Ruddy, Deputy Director Frederick County Department of Planning and Development 107 North Kent Street, Suite 202 Winchester, VA 22601 Re: CUP #05-07; Spirituality Retreat Center, Catholic Diocese of Arlington White Post, Virginia Dear Mr. Ruddy; The purpose of this letter is to inform you of certain developments subsequent to the Frederick County Board of Supervisors approval of CUP #05-07 on October 10, 2007 First, Bishop Loverde has selected an official name of San Damiano Spiritual Life Center. While approved earlier, this was announced in the Arlington Catholic Herald edition of July 16-22, 2009. We are in the process of applying this name to official operating permits and licenses where necessary. Second, during Staff review and discussions with our representatives, we expressed concern that Condition 9 was inconsistent with Condition 7 should the Catholic Diocese of Arlington (CDA) reach a level of use that we were at time identifying as Phase H. Phase I envisioned a slow start up with no on -site preparation of food, but Phase II would include a food service establishment license with on -site preparation. We were advised by Evan Wyatt on October 3, 2007 that you would advise the Board that if all of the conditions applicable to Condition #7 allow for food preparation to occur on -site, then Condition #9 would not be applicable. Later we were advised that minutes of the board reflected this. By letter dated January 4, 2008 addressed to Greenway Engineering the Lord Fairfax Environmental Health District replied to a request for Site Plan Comments indicating that we would not be allowed to open the facility without a Hotel and Food Service license. The requirement for a Food Service license was also linked to upgrading the existing well to a Public Water supply. As a consequence, we have gone to great expense and delayed use of the facility beyond the programmed date of Spring, 2009 by: a) upgrading the potable water system to a Public Water System (Waterworks Construction Permit No. 204708 and CUP #05-07; Spirituality Retreat Center, Catholic Diocese of Arlington White Post, Virginia Page -2 b) collapsing our Phase I and Phase II Food Service plan into one phase and applying for a Food Service Establishment Permit (Lord Fairfax Health District permit number 01-069-0129) c) appealing the requirement regarding the Hotel status to the Director, Office of Environmental Health Services, Department of Health, Richmond. By letter dated March 18, 2009 the Director advised that we do not meet the definition of a hotel as defined in the Code of Virginia. We have submitted additional information to the Director as requested, and we are waiting for a formal decision in writing. We are completing the construction and expect to request operating permits/licenses within the next few days. We have not yet scheduled any group for religious events. On July 1, 2009, the writer conducted a final inspection of the well and water facilities for the San Damiano Spiritual Center. Based on this inspection, the well and related water facilities, appeared to have been completed substantially in accordance with the approved plans and specifications and can be placed into service. A waterworks operation permit for the water system is being prepared and will be forwarded to the Office of Drinking Water in Richmond for execution. Upon receipt of the executed waterworks operation permit, a copy will be forwarded to Mr. Kenneth Brooks, Catholic Diocese of Arlington. Operational monitoring, testing, and reporting requirements were discussed with Mr. Brooks to ensure proper system operation. If operated as designed, the water system should ensure that all water supplied will comply with current drinking water standards. Ruddy, AICP, Deputy Planning Director This report is prepared by the Frederick County Planning Staff to provide information to the Planning Commission and the Board of Supervisors to assist them in making a decision on this request. It may also be useful to others interested in this zoning matter. This proposed submittal appears acceptable to VDOT. Further comments will follow at site plan review. Prior to operation of the business, a commercial entrance must be constructed to our standards to allow for safe egress and ingress of the property. Any work performed on the State's right-of-way must be covered under a land use permit. The permit is issued by this office and requires an inspection fee and surety bond coverage. Frederick County Fire Marshall: Plan approval recommended. Frederick County Inspections: Existing building shall comply with The Virginia Uniform Statewide Building Code, The International Existing Building Code and use group A (Assembly) and R (Residential), of the International Building Code/2003. Other Code that apply are ICC/ANSI A 177.1-03 Usable and Accessible Buildings and Facilities. Accessible route improvements shall comply with the IEBC 20% cost unless full compliance is met. Asbestos inspection shall be required prior to permit issuance for change of use permit for the renovations. Note: Elevations of the accessible route from the building required exits to the accessible parking is not shown in detail on the site plans submitted. Please submit detailed plans showing the accessible route and elevations at the time of permit application. Frederick County Public Works: Upon review of the site plan dated May 30, 2007, we offer no comments at this time. Therefore, we recommend our approval of the subject site plan. Since the project proposes the disturbance of more than 10,000 square feet, the proposed improvements will require a Land Disturbance Permit. VDH-Office of Drinking Water: If the system serves "at least 25 persons per day for at least 60 days out of the year" you would not have to submit plans to our office for the construction and you would not be required to have a waterworks permit. In the eyes of the regulations you would be a private system regulated similar to a private home and your well site would be approved by the Local Health Department. I would make the following suggestions: I would be glad to meet with you and approve any well sites which you may be planning to develop. Then I suggest so that if the system ever expands to fit the public definition the wells will already be in the system. I can give you a list of water quality development samples required of public systems. For safety and liability purposes I would suggest you run these samples although they are not required. After the system is in operation I suggest you take quarterly bacterlogical samples again for safety and liability purposes, although they are not required. If you have any food services in the future a permit for that operation will have to be obtained from Local Health Department. If a food permit is required they will work with you to set up a bacterlogical sampling program. f 0 CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 3 Department of Environmental Quality: Please see the attached correspondence. Frederick -Winchester Health Department: The health department cannot comment favorably on the proposal as submitted. An antiquated, non -discharging lagoon is proposed to be used for sewage disposal. The possibility of contamination of groundwater is a concern. In addition, there is not guarantee that the current sewage disposal system will function properly given the proposed increase in water use and changes in wastewater quality. An Authorized Onsite Soil Evaluator could possibly locate an acceptable site for a sewage disposal system to accommodate the proposal. Public water and sewer, if approved by the Frederick County Sanitation Authority, could also be an option, if feasible. Based on the information provided in the submittal, a public water supply will be required. Contact the Office of Water Programs for information and permitting. A permit for a restaurant and/or a motel may be required and should be addressed when the site is submitted. Planning and Zoning: The proposed use is identified as a Spiritual Retreat Center in the application. Within the RA (Rural Areas) Zoning District this particular type of use has historically been classified within the following group, Section 165-51.0. Campgrounds, tourist camps, recreation areas and resorts. The most recent example of such a use being. addressed as a Religious Retreat in this, classification in Frederick County is'God's Glory Land within.the Back Creek District (CUP#01-94). The historical use of this property as monastery/friary, and later as a residence and care center for elderly friars, has riot been in operation for a relatively long period of time (much greater than one year). Therefore, the property has not retained any level of legal nonconformity. Accordingly, the direction is to establish a use permitted with a CUP, a Spirituality Retreat Center. This is consistent with Section 165-51.0. of the Frederick County Zoning Ordinance. The Catholic Diocese of Arlington is proposing to use the former Franciscan Monastery as a spirituality center for reflection, worship, retreats, and diocesan meetings. The existing facility is located on a 150 acre site and includes a chapel with approximately 100 seats, a cafeteria, meeting rooms, library, sleeping rooms, and