Dear Mr. Mogle:
This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of July 8, 1987:
Approval of Conditional Use Permit #014-87 of Roger L. Mogle for a cottage
occupation/small engine@= repair to be located on Route �,in the Opequon
Magisterial District. This Conditional Use Permit is approved with the following
conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit will expire and a new conditional use permit will be required.
3. All activities and storage shall be located within the existing buildings.
Equipment waiting for repair shall be located within the buildings or shall be
totally screened from surrounding properties.
4. Hours of operation shall be 3:00 p.m. to 6:00 p.m., Monday through Friday;
9:00 a.m. to 5:00 p.m, on Saturdays; closed on Sundays.

MAGISTERIAL DISTRICT: Opequon District
ADJACENT LAND USE AND ZONING: Residences, zoned R-P (Residential Performance)
PROPOSED USE AND IMPROVEMENTS: Cottage Occupation/Small Engine Repair
REVIEW EVALUATIONS:
Virginia Dept. of Transportation - No objection to conditional use permit.
Before the business is started, a commercial entrance permit will be required
and the entrance will have to be constructed to the minimum standards. It
should be done prior to opening this business.
Health Department - No objection. However, due to existing inadequate,
malfunctioning sewage disposal system at this site, this office will require
connection to Sanitation Authority sewer system upon such time that
additional hook-ups are allowed. No employees at this time. Temporary
repair attempt being considered.
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code as a minimum.
Building Department - No comment.
Planning and Zoning - The proposed use is to be located on a .69 acre lot in
a residential area, adjacent to Interstate 81. All proposed activities
associated with the use must not be visible from surrounding properties. Any
other impacts on surrounding properties should be avoided.
