Dear Mark:
I have had an opportunity to review the referenced plan which was submitted to our department on
September 27, 1999. The following information needs to be provided on this plan prior to final
administrative approval:
Al) Please revise the name and address of the project engineer.
✓2) Please provide a signature on the Surveyor's Certificate or remove this information.
✓3) Please provide the road name for Route 798 (Mill Lane) and for Route 11 (Valley Pike), and
provide the route number for Marathon Drive (Route 1091).
✓4) Please extend the "A" Category Buffer between the Phase I and Phase II properties that are
zoned B-3, Industrial Transition District and B-2, Business General District as indicated on
the red lined plan.
,//5) Please provide the posted speed limit for Valley Pike. ✓
/6) Please rename the third column in the Phase Table to state "Total Acreage". The total of the
three phases is 48.735 acres; therefore, either the total site acreage information or the phase
acreage information is inaccurate.
✓7) The General Information notes appears to be inaccurate as well. The total area acreage may
need to be revised depending upon which information is inaccurate as specified in comment
#6. Furthermore, the proposed development area should be` 16.1 acres if the information
shown for Phase II and Phase III is accurate.

) The area in right-of-way for Phase II and Phase III should be verified. It appears that each
phase contains approximately the same amount of cul-de-sac area; however, the Phase III
area is 65% greater.
9) A note is provided within the Phase III development which states 1.55 acres to be added to
Lot 19. This is appropriate; however, this note should be eliminated if this situation has
changed.

10) The approved Master Development Plan for Battlefield Partnership Development contains a
second sheet entitled Storm Water Management and Drainage Area Map. This sheet also
shows the proposed extension of Sulky Drive to Valley Pike; therefore, this sheet will need
to be revised to remove the road extension and provided as part of the final revised plan.
Please find attached a copy of the revised plan that has been red lined to reflect the comments in this
letter. Please modify your plan to reflect these comments and submit six copies of the Final Revised
Master Development Plan to our department; for administrative approval. Please do not hesitate to
contact me if you have any questions regarding the information in this letter.

RE: Battlefield Partnership Master Development Plan
Dear Mr. Gregory:
During .our meeting this morning, it was suggested that the required buffers and screening
associated" with the above referenced plan be delineated differently. The Frederick County
Planning Department supports your request to remove the active and inactive buffer distance
information from this plan. A revised master development plan may be submitted which depicts
the property lines that are required to have a buffer and specifies the required buffer category.
A narrative may also be included on this revised plan which states that,. "Buffers and screening
will be required to be established during the site plan review process for the individual lots that
are affected. The requirement for buffers and screening shall not apply if a future change in the
adjoining property zoning negates this standard."
Please provide this information to your design engineer and have him provide six copies of the
revised plan for ' the appropriate signatures. Please contact me if I may answer any questions
regarding this letter.

The purpose of this correspondence is to address the concerns expressed in your letter to Mr.
Bruce Edens, dated December 19, 1995. In particular, these concerns regard the Master
Development Plan approval process by Frederick County and the design requirements associated
with the above referenced plan.
Master Development Plans are required to be reviewed and approved by the Frederick County
Board of Supervisors and the Planning Commission. This approval is granted if there are no
significant concerns with the proposed plan; and is generally granted contingent upon all review
agency comments be adequately addressed. The Planning Commission considered this plan
during their regular meeting of March 18, 1992, and the Board of Supervisors considered the
same plan during their regular meeting of April 8, 1992. In both of these meetings, the staff
recommendation was for approval, provided that all review agency comments were adequately
addressed and an acceptable maintenance agreement (for the storm water management facility)
was furnished to the County. Each body approved your Master Development Plan as
recommended by staff.
When Master Development Plans are discussed at the Board of Supervisor and Planning
Commission meetings, staff attempts to surface design issues that are significant. In 1992, the
two issues presented by staff involved the extension of Sulky Drive to Valley Pike, and the need
for a regional storm water management facility for this business park. You are correct in stating
that there was no mention of buffers and screening during those meetings; however, that
requirement as well as all other design requirements are clearly listed in Article XVII of the
Zoning Ordinance, under "Contents of Preliminary Master Development Plan" (Article XV
during the 1992 review). These design requirements are commanded by county law and are not
arbitrarily added by the Planning Commission. Therefore, staff was not in a position to approve
your plan until all required design items were provided on the final Master Development Plan.
Our department received a plan that met these requirements, as well as the required storm water
management maintenance agreement in December, 1995.

