REVIEW EVALUATIONS:
Virginia Dept. of Highways and Transportation - A commercial
entrance permit must be applied for and approved before any work
is done on the State's right-of-way. However, this will depend
on having the adequate sight distance in both directions.
Health Department - No objections; facilities in the house.
Will add onto system when building garage. Three employees
maximum.

W. Pratt, representative of Fertig Cabinet Company. Mr. Carrick

Mr. DeHaven inquired if there will only be one building located on the
fflerty. Mr. Pratt stated that there will be a single metal building of

Chairman Brumback asked for anyone wishing to speak in favor or

Mr. DeHaven moved for approval of Rezoning Request #007-84 of J. P.
�Cington. This motion was seconded by Mr. Romine and passed unanimously.

Mr. DeHaven asked for the size of the building and Mr. Wine replied

Col. Myers asked if the setbacks for the proposed building met the
requirements of the ordinance. Mr. Gyurisin stated that they did.
In answer to Col. Myers' question, Mr. Wine stated that he is required
put in a standard commercial entrance.
No one else was present to speak either in favor or opposition to this
request.
Col. Myers moved to approve this permit with the two conditions noted
�f the staff in addition to those standard conditions required by the
ordinance. This motion was seconded by Mr. McDonald and passed unanimously.

Mr. Horne presented a letter from Mr. Kevin V. Omps of H. H. Omps,
a trucking firm north of the Route ll/Route 81 interchange in Frederick
f.unty. Mr. Horne noted that this area is currently zoned A-2 (Agricultural,

MAGISTERIAL DISTRICT: Gainesboro
ADJACENT LAND USE AND ZONING: Open space, commercial, and
residential land use and agricultural zoning.
PROPOSED USE AND IMPROVEMENTS: Public Garage
REVIEW EVALUATIONS:
Virginia Dept. of Highways and Transportation - A commercial
entrance permit must be applied for and approved before any work
is done on the State's right-of-way. However, this will depend
on having the adequate sight distance in both directions.
Health Department - No objections; facilities in the house.
Will add onto system when building garage. Three employees
maximum.
Inspections Department - Building to be in compliance with the
Virginia Uniform Statewide Building Code.
Reynolds Store Fire Company - No comment.
Planning and Zoning,- Enclosed, you will find the ordinance.
conditions that are placed on all public garages by the zoning
ordinance and a copy of the current conditions on a similar
public garage located on an adjacent property to this request.
The staff can not identify any adverse effects of this
particular request.if all conditions of the .zoning ordinance 'are
met. It would seem, however, that it would be very difficult
for Mr. Wine to meet the screening.provisions as outlined in the
ordinance. The screening, as outlined in the ordinance, does
not necessarily require the screening of inoperative vehicles

that are waiting to be repaired. The staff would recommend that
the Commission discuss the issue of these type vehicles and
determine whether screening should be required for these
vehicles also. The staff would not necessarily recommend
limitations on the hours of operations for this proposal due to
the lack of any nearby residences.
STAFF RECOMMENDATIONS: Approval with the following conditions, in
addition to those required by the ordinance:
1. This is a one year permit to be reviewed and renewed annually by
the staff, Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this
conditional use permit shall expire and a new conditional use
permit will be required.
The staff would recommend a thorough discussion of the outside
storage of inoperative vehicles and the possible necessity for
screening and hours of operation.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval with the
following conditions, in addition to those standard conditions
required in the ordinance for a public garage:
1. This is a one year permit to be reviewed and renewed annually by
the staff, Planning Commission, and Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this

Approval on April 6, 1983 of Amended Conditional Use Permit #005-80
of Robert and Betty Kerns for a public garage with the following
conditions:
1) No more than five motor vehicles of any kind which are not capable
of being operative and which would not be economically profitable
to make operative may be placed on the property at any one time.
2) All outside storage shall be adequately screened.
3) The applicant is authorized to operate a towing business on these
premises.
4) If the use, occupancy, or ownership of the property changes, this
