Dear Mr. Mercer:
This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of August 13, 1986:
Approval of Conditional Use Permit #009-86 of Charles A. Mercer to re-establish a
nonconforming use for gas pumps on property located four miles east of Winchester,
on Route 7, in the Shawnee Magisterial District with the following conditions:
1. This will be a one-year permit to be reviewed and renewed annually by the
staff, Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
3. Off-street parking will be provided for store customers that does not
. interfere with use of the gas pumps.
4. Fire hydrants shall be provided when public water service is available.

This office has recently noticed you have opened.a.new business on.
Route 7 and the entrance you are using is .substandard and unsafe. We
have no alternative than.to require an entrance to be constructed to meet
the minimum requirements for the safety of the traveling public.
The Department of Highways and,Transportation's authority to require
minimum design maintenance andsafety standards for.commercial entrances
to improve highways-is.covered under Section 33.1-198. It states all
commercial entrances whether.or.not constructed under this section.shall
be maintained.by the owner,.of the premises at all times.in a manner
satisfactory to the State .Highway and Transportation.Board. 'Furthermore,
the Department's authority to regulate commercial and residential highway
entrances is covered under Section.33.1-12(3) to make rules and regulations
from time to time not in conflict.with the laws of.the State.for the
protection of and covering traffic for the use.of State highways and to
add, to amend or appeal the same:
A commercial entrance permit requires -a permit.fee and bond. The bond
can be done in three ways: .
1. A cash bond equivalent to the amount of work to be done on the State's
right-of-way.
2. A bond from an insurance company using our bond form.
3. A contractor who is doing the work is bonded with us can act as your
agent by getting the permit in your behalf.
It.takes approximately two weeks to -execute a permit application.
It is necessary for us to receive your prompt.attention to•this.matter
by contacting this office to apply for a commercial entrance permit.

Re-establish a Nonconforming Use - Gas Pumps
LOCATION: Four miles east of Winchester on Route 7.
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Residential and vacant land use and A-2
(Agricultural General) and MH-1 (Mobile Home) zoning.
PROPOSED USE AND IMPROVEMENTS: Re-establish a nonconforming use for gas pumps
REVIEW EVALUATIONS:
VA Dept. of Highways & Transportation - The existing entrances will have to
be brought to the minimum commercial entrance requirements and a commercial
entrance permit must be applied for and approved before the business is
opened.
Health Department - No objection.
Greenwood Fire Company - No objection, however, we would like a hydrant
within 300' of all parts of the structure when water service is provided.
Planning and Zoning - No objection, however, off-street parking needs to be
addressed. The staff has determined that the general store (grocery -
convenience store) is a nonconforming use and is permitted to continue
operation. Additionally, the store may expand by 50% or approximately 1,000
square feet. Because the gas pumps have been abandoned for a period of over
one year, a conditional use permit is required to re-establish this use.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This will be a one-year permit to be reviewed and renewed annually by the
staff, Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this conditional
use permit will expire And a new conditional use permit will be required.
3. Off-street parking shall be provided.