I would like to bring your attention to one item in your letter that is inaccurate. You state that
Frederick County allowed you to release Lot 6 within the business park after Board of
Supervisor approval in April, 1992. This in inaccurate, in that Frederick County approved a
subdivision plat for Lot 6 in June, 1987 (please refer to enclosed plat). The only subdivision
that was approved within this business park by Frederick County after April, 1992 pertained to
Marathon Drive and Sulky Drive. This subdivision was required so the right-of-ways could be
dedicated to Frederick County for eventual acceptance into the Virginia Department of
Transportation's (VDOT) secondary system of roads. This is required by VDOT before they
will assume maintenance responsibilities for the roads within the business park.
I hope that the information in this letter provides a detailed history of the approval of the
Battlefield Partnership Master Development Plan. Please contact me if I may answer any
questions regarding this letter.

Dear Bruce,
I have now received a final master development plan from Frederick County Planning
Department.
This plan is completely different than the plan that we agreed to and was voted on at the April 8,
1992 planning commission meeting.
Most specifically there were no buffers shown on that plan. Richard Hardison and I were not
shown this prior to the county signing it.
There was no mention of buffers in April 1992. Why the plan was not completed and signed in
1992, is beyond me. Richard and I thought it was completed and were given a copy.
We were allowed to release Lot 6 after the April 8, 1992 plan approval with no mention that the
Master Plan was not approved by the Planning Commission.
I do not believe that you or the County Planning Commission should be allowed to add
something to a plan without confirming it with the owner.
We are not satisfied with the plan or the method in which it was handled.

REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No overall objections to
preliminary master development plan. However, prior to any
further street construction or lot development this office
will require a complete set of site plans, drainage
calculations and traffic flow data from the I.T.E. Trip
Generation Manual, Fourth edition, for review. Before
starting any construction on the State's right-of-way the
developer will need to apply to this office for issuance of
appropriate permits to cover said work.
Sanitation Authority: Approved as noted.
Inspections Department: Building shall comply with the
Virginia Uniform Statewide Building Code 1990. The Building
Department shall comment on Building Use Group at the time of
Building Plans review.
Fire Marshal: Emergency vehicle access is adequate. Fire

Master Development Plan
County Engineer: Prior to road construction, we request
copies of the detailed site plans, with corresponding road
profiles, culvert inverts and ditch sections. We also request
a copy of drainage calculations to verify adequacy of existing
drainage structures.
Planning and Zoning: The proposed Master Development Plan is
being reviewed specifically for parcels owned by Battlefield
Partnership (marked in yellow on your plans). Some lots in
the vicinity of this development were previously owned by the
applicant and have been subdivided, sold, and developed. The
site currently includes Marathon Drive, Musket Drive, and
Sulky Drive, water and sewer, fire protection, drainage
easements, and existing facilities such as Marathon Bank,
Donald B. Rice Tire Company, Stroehman Breads, and Snappy
Lube.
Two issues that are the basis for a required Master
Development Plan are the proposed extension of Sulky Drive
which will connect with U.S. Route 11 South, and the creation
of a stormwater management pond that will serve the developed
areas, as well as future development.
Review agencies appear to be satisfied with this plan,
provided that they receive additional information related to
road and site drainage. Staff concerns regard the maintenance
of the proposed stormwater management pond, as well as its
location. With this area being owned by many individuals,
staff believes it is prudent to require an acceptable
maintenance agreement for this facility. The location of the
proposed stormwater management pond will make it difficult to
develop the western side of Sulky Drive, as the stormwater
management pond and the twenty (20) foot drainage easement can
not be encroached by development.
Staff will require the applicant to address minor plan
revisions prior to final plan approval. These items include
total acreage of the area owned by Battlefield Partnership,
zoning classification of property numbers 1-A1, 1-A2, 2, 3,
and 4, and administrative information.
STAFF RECOMMENDATIONS FOR 03/18/92 P/C MTG.: Approval, provided
that all review agency comments are adequately addressed and an
acceptable maintenance agreement is furnished to the County.
PLANNING COMMISSION RECOMMENDATIONS OF 03118192: Unanimous