supporting areas. The Diocese also anticipates using the property for outdoor passive recreational trails such as nature and reflection trails. The Diocese projects that as many as 160 people may use the facility at any one time. However, such large scale gatherings would occur relatively infrequently. More frequently, the facility would be used for small retreats, some that may be for several nights, and for larger groups for daytime use. A limited number of resident staff (no more than 5) is anticipated. The proposed conditions accompanying this Conditional Use Permit are based upon the scope. of the above use of the facility as provided by the CDA: A possible schedule of their use has been provided as part of their application. In addition, the .proposed conditions address the current health system limitations of the property. . t CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 4 The scope of the use should be based around the existing building and the current health system limitations of the property. The responsible permitting agencies; the Virginia Department of Health — Office of Water Programs and the Department of Environmental Quality have been in consultation with the Catholic Diocese of Arlington and the County regarding the proposed use of this facility. In particular, the Department of Environmental Quality, who recently modified the facilities VPDES Permit (No. VA 0089010 with Modification Date of January 10, 2007 and Expiration Date of March 31, 2010) has evaluated the proposed use of the facility and expressed to staff that they foresee no reason why the CDA will not be able to operate within the parameters of their existing permit. The existing facility currently operates under a VPDES Permit and utilizes a zero discharge limit sewage lagoon. The permitted discharge to the lagoon is a rate of 1,600 gdp. Future options that may be available to the CDA include constructing an alternative waste water system on -site for their use that would meet current standards. The CDA has expressed a desire to ultimately connect to public water and sewer. However, this property falls well beyond the area in which public water and sewer is available by policy. The property is not located within the Urban Development Area or Sewer and Water Service Area. The Virginia Department of Health — Office of Drinking Water has outlined the qualifications for being classified as a public waterworks system that must have an Operations Permit issued by their Office. The CDA is aware of these requirements and have stated that they will not meet these minimum requirements. Should the CDA ultimately determine that they need to obtain an operations permit for a public waterworks system or improve their private water system, the Office of Drinking Water has offered several suggestions to assist the CDA. Staff contacted the local Health Department regarding the requirements for needing a restaurant permit. Based upon the CDA's proposed approach to providing only off -site catering for larger groups and utilizing boxed lunches, light meals, and bottled water, it would appear as though a food or restaurant permit would not be required. This approach has resulted in the condition being proposed that only off -site catering will be allowed in conjunction with this conditional use permit. In general, the facility and site is well suited for the proposed use of a Spirituality Retreat Center. Several site improvements would be required to accommodate the proposed use including improved access to the site and an increase in the size of the parking area. A site development plan will be required to be completed prior to the use of this site. Staff has also suggested that the signage on the site be limited in order to maintain the character of the facility and to ensure that the facility continues to fit in with the surrounding neighborhood. CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 5 STAFF CONCLUSIONS FOR THE 09/19/07 PLANNING. COMMISSION MEETING: Should the Planning Commission find this use appropriate, Staff would recommend the following conditions: 1. All.review agency comments shall be followed at all times. 2. An engineered site plan for the expansion of the parking area and access to the site shall be approved by Frederick County, -and the improvements completed prior to, starting this use. 3. No expansion of the existing building shall be permitted with this CUP. 4. The Resident Staff shall not exceed five (5) people living in the facility at any one time. 5. No transit user or guest will be permitted to stay longer than thirty (30) days. 6. The maximum number of guests allowed to use the facility at any one time shall be one hundred and sixty (160). 7. When required by the use of the facility, all federal, state, and local regulations applicable to public waterworks, wastewater disposal, and restaurant operation will be complied with at all times. 8. CDA will operate the facility to comply with VPDES Permit No. VA 0089010 with Modification Date of January 10, 2007 and Expiration Date of March 31, 2010. and -further direction of the Commonwealth of Virginia Department of Environmental Quality: 9. PLANNING COMMISSION SUMMARY & ACTION OF THE 09/19/07 MEETING: The applicant stated that a community meetingwas held and was well -attended; a conceptual site plan was presented and input received from adjoining residents. The applicant said community residents did not actually favor evergreen screening along Armel Road, but instead preferred to see deciduous trees and flowers to enhance the appearance of the property and to provide an open view of the property. In addition, the adjoining property owners requested that the proposed trail systems do not get too close to the perimeter of the property line for privacy and safety reasons. One adjoining property owner spoke during the public comment portion of the meeting and expressed concern about the constant influx of people attending daily events, Monday through Friday. She was concerned about the capacity of area roads to handle the traffic or if the area could handle the volume of people. CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 6 The applicant's consultant stated that the proposed program submitted with the application attempts to show the maximum possible use of their facilities. The consultant said they are totally constrained and will be operating under their DEQ permit, as well as the limitations on the water plant. He predicted that on the average, there will be 20 people per day. Commission members commented that considering the alternative, this property provides a significant contribution to green space conservation. The Commission unanimously recommended approval with the conditions provided by the staff and clarified in Staff s presentation, as follows: PLANNING COMMISSION RECOMMENDED CONDITIONS: 1. The maximum number .of guests allowed to use the facility at any one time shall be one hundred and sixty (160). 7. When required by the use of the facility, all federal, state, and local regulations applicable to public waterworks, wastewater disposal, and restaurant operation will be complied with at all times. 8. Following the required public hearing, a decision regarding this Conditional Use Permit application by the Board of Supervisors would be appropriate. This proposed submittal appears acceptable to VDOT. Further comments will follow at site plan review. Prior to operation of the business, a commercial entrance must be constructed to our standards to allow for safe egress and ingress of the property. Any work performed on the State's right-of-way must be covered under a land use permit. The permit is issued by this office and requires an inspection fee and surety bond coverage. Frederick County Fire Marshall: Plan approval recommended. Frederick County Inspections: Existing building shall comply with The Virginia Uniform Statewide Building Code, The International Existing Building Code and use group A (Assembly) and R (Residential), of the International Building Code/2003. Other Code that apply are ICC/ANSI A 177.1-03 Usable and Accessible Buildings and Facilities. Accessible route improvements shall comply with the IEBC 20% cost unless full compliance is met. Asbestos inspection shall be required prior to permit issuance for change of use permit for the renovations. Note: Elevations of the accessible route from the building required exits to the accessible parking is not shown in detail on the site plans submitted. Please submit detailed plans showing the accessible route and elevations at the time of permit application. Frederick County Public Works: Upon review of the site plan dated May 30, 2007, we offer no comments at this time. Therefore, we recommend our approval of the subject site plan. Since the project proposes the disturbance of more than 10,000 square feet, the proposed improvements will require a Land Disturbance Permit. VDH-Office of Drinking Water: If the system serves "at least 25 persons per day for at least 60 days out of the year" you would not have to submit plans to our office for the construction and you would not be required to have a waterworks permit. In the eyes of the regulations you would be a private system regulated similar to a private home and your well site would be approved by the Local Health Department. I would make the following suggestions: I would be glad to meet with you and approve any well sites which you may be planning to develop. Then I suggest so that if the system ever expands to fit the public definition the wells will already be in the system. I can give you a list of water quality development samples required of public systems. For safety and liability purposes I would suggest you run these samples although they are not required. After the system is in operation I suggest you take quarterly bacterlogical samples again for safety and liability purposes, although they are not required. If you have any food services in the future a permit for that operation will have to be obtained from Local Health Department. If a food permit is required they will work with you to set up a bacterlogical sampling program. 