REVIEW EVALUATIONS:
Virginia Department of Transportation: No objection to a conditional use
permit for this property. However, prior to operation of business a commercial
entrance must be constructed to our minimum standards to allow for safe egress
and ingress of the property. Any work performed on the State's right-of-way must
be covered under a land use permit. The permit is issued by this office and
requires an inspection fee and surety bond coverage.
Inspections Department: Building shall comply with Virginia Uniform Statewide
Building Code and Section 304, Use Group B (Business) of the BOCA National
Building Code 1993. Other codes that apply are Title 24 Code of Federal

Regulation, Part 36 Nondiscrimination on the Basis of Disability by Public
Accommodations and in Commercial Facilities. Need to show ADA parking and
access to the building (min. one van accessible ADA parking space).
Fire Marshal: Access to buildings must be maintained at all times. This
structure would create no greater fire hazard potential than a large single family
dwelling. Approval of this CUP will not significantly impact fire and rescue
resources.
Health Department: Adequate public water and sewer must be provided for the
new facility.
Winchester Regional Airport: See Attached letter dated May 25, 1995
Sanitation Authority: Water and Sewer are available. See attached Drawings.
Planning Department: In the most recent change to the zoning ordinance,
Veterinary Offices, Veterinary Clinics or Veterinary Hospitals, excluding the
boarding of animals for non -medical purposes, is permitted with an approved
conditional use permit. The proposed site in this application is a very good one
because of the frontage on a collector road (Aylor Road, Route 647) and the
size of the property which provides enough area to install the necessary features
such as parking, screening and some buffering. By ordinance, a business sign of
the type needed for this use is not permitted. Staff believes it would be
inappropriate to approve a business use and not permit a business sign for that
use. The Commission will need to address this issue and it is suggested that a
sign be allowed as part of the permit process and this would allow tight control
on the size, height and location of the sign. Staff will address this issue with an
ordinance amendment if the Commission desires. In this case, a monument type
sign not to exceed 6 feet in height and a surface area not to exceed 20 square
feet is recommended. This was discussed with the applicant and he suggested
the 20 square foot figure as being adequate for his needs.

More detailed study will be required to determine parking requirements,
screening requirements and location and other feature requirements. This will
be done during the site plan process.
The existing house on the property will become accessory to the business if this
permit is approved. RP Zoning only permits accessory dwellings if attached to
the primary residence, however, one accessory dwelling shall be allowed with any
business so long as it is occupied by the owner of the business, an employee or
a watchman. In staffs opinion, if this permit is approved, the business is the
allowed primary use on the property, and the existing house would need to meet
the requirement of housing only the owner, an employee or a watchman.
STAFF RECOMMENDATION FOR JULY 5, 1995: Approval with the following conditions:
1. A site plan must be submitted and approved.
2. A business sign of a monument type not exceeding 6 feet in height and a
maximum of 20 square feet will be allowed.
3. The use shall have a full screen to protect adjoining residential areas. Location
and extent of screening to be determined by staff during site plan process.
4. Any proposed expansion beyond that approved on the original site plan will
require a new conditional, use permit and a revised site plan.
5. The proposed clinic or hospital must be connected to public sewer and water.
6. Compliance with all review agency comments must be completed prior to
beginning operation.
7. Only animals required to be hospitalized for medical reasons shall be allowed
to remain on premises overnight.
8. Animals recovering at the facility will only be permitted in the outside area for
brief exercise periods.
9. Continuously barking dogs or other noises that may disturb the surrounding
residential areas shall not be permitted.

SUMMARY OF 7/5/95 PLANNING COMMISSION ACTION: Two residents from
Fredericktowne and the general area of the proposed use appeared in opposition to this
request. One adjoining resident submitted a letter in opposition to the request. One resident
who appeared presented a petition with 11 signatures in opposition to the request. The major
reasons given for the opposition was increased traffic, noise, odors, degradation of property
values and the possibility of additional animals running loose in the neighborhood. Five people
appeared and spoke in favor of the request being approved. The Commission thoroughly
questioned all facets of the intended operation and were satisfied that all appropriate
precautions are being taken to protect the surrounding residents. They based part of their
decision on the fact that there are similar operations near residential areas and there has never
been a complaint or problem with those operations. They reasoned further that the required
screening and buffering, plus the conditions of the permit, will adequately protect the
residential area from any significant impact.
The Commission unanimously recommends approval of this request with the following
conditions: (Wilson & Light were absent)

2. A business sign of the monument type not exceeding 6 feet in height and a
maximum of 20 square feet will be allowed.
3. The use shall have a full screen to protect residential areas. Location and extent

to this request and the Board voted to approve this Conditional Use Permit with the following

Dear Mr. Miller,
I regret a prior engagement has enable us from attending the public hearing that will be held
July 5, 1995 regarding Conditional Use Permit #006795 property location: (689 Aylor Road)
(Route 647).
As property owners of the adjoining land parcel to the proposed site of the veterinary hospital
(100 Westmoreland Drive) we feel that allowing the facility to open would cause a great
disruption to the community as well as our parents who occupy the dwelling.
By allowing this proposal to pass we will have increased traffic noise and other noise pollution,
such as barking dogs and other animals that reside in the hospital. And the possible health hazards
that accompany such a facility such as a sick animal getting lose and the disposal of medical
waste, etc.
Our parents chose to move to 100 Westmoreland Drive 2 years ago to separate themselves from
the noise and congestion of the city. We do not wish to see this nice, peaceful and safe community
be disrupted. Therefore, we totally oppose this Conditional Use Permit 100 %! ! ! !

My name is John Lock and I apologize that I am unable to
attend this important meeting. Due to the Vacation Bible School
for the churches that I pastor, I was previously committed.
To get straight to the point of concern, I wholeheartedly
support Bruce Welch's request for a facility at Aylor Road. I
have known Bruce for numerous, years and have always had the
utmost respect for his character and hard work ethics. His
honesty is above reproach and he has always been caring and
friendly to myself and my family. I have no d'oubt that his
business will also be one of caring practices, not only to his
patrons but also to the community in which he will serve and
live.
I have lived in the Pines for 8 years and have seen much
growth all around my neighborhood. I honestly feel that Bruce's
practice will in no way affect adversely any areas of the
neighborhood, including traffic or surrounding neighbors. I would
welcome Bruce's practice next door to my property if it was the
case, because I realize that most of the proposed problems or
concerns that I have heard mentioned seem no more a problem than
the ones I contend with everyday in my neighborhood presently..
In closing, I cannot speak enough about the superior
character of Mr. Bruce Welch. I know that his morals and keen
respect for nature make his business valuable to the neighborhood.
