This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of May 8, 1985:
Approval of Conditional Use Permit #004-85 of Glenn C. Whitacre for a Sawmill,
Type B (Woodlot for Storing and Sawing Firewood) located on the right side of
Route 127, three miles from Route 522 North with the following conditions:
1. This is a one year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
2. If the use, occupancy, or ownership of the property changes, this Conditional
Use Permit shall expire and a new Conditional Use Permit will be required.
3. Off-street parking is to be provided.
4. No structures to be built on the property.

REVIEW EVALUATIONS:
Highway Department - A commercial entrance permit must be applied for and
approved if retail uses are proposed.
Reynolds Store Fire Company - No comment.
Health Department - No objections.
Planning and Zoning - This use would consist of storing and sawing of wood
for delivery. Public retail traffic to this site should be minimal.
STAFF RECOMMENDATIONS: Approval, with the following conditions:
1) This is a one year permit to be reviewed and renewed annually by the staff,
Planning Commission, and the Board of Supervisors.
2) If the use, occupancy, or ownership of the property changes, this conditional
use permit shall expire and a new conditional use permit will be required.
3) Off-street parking to be provided.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous Approval, with the following
conditions:

between Sylvester 0. Speelman and Margaret R, Speelman, his wife, parties of
the first part$' and Clenn Co Whitacre and Linda M. Whitacre, his wife, parties
of the second part,
WITNESSETH: That for and in consideration of the sum of Ten
Dollars ($10.00) cash in hand paid, and other good and valuable consideration,
the receipt of all of which is hereby acknowledged, the said parties of the
first part do hereby grant, sell, and convey, with general warranty of title,
unto the parties of the second part, as tenants by the entirety, with common
law right of survivorship, all of that certain tract or parcel of la'hd con-
taining 6,858 acres, more or less, together with all rights, rights of way,
privileges, improvements and appurtenances thereto belonging, lying and being

Frederick County, Virginia, and being all of the remainder of that certain
larger tract or parcel of land originally containing 7.83 acres, more or less,
that was conveyed to .the parties of,the first part by Vermont Speelman by
deed dated August 27th, 1963, and of record in the Clerk's Office of the
Circuit -Court of Frederick County, Virginia, in Deed Book No. 292, page 333,
from which original tract tits parties of the first part have heretofore
conveyed to the parties of the second part a lot containing 0.972 acre, more
or less, by deed dated May 7th, 1979, and of record in the aforesaid Clerk's
Office in Deed Book No. 508, page 8. thus leaving 6.858 acres, more or less,
conveyed hereby, but it is expressly stipulated that his conveyance is in
gross and not by the acre, and is intended to convey all of the remainder of
said original tract* A reference to all of said records, and to the refer-
ences therein contained, is here made for a further and more particular
description of said land.
It is expressly stipulated that said land is conveyed subject to
all applicable, or legally enforceable, easements, if any, of record affects
same.
Except as noted above the aforesaid grantors covenant that they
have the right to convey the said land to the aforesaid grantees; that the
said grantees shall have quiet possession of the said land, free from all

encumbrances; that they have done no act to encumber the said land; and that
they will execute all such further assurances of the said land as may be
requaitie.
