The existing sign foundation cannot be used unless VDOT receives, through a copy of the survey, verification that says foundation is not within the right -of --way. Winchester Regional Airport: Based on the above description and height specifications, the airport finds no impact on airspace. Planning and Zoning: Off -premise business signs are allowed with an approved conditional use permit in this zoning district. The sign will be restricted to a maximum of 100 square feet in size and 35 feet in height. If approved, the sign must be at least 10 feet from any property line or road right-of-way. The sign must be at least 50 feet from any other business sign. Staff Recommendation for 3/5/97: Staff recommends approval with the following conditions: 1. If the business being advertised ceases, the sign must be removed. 2. Review agency comments must be complied with. PLANNING COMMISSION SUMMARY & ACTION OF 03/05/97: Members of the Commission asked if the sign would be lighted and the applicant stated that it would not. There were no other areas of concern raised by the Commission. There were no public comments. The Commission unanimously recommended approval of the conditional use permit with the same two conditions as recommended by the staff. (Mr. Ours and Mr. Stone were absent.) I was at your office in April of 1992 along with my mother to de -aver informaticn requested of me by your department. We met with a young man (I do not remember his name)who was well dressed and had a beard and he had just started working with the planning and commission office.. An anonymous call had been made to your department about our business being run in a residential neighborhood , it is zoned agricultural. I had to provide your department with proof of a prior business being located there. I provided this Iran with pictures of my grandfathers trucking company, tax forms, letters from everyone in the neighborhood ect..., all of which were never returned. My grandfathers trucking company was "?uffinberger Trucking" On the morning I delivered this informaticn I was told that our business could remain there because we were grandfathered in. I assumed that my information would be returned to me and it never was. Considering the fact that we had never been through this before I was taking th=s man's word fcr it not realizing we should have been issued a card. We have not heard any further on this matter so we considered it was taken care of and over with. We have also applied and received two building per^_ts for this location under our business name.