I have reviewed the Battlefield Partnership Preliminary Master Development Plan as you
requested. Listed below are the items that I feel are questionable in relation to Article XV:
✓15-5-2.4 Certificate of engineer is not signed.
Dimensions in feet are questionable along southeast property line.
15-5-2.5 The total area of the property is not listed, only the area that HFG desires to
develop is provided.
15-5-2.8 If HFG plans to develop this area is phases, it needs to be indicated.
15-5-2.9 Should this plan list the adjoining property owners and use of property across
Route 11 and Route 798?
15-5-4.1.2 This site is approximately 450 feet away from the Opequon Creek
Floodplain A Zone; however, I believe that there is a natural
stormwater detention area located adjacent to the interstate.
15-5-4.1.5 This plan provides a conceptual stormwater management plan;
however, the description is not provided.
OTHER: Lots 7 & 8 indicate a problem at the subdivision stage.
Lots 1-A1, 1-A2, 2, 3, & 4 are zoned B-3. E

specific.
The gravel parking lot on parcel 1-B is located in the proposed
stormwater detention area. Is this acceptable from an improvement
viewpoint and a water quality standpoint?
There is a thick dashed line that runs through some of the site - what
does it indicate?

15-5-2 SPECIFICATIONS OF A PRELIMINARY MASTER DEVELOPMENT PLAN
All required items shall be shown clearly on the plan. All preliminary MDPs
shall be prepared in accordance with the following specifications:
/15-5-2.1 The scale shall be 1" = 100' or larger (the ratio of feet to inches shall be no
more than 100' to 1") or at a scale acceptable to the Director. The scale shall
be sufficient so that all features are discernible.
✓15-5-2.2 No sheet shall exceed 42" in size unless approved by the Director of Planning
and Development. If the MDP is prepared on more than one sheet, match
lines shall clearly indicate where the sheets join.
✓ 15-5-2.3 All MDPs shall include a orth arrow, a scale, and a legend describing all .
symbols.
15-5-2.4 A boundary survey of the entire property related to true meridian and
certified a certified Virginia surveyor, architect, or engineer, with
mansions in feet d decimals of feet, is required for all MDPs.
15-5-2.5 The total area of the property shall be specified on the MDP.
✓15-5-2.6 The topography shall be shown at contour intervals acceptable to the
Director.
✓15-5-2.7 The title of the proposed project; the date, month, year the plan was prepared

the adoption of this requirement shall be provided.
15-5-4 CONTENTS OF A PRELIMINARY MASTER DEVELOPMENT PLAN IN
THE M-1 (INDUSTRIAL LIMITED) DISTRICT, THE M-2 (INDUSTRIAL
GENERAL) DISTRICT, THE EM (EXTRACTIVE MANUFACTURING)
DISTRICT, THE HE (HIGHER EDUCATION DISTRICT, THE B-1
(BUSINESS NEIGHBORHOOD) DISTRICT,, THE B-2 (BUSINESS
GENERAL) DISTRICT, OR THE B-3 (INDUSTRIAL TRANSITION)
DISTRICT.
15-5-4.1 The preliminary MDP shall contain a conceptual plan showing the location
and functional relationship between streets and land uses, including the
following:
15-5-4.1.1 A conceptual plan showing the location and arrangement of proposed uses.

required with approval of the preliminary MDP.
15-6-3 An approval block and signature lines for the Director of Planning and
Development.
15-7 MASTER DEVELOPMENT PLAN REVIEW FEES
The Board of Supervisors may adopt a schedule of fees to be paid by the
applicant to the County for the costs associated with the review of the MDP.

I have now received a final master development plan from Frederick County Planning
Department.
This plan is completely different than the plan that we agreed to and was voted on at the April 8,
1992 planning commission meeting.
Most specifically there were no buffers shown on that plan. Richard Hardison and I were not
shown this prior to the county signing it.
There was no mention of buffers in April 1992. Why the plan was not completed and signed in
1992, is beyond me. Richard and I thought it was completed and were given a copy.
We were allowed to release Lot 6 after the April 8, 1992 plan approval with no mention that the
Master Plan was not approved by the Planning Commission.
I do not believe that you or the County Planning Commission should be allowed to add
something to a plan without confirming it with the owner.
We are not satisfied with the plan or the method in which it was handled.

Storm Water Retainage Area Agreement
It is, hereby, agreed that present Owners, Battlefield
Partnership, will maintain the retainage basin area by,
mowing and removal of debris, so as to insure proper
storm water management of the holding pond area.
This agreement will pass with the transfer of ownership.
as a covenant of the land; for all areas of the basin,
as shown in the Master Development Plan of August 31,
1991.