9 0 CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 3 Department of Environmental Quality: Please see the attached correspondence. Frederick -Winchester Health Department: The health department cannot comment favorably on the proposal as submitted. An antiquated, non -discharging lagoon is proposed to be used for sewage disposal. The possibility of contamination of groundwater is a concern. In addition, there is not guarantee that the current sewage disposal system will function properly given the proposed increase in water use and changes in wastewater quality. An Authorized Onsite Soil Evaluator could possibly locate an acceptable site for a sewage disposal system to accommodate the proposal. Public water and sewer, if approved by the Frederick County Sanitation Authority, could also be an option, if feasible. Based on the information provided in the submittal, a public water supply will be required. Contact the Office of Water Programs for information and permitting. A permit for a restaurant and/or a motel may be required and should be addressed when the site is submitted. Planning and Zoning: The proposed use is identified as a Spiritual Retreat Center in the application. Within the RA (Rural Areas) Zoning District this particular type of use has historically been classified within the following group, Section 165-51.0. Campgrounds, tourist camps, recreation areas and resorts. The most recent example of such a use being addressed as a Religious Retreat in this classification in Frederick County is God's Glory Land within the Back Creek District (CUP#01-94). The historical use of this property as monastery/friary, and later as a residence and care center for elderly friars, has not been in operation for a relatively long period of time (much greater than one year). Therefore, the property has not retained any level of legal nonconformity. Accordingly, the direction is to establish a use permitted with a CUP, a Spirituality Retreat Center. This is consistent with Section 165-51.0. of the Frederick County Zoning Ordinance. The Catholic Diocese of Arlington is proposing to use the former Franciscan Monastery as a spirituality center for reflection, worship, retreats, and diocesan meetings. The existing facility is located on a 150 acre site and includes a chapel with approximately 100 seats, a cafeteria, meeting rooms, library, sleeping rooms, and supporting areas. The Diocese also anticipates using the property for outdoor passive recreational trails such as nature and reflection trails. The Diocese projects that as many as 160 people may use the facility at any one time. However, such large scale gatherings would occur relatively infrequently. More frequently, the facility would be used for small retreats, some that may be for several nights, and for larger groups for daytime use. A limited number of resident staff (no more than 5) is anticipated. The proposed conditions accompanying this Conditional Use Permit are based upon the scope of the above use of the facility as provided by the CDA. A possible schedule of their use has been provided as part of their application. In addition, the proposed conditions address the current health system limitations of the property. • . r CUP #05-07, Spirituality Retreat Center October 1, 2007 Page 4 The scope of the use should be based around the existing building and the current health system limitations of the property. The responsible permitting agencies; the Virginia Department of Health — Office of Water Programs and the Department of Environmental Quality have been in consultation with the Catholic Diocese of Arlington and the County regarding the proposed use of this facility. In particular, the Department of Environmental Quality, who recently modified the facilities VPDES Permit (No. VA 0089010 with Modification Date of January 10, 2007 and Expiration Date of March 31, 2010) has evaluated the proposed use of the facility and expressed to staff that they foresee no reason why the CDA will not be able to operate within the parameters of their existing permit. The existing facility currently operates under a VPDES Permit and utilizes a zero discharge limit sewage lagoon. The permitted discharge to the lagoon is a rate of 1,600 gdp. Future options that may be available to the CDA include constructing an alternative waste water system on -site for their use that would meet current standards. The CDA has expressed a desire to ultimately connect to public water and sewer. However, this property falls well beyond the area in which public water and sewer is available by policy. The property is not located within the Urban Development Area or Sewer and Water Service Area. The Virginia Department of Health — Office of Drinking Water has outlined the qualifications for being classified as a public waterworks system that must have an Operations Permit issued by their Office. The CDA is aware of these requirements and have stated that they will not meet these minimum requirements. Should the CDA ultimately determine that they need to obtain an operations permit for a public waterworks system or improve their private water system, the Office of Drinking Water has offered several. suggestions to assist the CDA. Staff contacted the local Health Department regarding the requirements for needing a restaurant permit. Based upon the CDA's proposed approach to providing only off -site catering for larger groups and utilizing boxed lunches, light meals, and bottled water, it would appear as though a food or restaurant permit would not be required. This approach has resulted in the condition being proposed that only off -site catering will be allowed in conjunction with this conditional use permit. In general, the facility and site is well suited for the proposed use of a Spirituality Retreat Center. Several site improvements would be required to accommodate the proposed use including improved access to the site and an increase in the size of the parking area. A site development plan will be required to be completed prior to the use of this site. Staff has also suggested that the signage on the site be limited in order to maintain the character of the facility and to ensure that the facility continues to fit in with the surrounding neighborhood. An engineered site plan for the expansion of the parking area and access to the site shall be approved by Frederick County, and the improvements completed prior to starting this use. 3. No expansion of the existing building shall be permitted with this CUP. 4. The Resident Staff shall not exceed five (5) people living in the facility at any one time. 5. PLANNING COMMISSION SUMMARY & ACTION OF THE 09/19/07 MEETING: The applicant stated that a community meeting was held and was well -attended; a conceptual site plan was presented and input received from adjoining residents. The applicant said community residents did not actually favor evergreen screening along Armel Road, but instead preferred to see deciduous trees and flowers to enhance the appearance of the property and to provide an open view of the property. In addition, the adjoining property owners requested that the proposed trail systems do not get too close to the perimeter of the property line for privacy and safety reasons. One adjoining property owner spoke during the public comment portion of the meeting and expressed concern about the constant influx of people attending daily events, Monday through Friday. She was concerned about the capacity of area roads to handle the traffic or if the area could handle the volume of people. 