comments. Sanitation Authority - No comment. Stephens City Fire Company - No comment. Planning and Zoning -The proposed site for this development is currently a vacant grassland area used for pasture. The only minor environmental area on the site is an area to the extreme northwest corner of the site which is a natural stormwater retention area. It is proposed during this development that there be some reconstruction of this area to increase its capacity to retain the peak runoff from this proposed development and that a major area of open space be included around .that area. As the enclosed plans will show, the open space is relatively evenly dispersed throughout the development. All housing types proposed are single-family detached cluster or single-family detached traditional. The required buffer area along Route 647 is shown on the plan.. No lots will front on Route 647. While the developer of .the property does not propose to use the solar access density bonus due to design preferences on density, over 60% of the proposed lots are oriented within 20% of true north. The overall solar access to the development will therefore be dramatically increased and will make available to homeowners the option of significant utilization of solar energy for heating. This is a significant accomplishment by the developer and should be of significant impact on the energy useage of Albin Village. The proposed Final Master Development Plan does meet the intent and letter of all sections of the Residential Performance District. The proposed open space will be entirely in grassland area and will be maintainable by the homeowners association. STAFF RECOMMENDATIONS: Approval. In addition'to the annual assessments authorized above, the Association may.levy in any assessment year a special assessment applicable to that year only, for the purpose of defraying, in whole or in part, the cost of any construction or reconstruction, unexpected repair orreplacement of a described capital improvement, such capital improvements must be in conformity with the final master development plan on file in the Office of the Frederick County Department of Planning and Development, upon the Common Elements, including the necessary fixtures and personal property related thereto, provided that any such assessment shall have the assent of two-thirds (2/3) of the votes of members who are voting in person or by proxy at a meeting duly called for this purpose, written notice of which shall be sent to all members not) less than ,thirty (30) days nor'more than sixty (60) days in advance of the meeting, setting forth the purpose of the meeting. Section 5. Uniform Rate of Assessment. Both annual and IMi12 I'll special assessments -must be fixed at a uniform rate for all Lots, and may be collected on a monthly basis. Section 6. Quorum for any Action Authority Under Sections 3 and 4. At the first meeting called, as provided in Sections 3 and 4 hereof, the presence at the meeting of members or of proxies entitled to cast sixty-seven percent (67%) of all votes shall constitute a quorum. If the required quorum is not forthcoming at any meeting, another meeting may be called, subject to the notice requirement set forth in Sections 3 and 4 and the required quorum at any such subsequent meeting shall be one-half (1/2) of the re- quired quorum at the preceding meeting., No such subsequent meeting shall be held more than sixty (60) days following the preceding meeting. Section 7.-. Date of Commencement of Annual Assessments: Due Date. The annual assessments provided for herein shall commencE as to all Lots on the first day of the month following the con- veyance of the Common Elements. The first annual assessment shall be adjusted according to the number of months remaining in the calendar year. The Board of Directors shall fix the amount of the annual assessment against each Lot at least thirty (30) days in advance of each annual assessment period. Written notice of the annual assessment shall be sent to every Owner subject thereto. The due dates shall be established by the'Board of Directors. The Association shall, upon demand at any time, furnish'a certificate in writing signed by an officer of the Association, setting forth Whether the assessments on a specified Lot have been paid. A reasonable charge may be made by the Board for the issuance of thesf (certificates. Such certificates shall be conclusive evidence of (payment of any assessment therein stated to have been paid. Any assessments which are not paid when due shall be delinquent. No owner may waive or otherwise escape liability for the assessments provided for herein by -non-use of the Common Elements or abandonment of his Lot. Section 9. Subordination of the Lien to Mortgages. The lien of the assessments provided for herein shall be subordinate to the lien of any mortgage or mortgages now or hereafter encumber- ing any Lot-' Sale or transfer of any Lot shall not affect the assessment lien. However, the'sale or transfer of any Lot which is subject to any mortgage or deed of trust, pursuant to a decree of foreclosure thereof, or a valid Trustee sale, shall extinguish the lien of such assessments as to payments thereof which become due prior to such.sale or transfer. The radius at the major street intersections should be 50' with an absolute minimum 45'. Exception would be the cul de sac streets could be a minimum of 40'. 2. The radius of the cul de sac's should be a minimum of 40' to accomodate turning movements of snow plows and school buses. 3. The water and sewer lines must be located outside of the proposed pavement and the laterals be installed before the final pavement is constructed. 4. The bulb type street oposite Lots 207 & 208 on Polypay Place is not acceptable and would not be maintained as part of the street right of way. 5. The typical section for cul de sac streets appears satisfactory with the exception a minimum 8" depth is recommended for the aggregate base material. Due to the anticipated traffic on Albin Drive and Village Lane in excess of 500 VPD, Bituminous Concrete B-3 with I-2 or S-5 surface treatment is recommended in lieu of prime and double seal. Tests by the VDH&T and the Materials Section will be required to make a more accurate determination of the pavement design. 6. Our recommendations so far as drainage is concerned are very limited since we did not have the benefit of the drainage design and computations. We do anticipate the need for drainage easements at various locations. I am returning a set of plans with our recommendation marked in colored pencil.
