This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of November 11, 1987:
Approval of Conditional Use Permit Request #018-87 of Theodore P. Hoover for a
public garage and body shop to be located on the west side of Route.654,
approximately .02 miles north of Route 522 North in the Gainesboro-Magisterial
District, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use of the property changes, this conditional use permit shall expire
and a new conditional use permit will be required.
3. Approval of Virginia Department of Transportation commercial entrance permit
prior to operating the business.
4. Off street parking:,is required.
5. The following conditions taken from the Zoning Ordinance will apply:
Garage, Public - the following conditions will be met:
--All repair work shall take place entirely within an enclosed structure.
--All exterior storage of parts and equipment shall be screened from view of
surrounding properties by a solid artificial or compact natural screen of
at least five (5) feet in height, which shall be adequately maintained as
long as such exterior storage is continued.
Garage, Body Repair - the following conditions will be met:
--All repair work shall take place entirely within an enclosed structure.
--All exterior storage of parts and equipment shall be screened from view of
surrounding properties by a solid artifical or compact natural screen of at
least five (5) feet in height, which shall be adequately maintained as long
as such exterior storage is continued.

After long and careful consideration, this office is in agreement to the
conditional use permit to the above referenced location without the
construction of a commercial entrance to our minimum requirements with the
following conditions.
1. The Department of Transportation shall reserve the right to review the
aforementioned one (1) year after the date of the conditional use permit
or the time frame within.
2. There shall be no parking at anytime from the business outside the
adjacent buildings.
3. There shall be no signs as to advertisement of the business placed outside
the premises.
4. At anytime the Department warrants it necessary, the applicant agrees to
apply for a commercial entrance permit which will be built to the
Department's minimum standards.
5. At anytime within this time frame the applicant so desires, a commercial
entrance permit may be applied for, approved and built to our minimum
standards.

MAGISTERIAL DISTRICT: Gainesboro
ADJACENT LAND USE AND ZONING: Mixed residential, commercial, and vacant land uses
and A-2 (Agricultural General) Zoning.
PROPOSED USE AND IMPROVEMENTS: public garage and body shop.
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - No objection to the conditional use
permit. Before a business can be opened at this location, a commercial
entrance permit must be applied for and approved and must be built to our
minimum standards.
Health Department - No objection. A permit from the Health Department is
necessary to install the sewer line and to connect to tank. Maximum of two
occupants.
Gainesboro Fire Company - No objection.
Inspections Department - This conditional use permit request shall comply to
Use Group S-1, Section 310.0, BOCA Basic National Building Code, 1984.
Planning and Zoning - No objection. A conditional use permit is required for
a public garage/body shop in the A-2 (Agricultural General) Zoning District.
There are a number of businesses located on this portion of Route 654 just
north of Route 522 at Nain. Across from this property, on the east side of
Route 654, two auto repair businesses have been issued permits. One of these
appears to be closed at this time.
The character and appearance of this neighborhood would not appear to be
changed with the addition of another public garage use. The building
proposed for this use is existing. Because of the location of the existing
building, especially in relation to Route 654, the staff would suggest that
only off street parking be allowed.

PLANNING COMMISSION RECOMMENDATIONS OF 11/4/87: Unanimous approval with the
following conditions:
1. This will be a one year permit to be reviewed and renewed annually by the
staff, the Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit will expire and a new conditional use permit will be required.
3. Approval of VDOT commercial entrance permit prior to operating the business.
4. Off street parking.
5. The following conditions taken from the zoning ordinance will apply:
Garage, Public - provided that the following conditions shall be met:
--All repair work shall take place entirely within an enclosed structure.
--All exterior storage of parts and equipment shall be screened from view of
surrounding properties by a solid artificial or compact natural screen of at
least five (5) feet in height, which shall be adequately maintained as long
as such exterior storage is continued.