0 CUP 405-07, Spirituality Retreat Center October 1, 2007 Page 6 The applicant's consultant stated that the proposed program submitted with the application attempts to show the maximum possible use of their facilities. The consultant said they are totally constrained and will be operating under their DEQ permit, as well as the limitations on the water plant. He predicted that on the average, there will be 20 people per day. Commission members commented that considering the alternative, this property provides a significant contribution to green space conservation. VPDES Permit No. VA0089010 requires the wastewater lagoon be operated and managed such that surface and groundwater water quality and uses are protected. The CDA Spirituality Center wastewater lagoon operates under a "no discharge" condition and is limited to an average influent flow of 1600 GPD, which corresponds to a lagoon liner permeability of 1X10-6 cm/sec as required by 9 VAC 25-790- 720. The most recent request for reissuance of this permit was received by DEQ on August 16, 2004. The owner also forwarded a copy of their request the Virginia Department of Health (VDH). The VDH replied to DEQ by memorandum dated August 19, 2004, noting no objection to the request. On February 8, 2005, DEQ developed a draft permit in response to the reissuance request. The draft permit was public noticed on February 22 and March 1, 2005 in the Winchester Star. Local government officials (County Administrator, County Board of Supervisors Chairman, and Planning District #7 Executive Director) were copied with the public notice on February 25, 2005, and invited to comment. DEQ did not receive any comments from local government or the public in response to the public notice. The draft permit was authorized by DEQ on March 29, 2005, and became effective on April 14, 2005. The permit includes all applicable limitations and requirements, and it is the responsibility of the owner to demonstrate compliance with the permit. DEQ currently has no reason to believe the Diocese is or will be unable to demonstrate compliance with this VPDES permit. The most recent DEQ inspection of the lagoon was completed on July 20, 2004. The inspection report notes the lagoon was in fair condition, and included several required actions (update lagoon observation log, maintain path to the lagoon outfall, clear lagoon berm of any brush, inspect lower level discharge valve) necessary to ensure the lagoon does not discharge and is properly maintained. On August 16, 8/20/2007 Page 2 of 2 2004, DEQ received notice from the permittee (Franciscan Friars, T.O.R.) that the required actions had been completed. The Spirituality Center will be used by priests, parishioners, diaconate aspirants, youth ministry, and other ministries. These uses will be for small retreats, some that may be for several nights; and for larger groups for daytime use. There will be no use by corporate or business groups. The use will be restricted to religious individuals and groups. Except for resident staff (not to exceed 5) there will be no occupancy exceeding 30 days, with the typical occupancy not exceeding one week and in most cases only a few days. A possible schedule of such use is attached as Exhibit A. The existing facilities are located on a 150 acre site located at 125 Old Kitchen Road and include a chapel with approximately 100 seats, a cafeteria, meeting rooms, library, sleeping rooms, administrative spaces, and supporting areas. The monastery opened in 1960 as a training facility for young priests with the Province of the Sacred Heart of Jesus, T.O.R. In 1972 it became home to the Franciscan Center for Spiritual Renewal, a part time retreat center, and in 1991 a residence and care center for elderly friars. The proposed use will be limited by the availability of water and sewer. The water plant and the sewage treatment facility is operating tinder a VPDES Permit that requires monitoring the water plant backwash discharge and sets a zero limit discharge for the sewage lagoon. The Permit estimated discharge to the sewage lagoon at an average rate of 1,600 GPD and effectively sets the limit on use of the Property. The operation of the water plant and the sewage facility will be strictly monitored by the facility manager to ensure the discharge limits are not exceeded. Scheduled events may be cancelled if the discharge limits are in danger of being exceeded. • 0 The CDA` Spirituality Center will operate year round (subject to the above discussed limits). The existing kitchen will be refurbished to provide for "lite" meals and for small groups with many events and large groups served by caterers. Some groups will be provided with "box" lunches. The proposed schedule of available facilities is attached as Exhibit A. While we project as many as 160 people in the facility at any one time, these events are not expected to last longer than about 7 hours, with most being of shorter duration. Note that weather permitting, we expect some individuals and small groups to experience the outdoors. The outdoor activities will be allowed to develop at a natural pace as the interest is such activities develops. We propose to start with broadly defined trails that we have called a Nature Trail and a Reflection Trail. We do not propose any structures on or along these trails. Some individuals may carry a portable stool or chair if they wish to stop along the way for reflection. The trails will be pervious materials with small (and low) markers. As these trails are become more used, low benches may be added. We propose to make limited renovations to some areas of the existing facility. We propose to provide fire sprinklers in all sleeping rooms and meeting rooms along with a smoke detector and alarm system through out. Maintenance and repairs will be accomplished where needed. In the future, say 5 —15 years we anticipate a more complete renovation and possible expansion of the facility. The availability of public water and sanitary sewer would accelerate the possible expansion. The "experienced" use of the Spirituality Center will also have a large input to any plans for expansion. This proposed submittal appears acceptable to VDOT. Further comments will follow at site plan review. Prior to operation of the business, a commercial entrance must be constructed to our standards to allow for safe egress and ingress of the property. Any work performed on the State's right-of-way must be covered under a land use permit. The permit is issued by this office and requires an inspection fee and surety bond coverage. Frederick County Fire Marshall: Plan approval recommended. Frederick County Inspections: Existing building shall comply with The Virginia Uniform Statewide Building Code, The International Existing Building Code and use group A (Assembly) and R (Residential), of the International Building Code/2003. Other Code that apply are ICC/ANSI A 177.1-03 Usable and Accessible Buildings and Facilities. Accessible route improvements shall comply with the IEBC 20% cost unless frill compliance is met. Asbestos inspection shall be required prior to permit issuance for change of use permit for the renovations. Note: Elevations of the accessible route from the building required exits to the accessible parking is not shown in detail on the site plans submitted. Please submit detailed plans showing the accessible route and elevations at the time of perinit application. Frederick County Public Works: Upon review of the site plan dated May 30, 2007, we offer no comments at this time. Therefore, we recommend our approval of the subject site plan. Since the project proposes the disturbance of more than 10,000 square feet, the proposed improvements will require a Land Disturbance Permit. VDH-Office of Drinking Water: If the system serves "at least 25 persons per day for at least 60 days out of the year" you would not have to submit plans to our office for the construction and you would not be required to have a waterworks permit. In the eyes of the regulations you would be a private system regulated similar to a private home and your well site would be approved by the Local Health Department. I would make the following suggestions: I would be glad to meet with you and approve any well sites which you may be planning to develop. Then I suggest so that if the system ever expands to fit the public definition the wells will already be in the system. I can give you a list of water quality development samples required of public systems. For safety and liability purposes I would suggest you run these samples although they are not required. After the system is in operation I suggest you take quarterly bacterlogical samples again for safety and liability purposes, although they are not required. If you have any food services in the future a permit for that operation will have to be obtained from Local Health Department. If a food permit is required they will work with you to set up a bacterlogical sampling program. CUP #05-07, Spirituality Retreat Center September 4, 2007 Page 3 Department of Environmental Quality: Please see the attached correspondence. Frederick -Winchester Health Department: The health department cannot comment favorably on the proposal as submitted. An antiquated, non -discharging lagoon is proposed to be used for sewage disposal. The possibility of contamination of groundwater is a concern. In addition, there is not guarantee that the current sewage disposal system will function properly given the proposed increase in water use and changes in wastewater quality. An Authorized Onsite Soil Evaluator could possibly locate an acceptable site for a sewage disposal system to accommodate the proposal. Public water and sewer, if approved by the Frederick County Sanitation Authority, could also be an option, if feasible. Based on the information provided in the submittal, a public water supply will be required. Contact the Office of Water Programs for information and permitting. A permit for a restaurant and/or a motel may be required and should be addressed