Dear Mr. Smith:
This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of February 11, 1987:
Approval of Conditional Use Permit #013-86 of Joseph C. Smith for a Group Adult
Retirement Home, to be located on the east side of Route 7, one mile east of
Winchester, in the Stonewall Magisterial District. This Conditional Use Permit
is approved with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit will expire and a new conditional use permit will be required.
3. Off-street parking will be provided.
4. Should additional construction or expansion of facilities take place, a site
plan shall be submitted for approval.
5. All state regulatory agency requirements must be met.

LOCATION: East side of Route 7, one mile east of town. It is one house east of
Paramount Pest Control and one house west of Shenandoah Computer. Highs and Video
Den are across the highway and slightly to the east.
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Residential and Commercial Land Use and RP
(Residential Performance) Zoning.
PROPOSED USE AND IMPROVEMENTS: A group adult retirement home.
REVIEW EVALUATIONS:
Health Department - No objection.
Highway Department - A commercial entrance permit must be applied for and
approved prior to opening the business.
Greenwood Fire Company - No objection.
Inspections Department - Existing building to be brought into conformance
with requirements for Use Group 1-1 and Certificate of Occupancy issued
before building is occupied.
Planning and Zoning - No objection. The proposed use is permitted in the RP
(Residential Performance) Zoning District with a conditional use permit. The
use does not detract from the residential characteristics of the
neighborhood, because of the mix of commercial and residential uses.
STAFF RECOMMENDATION: Approval, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
3. Off-street parking will be provided.
