This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of October 14, 1987:
Approval of Conditional Use Permit Request #016-87 of Harry A. Downard for farm
supply sales to be located on Route 842 in the Opequon Magisterial District, with
the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the'Planning Commission, and the Board of Supervisors.
2. If the use of the property changes, this conditional use permit shall expire
and a new conditional use permit will be required.

LOCATION: Route 842, approximately 1 1/2 miles, turn left at new house in field.
MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Agricultural land use and zoning
PROPOSED USE AND IMPROVEMENTS: Construct a 25' x 40' building for sales office
for new horse and livestock trailers.
REVIEW EVALUATIONS:
Transportation Department - No objection to Conditional Use Permit; however,
before a business is started, a commercial entrance permit must be applied
for and approved.
Health Department - No objection; has NPDES permit to allow for bathroom if
necessary.
Middletown Fire Company - No comment.
Inspections Department - All structures must be built according to Virginia
Uniform Statewide Building Code.
Planning and Zoning - No objections. The proposed use is considered a farm
supply sales use permitted only with a conditional use permit in the A-2
Zoning District.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