when the site is submitted. Planninjz and Zoning: The proposed use is identified as a Spiritual Retreat Center in the application. Within the RA (Rural Areas) Zoning District this particular type of use has historically been classified within the following group, Section 165-51.0. Campgrounds, tourist camps, recreation areas and resorts. The most recent example of such a use being addressed as a Religious Retreat in this classification in Frederick County is God's Glory Land within the Back Creek District (CUP#01-94). The historical use of this property as monastery/friary, and later as a residence and care center for elderly friars, has not been in operation for a relatively long period of time (much greater than one year). Therefore, the property has not retained any level of legal nonconformity. Accordingly, the direction is to establish a use permitted with a CUP, a Spirituality Retreat Center. This is consistent with Section 165-51.0. of the Frederick County Zoning Ordinance. The Catholic Diocese of Arlington is proposing to use the former Franciscan Monastery as a spirituality center for reflection, worship, retreats, and diocesan meetings. The existing facility is located on a 150 acre site and includes a chapel with approximately 100 seats, a cafeteria, meeting rooms, library, sleeping rooms, and supporting areas. The Diocese also anticipates using the property for outdoor passive recreational trails such as nature and reflection trails. The Diocese projects that as many as 160 people may use the facility at any one time. However, such large scale gatherings would occur relatively infrequently. More frequently, the facility would be used for small retreats, some that may be for several nights, and for larger groups for daytime use. A limited number of resident staff (no more than 5) is anticipated. The proposed conditions accompanying this Conditional Use Permit are based upon the scope of the above use of the facility as provided by the CDA. A possible schedule of their use has been provided as part of their application. In addition, the proposed conditions address the current health system limitations of the property. CUP #05-07, Spirituality Retreat Center September 4, 2007 Page 4 The scope of the use should be based around the existing building and the current health system limitations of the property. The responsible permitting agencies; the Virginia Department of Health — Office of Water Programs and the Department of Environmental Quality have been in consultation with the Catholic Diocese of Arlington and the County regarding the proposed use of this facility. In particular, the Department of Environmental Quality, who recently modified the facilities VPDES Permit (No. VA 0089010 with Modification Date of January 10, 2007 and Expiration Date of March 31, 2010) has evaluated the proposed use of the facility and expressed to staff that they foresee no reason why the CDA will not be able to operate within the parameters of their existing permit. The existing facility currently operates under a VPDES Permit and utilizes a zero discharge limit sewage lagoon. The permitted discharge to the lagoon is a rate of 1,600 gdp. Future options that may be available to the CDA include constructing an alternative waste waster system on -site for their use that would meet current standards. The CDA has expressed a desire to ultimately connect to public water and sewer. However, this property falls well beyond the area in which public water and sewer is available by policy. The property is not located within the Urban Development Area or Sewer and Water Service Area. The Virginia Department of Health — Office of Drinking Water has outlined the qualifications for being classified as a public waterworks system that must have an Operations Permit issued by their Office. The CDA is aware of these requirements and have stated that they will not meet these minimum requirements. Should the CDA ultimately determine that they need to obtain an operations permit for a public waterworks system or improve their private water system; the Office of Drinking Water has offered several suggestions to assist the CDA. Staff contacted the local Health Department regarding the requirements for needing a restaurant permit. Based upon, the CDA's proposed approach to providing only off -site catering for larger groups and utilizing boxed lunches, light meals, and bottled water it would appear as though a food or restaurant permit would not be required. This approach has resulted in the condition being proposed that only off -site catering will be allowed in conjunction with this conditional use permit. In general, the facility and site is well suited for the proposed use of a Spirituality Retreat Center. Several site improvements would be required to accommodate the proposed use including improved access to the site and an increase in the size of the parking area. A site development plan will be required to be completed prior to the use of this site. Staff has also suggested that the signage on the site be limited in order to maintain the character of the facility and to ensure that the facility continues to fit in with the surrounding neighborhood. CUP 405-07, Spirituality Retreat Center September 4, 2007 Page 5 STAFF CONCLUSIONS FOR THE 09/19/07 PLANNING COMMISSION MEETING: Should the Planning Commission find this use appropriate, Staff would recommend the following conditions: l . All review agency comments shall be followed at all times. 2. An engineered site plan for the expansion of the parking area and access to the site shall be approved by Frederick County, and the improvements completed prior to starting this use. 3. No expansion of the existing building shall be permitted with this CUP. 4. The Resident Staff shall not exceed five (5) people living in the facility at any one time. 5. No transit user or guest will be permitted to stay longer than thirty (30) days. 6. The maximum number of guests allowed to use the facility at any one time shall be one hundred and sixty (160). 7. When required by the use of the facility, all federal, state, and local regulations applicable to public waterworks, wastewater disposal, and restaurant operation will be complied with at all times. 8: CDA will operate the facility to comply with VPDES Permit No. VA 0089010 with Modification Date of January 10, 2007 and Expiration Date of March 31, 2010 and further direction of the Commonwealth of Virginia Department of Environmental Quality. 9. Only off -site catering will be allowed in conjunction with this conditional use permit. 10. No more than one (1) entrance shall be permitted to access this property from Armel Road, Route 642. 11. Assuming you do not serve "at least 25 persons per day for at least 60 days out of the year" you would not have to summit plans to our office for the construction and you would not be required to have a waterworks permit. In the eyes of the regulations you would be a private system regulated similar to a private home and your well site would be approved by the Local Health Department. I would snake the following suggestions. I would be glad to meet with you and approve any well sites which you may be planning to develop. Then I suggest you develop the sites to the standards required for pubic water systems so that if the system ever expands to fit the public definition the wells will already be in the system. I can give you a list of water quality development samples required of public systems. For safety and liability purposes I would suggest you run these samples although they are not required. Diocese of Arlington The Catholic Diocese of Arlington proposes to use the former Franciscan Monastery in White Post, Virginia as the Diocese's new Spirituality Center — a facility for reflection, worship, retreats, and diocesan meetings. The Spirituality Center will be used by priests, parishioners, diaconate aspirants, youth ministry, and other ministries. These uses will be for small retreats, some that may be for several nights; and for larger groups for daytime use. There will be no use by corporate or business groups — use will be restricted to use by religious individuals and groups. Except for resident staff (not to exceed 5) there will be no occupancy exceeding 30 days, with the typical occupancy not exceeding one week and in most cases only a few days. A possible schedule of such use is attached as Exhibit A. The existing facilities are sited on a 150 acre site located at 125 Old Kitchen Road and includes a chapel with approximately 90 seats, a cafeteria, meeting rooms, library, sleeping rooms, administrative spaces, and supporting areas. The monastery opened in 1960 as a training facility for young priests with the Province of the Sacred Heart of Jesus, T.O.R. In 1972 it became home to the Franciscan Center for Spiritual Renewal, a part time retreat center, and in 1991 a residence and care center for elderly friars. The proposed use will be limited by the availability of water and sewer. The water plant and the sewage treatment facility is operating under a VPDES Permit that requires monitoring the water plant backwash discharge and sets a zero limit discharge for the sewage lagoon. The Permit estimated discharge to the sewage lagoon at an