Gentlemen:
I herewith submit application for a conditional use permit
to reestablish the subject property as a legally non -conforming
use with more than (1) residence. I intend to build a house on
the lot as shown on the attached plot plan that is not in the
same location as the structure that was demolished. As well, the
new structure we have planned to have a living area of
approximately 3700 sq ft as compared to an estimated 2700 sq ft
in the structure that was demolished. ( I have been unable to
find any records that give the exact size of the origional
structure.) The origional structure was maintained as a residence
as recent as 1975 and was demolished in 1981.
Also, I intend to submit the application for a building
permit for the new residence in the next couple of days. I
request that a building permit be issued without waiting for
approval or disapproval of the conditional use permit. I agree
to sign an affidavit to abide by the decision of the Planning
Department and the Board of Supervisors regarding the conditional
use permit and discontinue use of the existing structure if so
dictated.

LOCATION: Intersection of Routes 628 and 11 South at Wards Plaza Shopping Center.
2.3 miles southwest on Route 628, right on 621, .2 miles, lot on right, west of
mobile home.
MAGISTERIAL DISTRICT: Back Creek
ADJACENT LAND USE AND ZONING: Residential Land Use and RP (Residential
Performance) Zoning.
PROPOSED USE AND IMPROVEMENTS: Re-establish a legal nonconforming use of property
with more than one residence.
REVIEW EVALUATIONS:
Virginia Dept. of Highways and Transportation - No objection to conditional
use permit. It is our understanding at this time that this is just a
renovation project and not any type of proposed business. However, should a
business be established at a later date, a commercial entrance permit will be
required to meet our minimum commercial entrance standards at that time.
Inspections Department - Proposed building to be designed and built in
accordance with the Virginia Uniform Statewide Building Code and applicable
referenced standares for residential use.
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code.
Health Department - No objections; drainfield site found.
Planning and Zoning - No objections. The proposed house location conforms to
all RP Zoning setback and yard requirements.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This is a one-year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval - no conditions.
