This letter is to confirm the Frederick County Board of Supervisors' action at
..their meeting of April 12, 1989 in reviewing your conditional use permit:
..Approval of Conditional Use Permit Request #012-83 of James Lofton for a cottage
occupation/C.B. repair and installation. This property is located on Route 277
east of Stephens City, in the Opequon Magisterial District, with the following
owing
1. This is a one-year permit to be reviewed and renewed annually by the staff,
the Planning Commission, and the Board of Supervisors.
2. If the use
occupancy, or ownership of the property
changes, this conditional
use permit shall expire and a new conditional use permit will be required
3. Limit hours of operation from 9:00 a.m. to 6 p.m. on Monday through Friday,
from 8:00 a.m. to 3:00 p.m. on Saturday, and no Sunday operation.

south side of Route 277.
MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Commercial, residential, and
agricultural land use and agricultural zoning.
PROPOSED USE AND IMPROVEMENTS: Cottage Occupation/C.B. Repair and.
Installation in an accessory building
REVIEW EVALUATIONS:
VA. Dept. of Highways & Transportation - Entrance will require
a minimum 12. 5' radius, ' 20' width at catch point, and 6" of
aggregate Type 21-A. A commercial entrance permit will be
required and upgrading to standard requirement if -deemed
necessary by the Department.
Department of Inspections - No objections. Any future
alterations or construction shall conform to the Virginia
Uniform Statewide Building Code.
Health Department -.No objection as long as the business
requires no employees.
Stephens City Fire Company - No objections.
Planning and Zoning - No objection.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1. This will be a one year permit to be reviewed and renewed
annually be the staff, Planning Commission, and the Board of
Supervisors.
2. If the use, occupancy, or ownership of the property changes, this
conditional use permit will expire and a new conditional use
permit will be required.

The staff had received.complaints-on both Conditional Use Permits
listed above. The CUP's were;
#012-83 James Loftin: Cottage Occupation/ C.B. Repair and
Installation. Located on Rt. 277 east of Stephens
..City in the Opequon Magisterial District.
#019-87 Jane G. Sullivan: Public Garage. Located .on the .
south side of Rt. 645, Approximately 3/8 mile from
Rt: 50 east, in the Shawnee Magisterial District.
In the case of Mr. Loftin, the complaint was of heavy traffic on
the lane serving as an entrance to his shop. There are two other
residences which utilize the same entrance. After numerous visits
to the site the staff does not feel the traffic generated by the
business..is .-sufficient-to .warrant cancellation of the CUP In
°trAffic was observed during our visits.
..Staff :.recommendation. is ..that .CUP 4012-83 be renewed.
The complaint in the Sullivan case was of a building being built
too close to a property line. On visiting the property it was
found that the building used to'house the garage was in violation
of the required 15' rear setback in an A-2 (agriculture general)
zone. Mrs. Sullivan was informed of. the violation and instructed
that a variance was needed to rectify the situation. It was also
made clear that if a variance was not obtained the CUP would
likely be revoked. Mrs. Sullivan was allotted a number of weeks
to apply for a variance but has not done so.
Staff recommendation is that the CUP #019-87 be revoked.

At their meeting of April 5, 1989, the Frederick County Planning
Commission recommended that CUP # 012-83 of James Loftin be
revoked by the following vote:
YES (to revoke): Copenhaver, Marker, Sherwood, Golladay, Rinker
NO: McDonald, DeHaven, Wilson,.Romine
The Planning Commission also recommended that CUP # 019-87 of
Jane G. Sullivan be tabled until the next meeting. This vote was
unanimous with Commissioner Wilson abstaining.

Rt. 50 east, in the Shawnee Magisterial District.
In the case of Mr. Loftin, the complaint was of heavy traffic on
the lane serving as an entrance to his shop. There are two other
residences which utilize the same entrance. After numerous visits
to the site the staff does not feel the traffic generated by the
business. is sufficient to warrant cancellation of the CUP. In
fact no traffic was observed during our visits.
Staff recommendation is that CUP #012-83 be renewed.
The complaint in the Sullivan case was of a building being built
too close to a property line. On visiting the property it was
found that the building used to.house the garage was in violation
of the required 15' rear setback in an A-2 (agriculture general)
zone. Mrs. -Sullivan was informed of the violation and instructed
that a variance was needed to rectify the situation. It was also
made clear that if a variance was not obtained the CUP would
likely be revoked. Mrs. Sullivan was allotted a number of weeks
to apply for a variance but has not done.so.
Staff recommendation is that the CUP #019-87 be revoked.

We the undersigned wish to file a complaint against Lofton's C.B. Shop
located 3.5 miles east of Stephens City, Va. on Rt. #277. The shop is located
on a private road behind the homes of Roy Shell, W. C. Madagan, and Harold
6 #apzcyk.
We feel that the business has grown too big for the road. The road bed
is only 11 foot wide and has been since 1946. When cars, ten wheelers and
tractors meet they have to back up to one of the houses to pass, or run out in
the grass and make ruts when its wet. Some of them drive too fast. Some go
by and spin their wheels and throw gravel. When its dry they make so much
dust we cannot keep our house windows clean or our cars. Also, it isn't safe
for young children to cross the road to Mr. & Mrs. Madagan's pool.
We feel if the board doesn't