average rate of 1,600 GPD and effectively sets the limit on use of the Property. The. operation of the water plant and the sewage facility will be strictly monitored by the facility manager to ensure the discharge limits are not exceeded. Scheduled events may be cancelled if the discharge limits are in danger of being exceeded. The CDA Spirituality Center will operate year round (subject to the above discussed limits). The existing kitchen will be refurbished to provide for "lite" meals and for small groups with many events and large groups served by caterers. Some daytime groups may be provided with "box" lunches. The proposed schedule of available facilities is attached as Exhibit A. While we project as many as 160 people in the facility at any one time, these events are not expected to last longer than about 7 hours, with most being of shorter duration. Note that weather permitting, we expect some individuals and small groups to experience the outdoors. The outdoor activities will be allowed to develop at'a natural pace as the interest is such activities develops. We propose to start with broadly defined trails that we have called a Nature Trail and a Reflection Trail. We do not propose any structures on or along these trails. Some individuals may carry a portable stool or chair if they wish to stop along the way for reflection. The trails will be pervious materials with small (and low) markers. As these trails are become more used, low benches may be added. We propose to make limited renovations to some areas of the existing facilities. We propose to provide fire sprinklers in all sleeping rooms and meeting rooms along with a smoke detector and alarm system through out. Maintenance and repairs will be accomplished where needed. In the future, say 10 —15 years we anticipate a more complete renovation and possible expansion of the facilities. The availability of public water and sanitary sewer would accelerate the possible expansion. The "experienced" use of the Spirituality Center will also have a large input to any plans for expansion. VPDES Permit No. VA0089010 requires the wastewater lagoon be operated and managed such that surface and groundwater water quality and uses are protected. The CDA Spirituality Center wastewater lagoon operates under a "no discharge" condition and is limited to an average influent flow of 1600 GPD, which corresponds to a lagoon liner permeability of 1X10-6 cm/sec as required by 9 VAC 25-790- 720. The most recent request for reissuance of this permit was received by DEQ on August 16, 2004. The owner also forwarded a copy of their request the Virginia Department of Health (VDH). The VDH replied to DEQ by memorandum dated August 19, 2004, noting no objection to the request. On February 8, 2005, DEQ developed a draft permit in response to the reissuance request. The draft permit was public noticed on February 22 and March 1, 2005 in the Winchester Star. Local government officials (County Administrator, County Board of Supervisors Chainnan, and Planing District #7 Executive Director) were copied with the public notice on February 25, 2005, and invited to comment. DEQ did not receive any comments from local government or the public in response to the public notice. The draft permit was authorized by DEQ on March 29, 2005, and became effective on April 14, 2005. The permit includes all applicable limitations and requirements, and it is the responsibility of the owner to demonstrate compliance with the permit. DEQ currently has no reason to believe the Diocese is or will be unable to demonstrate compliance with this VPDES permit. The most recent DEQ inspection of the lagoon was completed on July 20, 2004. The inspection report notes the lagoon was in fair condition, and included several required actions (update lagoon observation log, maintain path to the lagoon outfall, clear lagoon berm of any brush, inspect lower level discharge valve) necessary to ensure the lagoon does not discharge and is properly maintained. Significant lowering of the water quality of Tier 2 waters is not allowed without an evaluation of the economic and social impacts. Tier 3 water bodies are exceptional waters and are so designated by regulatory amendment. The antidegradation policy prohibits new or expanded discharges into exceptional waters. The antidegradation review begins with a Tier determination. The Franciscan Friars, T.O.R. discharges to an intermittent unnamed tributary (U.T.) of Opequon Creek via Outfall 002. The receiving stream is classified as Tier 1 because there is no stream flow at the discharge point during drought conditions. The U.T. flows into a segment of Opequon Creek, which is also classified as Tier 1. Opequon Creek is listed as impaired for fecal coliform and the General Standard (Benthic) in the currently approved 303(d) TMDL Priority List. Waste load allocations were calculated and permit limits set such that WQS's are maintained at all points downstream of the discharge. f Fact Sheet — V1 "ES Permit No. VA0089010 — Franciscan Friars, T.O.R. 21. Sewage Sludge Use or Disposal: A Sludge Management Plan (SMP) was submitted and approved as part of the previous permit application. The facility septic tank is periodically pumped and solids received by the lagoon are very low due to the low influent flow. As such, No sludge has needed to be removed and can be adequately stored in the lagoon. The SMP will be revised and submitted for approval once the most cost effective way to remove the sludge is determined and the facility actually needs to remove the sludge. There are no proposed changes to the approved SMP at this reissuance. 22. NPDES Permit Rating Worksheet: See ATTACHMENT F Total Score: 70 Classification: Minor In accordance with Department guidance, the NPDES Permit Rating Worksheet was completed for the water softener and iron removal backwash water discharge (Outfall 002), and this discharge is classified as "industrial Minor". NOTE: The facility is classified as "Municipal Minor" because the primary source of wastewater generated at the site is sanitary wastewater (Outfall 001). 23. Material Storage: On -site storage of material shall be addressed in the Operations and Maintenance Manual and maintained onsite by the permittee. These documents describe procedures and practices that provide adequate measures taken to prevent stored material from reaching state waters. Per the permit requirements of the permit, a revised Operations and Maintenance Manual addressing this requirement shall be submitted for approval by the Department. 24. 303(d) List Considerations: This facility will discharge to a stream segment listed in the currently approved 303(d) list. The receiving section of Opequon Creek is listed for non - attainment of bacteria and TSS in the currently approved 303(d) TMDL Priority List. The facility is currently assigned a TMDL wasteload allocation of 10 kg/yr for TSS. This is based on a flow of 241 GPD and TSS concentration of 30 mg/L for Outfall 002. 25. Variances/Alternate Limits or Conditions: None 26. Application Testing Waiver: The applicant requested waivers from "the sampling and testing requirements in the application forms." Their justification for the waiver "is the very minor nature of the Franciscan Friar operation [and] it is impractical and uneconomical for [them] to conduct effluent sampling and testing." Because Outfall 001 does not result in a discharge to waters of the US there are no sampling requirements included in the application Form 2A. Form 2C contains sampling requirements for Outfall 002. Parameters to be sampled include: BOD, COD, TOC, TSS, NH3, Flow, Temperature (Winter and Summer), and pH. The applicant did provide data for TSS, Flow, and pH. The applicant was previously granted a waiver from sampling for BOD, COD, TOC, NH3, and Temperature for Outfall 002 and is also not required by the existing permit to monitor for these parameters. Therefore, the waiver request is deemed acceptable for BOD, COD, TOC, NH3, and Temperature. The applicant, must also include data for any items listed in Part V.B. that are believed present in the discharge. Because the discharge results from the operation of a water treatment system, which utilizes manganese green sand filters, the applicant must provide sample data for manganese, iron, and color. Because there has been no change to the system, this data will be carried forward at this reissuance. Per the VPDES Permit Manual, page IN-175 (Water Treatment Plants) the applicant must also submit data for Cadmium, Chromium, Copper, Lead, Mercury, and Zinc. These parameters have not previously been sampled and the applicant did not provide sample data for these parameters at this reissuance. As a result, the applicant will be required to sample for these parameters as a requirement of the reissued permit. 27. Regulation of Users required by 9 VAC 25-31-280.B.9: There are no industrial users contributing to the treatment works. 28. Storm Water Management: VPDES Permit Regulation, 9 VAC 25-31-10 defines discharges of storm water from municipal treatment plants with design flow of 1.0 MGD or more, or plants with approved pretreatment programs, as discharges of storm water associated with industrial activity. 