DeHaven DeHaven Enterprises Bloomery Route, Box 92 Winchester, Virginia 22601 RE: Outside Storage of Inoperable .Automobiles Dear Mr. DeHaven: The purpose of this letter is to confirm our discussion, of last week when I was at your auto restoration business in Gainesboro. As I stated at that time, the major concern was, the number of inoperable automobiles being stored along the rear of your property. The number that you have stored there presently exceeds the number.of inoperable cars permitted on a parcel of property zoned A-1. It is my understanding from our discussions that within the next month you intend to remove and clean up many of the vehicles parked in the rear of your property. Please call me within the next 30 days when you have done this so that I may confirm what you have done as far as removing the vehicles. I want to also let you know what the Frederick County Zoning Ordinance permits regarding the outside storage of inoperable automobiles. In the Gainesboro area, which is zoned A-1 (Agricultural Limited), inoperable automobiles are limited to five per parcel of land. If you have more than five inoperable automobiles stored on your property, it is then considered a salvage operation and must be zoned M-2 (Industrial General) for such a use. If you have a business that is a nonconforming business or one that has been in continual operation since November 1, 1973 and is a body shop or automobile repair business such as yours, cars waiting to be repaired may be parked around or near the business so long as those cars are stored solely for customers' cars under repair. Otherwise, the outside storage of automobiles is limited to five inoperable automobiles and customers' automobiles waiting to be repaired. Dear Mr. DeHaven: This is to follow up on our conversation at your place of business on October 5th. I want to document what we agreed on concerning screening of vehicles there. You agreed to put an 8' solid fence around the vehicles you use for parts storage and whatever vehicles are inoperable and not waiting for repair by the end of this month. The only items that are not required to be screened are operable vehicles, vehicles awaiting repair, and the two truck trailer units (not on wheels), which you agreed to paint a neutral, unobtrusive color. With the vegetation around the truck trailers and the fact that they look and act like storage buildings, they do not need to be fenced. In order for the truck trailer units to be legal, though, they need to be 15' off the property line and have a building permit and Certificate of Occupancy. Dear Mr. DeHaven: This is to follow up on our recent conversations regarding what is required to -be in compliance with the screening provisions of your Conditional Use. Permit (#007-86). My.contacting you was prompted by complaints this office has received about the vehicles on your property. After you told me you could not locate the.letter you believe this office wrote after your Use Permit was approved which suspended the screening provisions of your CUP, I checked.with others who might remember such a letter, as I.told you:I .would, and have not found anyone remembering such a letter.`.The.only letter"that relates to this that is in. our files is from 1984', .which describes the number of vehicles you would be allowed to store.on.your property as a nonconforming use. I'm enclosing a copy of !that letter for your reference. However, since you,now operate under a CUP from 1986, that supersedes the letter of::.1984.. In..other words,.. one of.the conditions set for you to operate out of:your current facility overtakes the normal "grandfathering" allowance for. inoperable vehicles. I'm also enclosing :'a copy of.' the:'.' approval letter for your CUP, which describes the-conditions,imposed.on your public garage operation. Having no evidence to the contrary, it will be necessary for you to provide the screening called for in the CUP approval letter in the near future to avoid the revocation of, your CUP. Normally, the best screening is provided by a.6' high solid fence. In your case, since there are buses involved and the possibility of a better placement of them on your property, I would like to visit your site and work out a plan for bringing the property into compliance with the CUP. With the expansion of this business, it is felt this entrance should be upgraded to meet the VDH&T's minimum commercial entrance standards. Health Department — No objection to the proposed useage. The sewage facilities associated with the DeHaven residence are adequate as long as there is no outside employees or use of the sewage disposal system. Gainesboro Fire Company — No comment. Inspections Department — Proposed building to be designed and built in accordance with the virginia Uniform Statewide Building Code and applicable standards for Use Group S-1. Pre—engineered metal buildings require a foundation system designed by a Virginia licensed architect or engineer. Planning and Zoning — Satisfactory. This is a pre—existing or nonconforming restorations operation currently conducted in the basement of Mr. DeHaven's home. It is the staff's understanding that Mr. DeHaven would like to move his current operation to a new structure. The staff has no objection. All of the following public garage conditions must be met: 1. All repair work shall take place entirely within an enclosed structure. 2. All exterior storage of parts and equipment shall be screened from view of surrounding properties by a solid artificial or compact natural screen of at least five (5) feet in height, which shall be adequately maintained as long as such exterior storage is continued. 0 Pa ge 2 DeHaven CUP 3. The Planning Commission or Board of Supervisors may require additional screening where it deems necessary to protect surrounding properties. 4. The Planning Commission and Board of Supervisors shall determine that the proposed use will have no adverse effects on surrounding properties.
