The following information needs to be provided on this plan prior to final administrative approval: Al) Please revise the name and address of the project engineer. ✓2) Please provide a signature on the Surveyor's Certificate or remove this information. ✓3) Please provide the road name for Route 798 (Mill Lane) and for Route 11 (Valley Pike), and provide the route number for Marathon Drive (Route 1091). ✓4) Please extend the "A" Category Buffer between the Phase I and Phase II properties that are zoned B-3, Industrial Transition District and B-2, Business General District as indicated on the red lined plan. ,//5) Please provide the posted speed limit for Valley Pike. ✓ /6) Please rename the third column in the Phase Table to state "Total Acreage". The total of the three phases is 48.735 acres; therefore, either the total site acreage information or the phase acreage information is inaccurate. ✓7) The General Information notes appears to be inaccurate as well. The total area acreage may need to be revised depending upon which information is inaccurate as specified in comment #6. Furthermore, the proposed development area should be` 16.1 acres if the information shown for Phase II and Phase III is accurate. 8 ) The area in right-of-way for Phase II and Phase III should be verified. It appears that each phase contains approximately the same amount of cul-de-sac area; however, the Phase III area is 65% greater. 9) A note is provided within the Phase III development which states 1.55 acres to be added to Lot 19. This sheet also shows the proposed extension of Sulky Drive to Valley Pike; therefore, this sheet will need to be revised to remove the road extension and provided as part of the final revised plan. Please find attached a copy of the revised plan that has been red lined to reflect the comments in this letter. Please modify your plan to reflect these comments and submit six copies of the Final Revised Master Development Plan to our department; for administrative approval. The Frederick County Planning Department supports your request to remove the active and inactive buffer distance information from this plan. A revised master development plan may be submitted which depicts the property lines that are required to have a buffer and specifies the required buffer category. A narrative may also be included on this revised plan which states that,. Box 520 Stephens City, Virginia 22655 RE: Battlefield -Partnership Master Development Plan Dear Mr. Gregory: The purpose of this correspondence is to address the concerns expressed in your letter to Mr. Bruce Edens, dated December 19, 1995. In particular, these concerns regard the Master Development Plan approval process by Frederick County and the design requirements associated with the above referenced plan. Master Development Plans are required to be reviewed and approved by the Frederick County Board of Supervisors and the Planning Commission. This approval is granted if there are no significant concerns with the proposed plan; and is generally granted contingent upon all review agency comments be adequately addressed. The Planning Commission considered this plan during their regular meeting of March 18, 1992, and the Board of Supervisors considered the same plan during their regular meeting of April 8, 1992. In both of these meetings, the staff recommendation was for approval, provided that all review agency comments were adequately addressed and an acceptable maintenance agreement (for the storm water management facility) was furnished to the County. Each body approved your Master Development Plan as recommended by staff. When Master Development Plans are discussed at the Board of Supervisor and Planning Commission meetings, staff attempts to surface design issues that are significant. In 1992, the two issues presented by staff involved the extension of Sulky Drive to Valley Pike, and the need for a regional storm water management facility for this business park. You are correct in stating that there was no mention of buffers and screening during those meetings; however, that requirement as well as all other design requirements are clearly listed in Article XVII of the Zoning Ordinance, under "Contents of Preliminary Master Development Plan" (Article XV during the 1992 review). These design requirements are commanded by county law and are not arbitrarily added by the Planning Commission. Therefore, staff was not in a position to approve your plan until all required design items were provided on the final Master Development Plan. Our department received a plan that met these requirements, as well as the required storm water management maintenance agreement in December, 1995. 107 North Kent Street • Winchester, Virginia 22601-5000 Page -2- Gregory Letter December 29, 1995 I would like to bring your attention to one item in your letter that is inaccurate. You state that Frederick County allowed you to release Lot 6 within the business park after Board of Supervisor approval in April, 1992. This in inaccurate, in that Frederick County approved a subdivision plat for Lot 6 in June, 1987 (please refer to enclosed plat). The only subdivision that was approved within this business park by Frederick County after April, 1992 pertained to Marathon Drive and Sulky Drive. This subdivision was required so the right-of-ways could be dedicated to Frederick County for eventual acceptance into the Virginia Department of Transportation's (VDOT) secondary system of roads. This is required by VDOT before they will assume maintenance responsibilities for the roads within the business park. I hope that the information in this letter provides a detailed history of the approval of the Battlefield Partnership Master Development Plan. This plan is completely different than the plan that we agreed to and was voted on at the April 8, 1992 planning commission meeting. Most specifically there were no buffers shown on that plan. Richard Hardison and I were not shown this prior to the county signing it. There was no mention of buffers in April 1992. Why the plan was not completed and signed in 1992, is beyond me. Richard and I thought it was completed and were given a copy. We were allowed to release Lot 6 after the April 8, 1992 plan approval with no mention that the Master Plan was not approved by the Planning Commission. I do not believe that you or the County Planning Commission should be allowed to add something to a plan without confirming it with the owner. We also request a copy of drainage calculations to verify adequacy of existing drainage structures. Planning and Zoning: The proposed Master Development Plan is being reviewed specifically for parcels owned by Battlefield Partnership (marked in yellow on your plans). Some lots in the vicinity of this development were previously owned by the applicant and have been subdivided, sold, and developed. The site currently includes Marathon Drive, Musket Drive, and Sulky Drive, water and sewer, fire protection, drainage easements, and existing facilities such as Marathon Bank, Donald B. Rice Tire Company, Stroehman Breads, and Snappy Lube. Two issues that are the basis for a required Master Development Plan are the proposed extension of Sulky Drive which will connect with U.S. Route 11 South, and the creation of a stormwater management pond that will serve the developed areas, as well as future development. Review agencies appear to be satisfied with this plan, provided that they receive additional information related to road and site drainage. Staff concerns regard the maintenance of the proposed stormwater management pond, as well as its location. With this area being owned by many individuals, staff believes it is prudent to require an acceptable maintenance agreement for this facility. The location of the proposed stormwater management pond will make it difficult to develop the western side of Sulky Drive, as the stormwater management pond and the twenty (20) foot drainage easement can not be encroached by development. Staff will require the applicant to address minor plan revisions prior to final plan approval. These items include total acreage of the area owned by Battlefield Partnership, zoning classification of property numbers 1-A1, 1-A2, 2, 3, and 4, and administrative information. Greenway Engineering 1104 Baker Lane I have now received a final master development plan from Frederick County Planning Department. This plan is completely different than the plan that we agreed to and was voted on at the April 8, 1992 planning commission meeting. Most specifically there were no buffers shown on that plan. Richard Hardison and I were not shown this prior to the county signing it. There was no mention of buffers in April 1992. Why the plan was not completed and signed in 1992, is beyond me. Richard and I thought it was completed and were given a copy. We were allowed to release Lot 6 after the April 8, 1992 plan approval with no mention that the Master Plan was not approved by the Planning Commission. I do not believe that you or the County Planning Commission should be allowed to add something to a plan without confirming it with the owner. We are not satisfied with the plan or the method in which it was handled.