9 VAC 25-31-120 requires a permit for these discharges. Stonnwater from the Franciscan Friars T.O.R. WTP does not require monitoring or limitation based on the SIC Code and narrative portion of the stormwater regulation. Therefore, this facility is not required to have a storm water discharge permit or No Exposure Certification. If conditions change at the facility, and any industrial materials or activities become exposed to storm water, coverage under a VPDES permit may be required prior to any point source discharge of storm water from the facility. 29. The receiving stream is further described in the TMDL Information Figure and the Water Quality Assessments TMDL Review table included in this attachment. Flow: Stream flow estimates for Opequon Creek above its confluence with the Opequon Creek, U.T. were provided by memo from Eric Aschenbach on November 15, 2004. The Opequon Creek, U.T. was determined to be intermittent. As a result, all of the critical flow values for this portion of the receiving stream were reported as 0.0 cfs. Critical dry and wet season flow values for Opequon Creek are as reported in the attached Flow Frequency Determination Memo. pH: pH values were obtained from observations performed by DEQ WQMP on Opequon Creek (Station ID 1AOPE036.13) at river mile 36.13. The 90tn percentile annual pH was determined to be 8.5 S.U., while the 10u` percentile annual pH was 7.8 S.U. Temperature: Ambient stream temperatures were obtained from observations performed by DEQ WQMP on Opequon Creek (Station ID 1AOPE036.13) at river mile 36.13. The 90" percentile annual temperature was determined to be 21.9 °C and the 9e percentile wet season (December through May) temperature was 15.7 'C. Hardness: The average hardness value was obtained from observations performed by DEQ WQMP on Opequon Creek (Station ID 1AOPE036.13) at river mile 36.13. The average hardness was found to be 234 mg/L CaCO3. Ammonia-N: Not evaluated since ammonia-N is not a parameter of concern for this discharge. Mixing Zone Analyses: The effluent generates the only available stream flow, resulting in a 100% mixing condition at all critical flows. The perennial point is located on Opequon Creek. The VDEQ operated a continuous record gage on Opequon Creek near Berryville, Virginia (#01615000) from 1943-1997. The gage is located downstream of the perennial point at the Route 7 bridge in Frederick County, Virginia. In July 1988, approximately 1000 feet upstream of the gage, the 6.0 MGD Opequon Wastewater Reclamation Facility began discharging to Opequon Creek. Therefore, the flow frequencies for the reference gage are based only on the period of record from 1943 to 1988. Since the Parkins Mill STP did not begin discharging to Opequon Creek until about September 1989, its flow did not impact the gage during the selected period of record. In addition, the flow from Parkins Mill STP (located upstream) was not added to these flow frequencies. The flow frequencies for the gage and the perennial point are presented below. The values at the perennial point were determined by drainage area proportions and do not address any other discharges, withdrawals, or springs located between the gage and the perennial point. ATTACHMENT E EVALUATION OF POLLUTANTS 1. Outfall 001 to Facultative Lagoon All wastewater generated at the Franciscan Friars, T.O.R.., with the exception of the WTP backwash wastewater, is conveyed to a facultative lagoon. There is no discharge from the lagoon. The following information is carried forward from the previous two fact sheets and was originally taken from the lagoon construction plan sheet: 1) The lagoon is round with a bottom diameter of 126 FT (12,500 FT'). 2) The lagoon berm is 7 FT above the lagoon bottom. 3) Normal design operating depth is 4 FT (diameter =150 FT; surface area=17,500 FT 2; volume = 60,000 FT3). At the proposed design flow (1600 GPD) the hydraulic retention time is 280 days. 4) No liner was installed at the time of construction. 5) The lagoon is fed via a terra cotta sewer. 6) Assuming the lagoon permeability is 10-6 cm/sec, the allowable leakage rate at 4 FT depth is 1600 GPD (See attached calculation). In order to protect groundwater quality and prevent inadequately treated surface discharges, the previous VPDES permit for this facility was drafted with the following conditions: 1) There will be no discharge from the lagoon except for allowable permeability through the lagoon bottom at a rate not to exceed 10-6 cm/sec. 2) Thresholds above which an application must be submitted for permit modification to add final discharge limits include: a. Lagoon water depth greater than 5 FT or, b. Monthly average influent flow is greater than 95% of 1600 GPD for three consecutive months 3) The permittee shall maintain monthly logs on the lagoon influent flow, rainfall, and lagoon conditions (depth, animal damage, surface condition). Toxic Pollutants: There is no new available toxics data for evaluation at this reissuance. However, specific metals data is required for submission within one year of the permit reissuance. Water Quality Standards (WQSs) and Waste Load Allocations (WLAs) were calculated for these parameters. The WQSs and WLAs are presented in Attachment D. The metals data will be screened for applicable permit limits using STAT.EXE and the calculated WLAs upon submission. If the permittee monitors any pollutant specifically addressed by this permit more frequently than required by this permit using test procedures approved under Title 40 of the Code of Federal Regulalions Part 136 or using other test procedures approved by the U.S. Environmental Protection Agency or using procedures specified in this permit, the results of this monitoring, shall be included in the calculation and reporting of the data submitted in the DMR or reporting form specified by the Department. 4. Calculations for all limitations which require averaging of measurements shall utilize an arithmetic mean unless otherwise specified in this permit. D. Duty to Provide Information The permittee shall furnish to the Department, within a reasonable time, any information which the Board may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit or to determine compliance with this permit. The Board may require the permittee to .furnish, upon request, such plans, specifications, and other pertinent information as may be necessary to determine the effect of the wastes from his discharge on the quality of State waters, or such other information as may be necessary to accomplish the purposes of the State Water Control Law. The permittee shall also furnish to the Department upon request, copies of records required to be kept by this permit. E. Compliance Schedule Reports Reports of compliance or noncompliance with, or any progress reports on, interim and final requirements contained in any compliance schedule of this permit shall be submitted no later than 14 days following each schedule date. F. Unauthorized Discharges Except in with this permit, or another permit issued by the Board, it shall be unlawful for any person to: 1. Discharge into State waters sewage, industrial wastes, other wastes, or any noxious or deleterious -substances; or 2.. Otherwise alter the physical, chemical or biological properties of such State waters and make them detrimental to the public health, or to animal or aquatic life, or to the use of such waters for domestic or industrial consumption, or for recreation, or for other uses. Reports of Unauthorized Discharges Any permittee who discharges or causes or allows a discharge of sewage, industrial waste, other wastes or any noxious or deleterious substance into or upon State waters in violation of Part II.F.; or who discharges or causes or allows a discharge that may reasonably be expected to enter State waters r -ut No. VA0089010 art I Page 3 of 7 B. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS - ADDITIONAL INSTRUCTIONS 1. Daily Maximum -- Compliance with the daily maximum limitations and/or reporting requirements for the parameters listed in Part I.B.1. above shall be determined as follows: The highest single value of data that is equal to or above the test method QL shall be reported on the DMR and used to calculate the loading value reported on the DMR (if applicable). If all data are less than the method QL, then "<QL" shall be reported on the DMR for the concentration and/or loading values. Any single datum required shall be reported as "<QL" if it is less than the test method QL. Otherwise, the numerical value shall be reported. d. Monitoring results reported on the Discharge Monitoring Report (DMR) shall be reported to the accuracy of the, test, which'must be capable of at least the same number of significant digits as the permit limit for the given parameter. Rounding - the results to the number of significant digits in the permit, where the test method is sensitive enough to report more, is not acceptable. If there is not a method allowed by the permit that is accurate enough to measure two significant digits below the value of 1.0, it shall be the permittee's responsibility to provide documentation for DEQ approval demonstrating that only one significant figure can accurately be reported. The period of noncompliance, including exact dates and times, and if the noncompliance has no een-correctedthe-antioip-atedtiinz4t-is-expected�o-continue; and c. Steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance. The Board may waive the written report on a case -by -case basis for reports of noncompliance under Part II.I. if the oral report has been received within 24 hours and no adverse impact on State waters has been reported. ' 3. The permittee shall report all instances of noncompliance not reported under Parts 11.I.1. or 2., in writing, at the time the next monitoring reports are submitted. The reports shall contain the information listed in Part II.I.2. NOTE: The immediate (within 24 hours) reports required in Parts II.G, H, and I may be made to the Department's Valley Regional Office at (540) 574-7800 (voice) or (540) 574-7878 (fax). For reports outside normal working hours, leave a message and this shall fulfill the immediate reporting requirement. For emergencies, the Virginia Department of Emergency Services maintains a 24- hour telephone service at 1-800-468-8892. J. Notice of Planned Changes 1. The permittee shall give notice to the Department as soon as possible of any planned physical alterations or additions to the permitted facility. Notice is required only when: . a. The permittee plans alteration or addition to any building, structure, facility, or installation from which there is or may be a discharge of pollutants, the construction of which commenced: (1) After promulgation of standards of performance under Section 306 of the Clean Water Act which are applicable to such source; or (2) After proposal of standards of performance in accordance with Section 306 of the Clean Water Act which are applicable to such source, but only if the standards are promulgated in accordance with Section 306 within 120 days of their proposal; b. The alteration or addition could significantly change the nature or increase the quantity of pollutants discharged. This notification applies to pollutants which are subject neither to effluent limitations nor to notification requirements specified elsewhere.in this permit; or c. The alteration or addition results in a significant change in the permittee's sludge use or disposal practices, and such alteration, addition, or change may justify the application of permit conditions that are different from or absent in the existing permit, including far'IllIt No. Page 5 of 7 VA0089010 4. Operations and Maintenance (O&M) Manual Requirement -- The permittee shall maintain a current and approved O&M Manual for the treatment works. This manual shall detail the practices and. procedures which will be followed to ensure compliance with the requirements of this permit. This manual shall include, but not necessarily be limited to, the following items: a. Treatment works design, treatment works operation, routine preventative maintenance of units within the treatment system, critical spare parts inventory and record keeping; b. Techniques to be employed in the collection, preservation and analysis of effluent samples; C. Procedures for handling, storing, and disposing of all wastes, fluids, and pollutants characterized in Part I.C.3 that will prevent these materials from reaching state waters. The permittee shall operate the treatment works in accordance with the approved O&M Manual. Any changes in the practices and procedures followed by the permittee shall be documented and submitted for staff approval within 90 days of the effective date of the changes. Upon approval of the submitted manual changes, the revised manual becomes an enforceable part of the permit. 5. CTC / CTO Requirement-- The permittee shall, in accordance with the DEQ Sewage Collection and Treatment Regulation (9 VAC 25-790), obtain a Certificate to Construct (CTC) and a Certificate to Operate (CTO) prior to constructing and operating the wastewater treatment works. Noncompliance with the CTC or CTO shall be deemed a violation of the permit. 6. Sludge Reopener -- This permit.may be modified or, alternatively, revoked and reissued if any applicable standard for sewage sludge use or disposal promulgated under Section 405(d) of the Clean Water Act is more stringent than any requirements for sludge use or disposal in this permit, or controls a pollutant or practice not limited in this permit. 7. SMP Requirement -- The permittee shall conduct all sewage sludge use or disposal activities in accordance with the Sludge Management Plan (SMP) approved with the issuance of this permit. Any proposed changes in the sewage sludge use or disposal practices or procedures followed by the permittee shall be documented and submitted for IDEQ approval 90 days prior to the effective date of the changes. Upon approval, the SMP becomes an enforceable part of the permit. This permit may be modified or, alternatively, revoked and reissued to incorporate limitations/conditions necessitated by substantive changes in sewage sludge use or disposal practices. If an authorization under Part II.K.2. is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, a new authorization satisfying the requirements of Part II.K.2. shall be submitted to the Department prior to or together with any reports, or information to be signed by an authorized representative. —�1 Certification: A-ny-personsigning-"oeument-underb shal-l-make the following certification: "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations." L. Duty to Comply The permittee shall comply with all conditions of this permit: Any permit noncompliance constitutes a violation of the State Water Control Law and the Clean Water Act, except that noncompliance with certain provisions of this permit may constitute a violation of the State Water Control Law but not the Clean Water Act. Permit noncompliance is grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or denial of a permit renewal application. The permittee shall comply with effluent standards or prohibitions established under Section 307(a) of the Clean Water.Act for toxic pollutants and with standards for sewage sludge use or disposal established under Section 405(d) of the Clean Water Act within the time provided in the regulations that establish these standards orprohibitions or standards for sewage sludge use or disposal, even if this permit has not yet been modified to incorporate the requirement. M. Duty to Reapply If the permittee wishes to continue an activity regulated by this permit after the expiration date of this permit, the permittee shall apply for and obtain a new permit. All permittees with a currently . effective permit shall submit a new application at least 180 days before the expiration date of the existing permit, unless permission for a later date has been granted by the Board. The Board shall not grant permission for applications to be submitted later than the expiration date of the existing permit. N. Effect of a Permit This permit does not convey any property rights in either real or personal property or any exclusive privileges, nor does it authorize any injury to private property or invasion of personal rights, or any infringement of Federal, State or local law or regulations. O. State Law Nothing in this permit shall be construed to preclude the institution of any legal action under, or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any other State law or regulation or under authority preserved by Section 510 of the Clean Water Act. �1i...i No. VA0089010 art I Page 7 of 7 b. .That any activity has occurred or will occur which would result in any discharge, on a non -routine or infrequent basis, of a toxic pollutant which is not limited in this permit, if that discharge will exceed the highest of the following notification levels: (1) 500 µg/L; (2) 1 mg/L for antimony; (3) Ten times the maximum concentration value reported for that pollutant in the permit application; or (4) The level established by the Board. This condition is not satisfied if adequate back-up equipment should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance; and (3) The permittee submitted notices as. required under Part II.U.2. b. The Board may approve an anticipated bypass, after considering its adverse effects, if the Board determines that it will meet the three conditions listed above in Part II.U.3.a. V. Upset 1. An upset constitutes an affirmative defense to an action brought for. noncompliance with technology based permit effluent limitations if the requirements of Part II.V.2. are met. A determination made during administrative review of claims that noncompliance was caused by upset, and before an action for noncompliance, is not a final administrative action subject to judicial review. 2. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through properly signed, contemporaneous operating logs, or other relevant evidence that: a. An upset occurred and that the permittee can identify the cause(s) of the upset; b. The permitted facility was at the time being properly operated; c. The permittee submitted notice of the upset as required in Part ILL; and d. If you wish to continue operating a sewage treatment facility, you will need to apply for a VPDES permit, which carries the following requirements: 1. A permit fee of $1,400 - $2,000 every five years (depending on the size of your facility), 2.
