REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to a conditional use permit for this
property. However, prior to operation of the business, a commercial entrance must be
constructed to our minimum standards to allow for safe egress and ingress of the property.
Any work performed on the state's right-of-ways must be covered by a land use permit. This
permit is issued by this office and requires an inspection fee and surety bond coverage. The
northernmost entrance should be permanently closed due to lack of sight distance to the
south.
Inspections Department: Building shall comply with Virginia Uniform Statewide Building
Code and Section 306, Use Group F (Factory) of the BOCA National Building Code/l993.
Other codes that apply are Title 24 Code of Federal Regulation, Part 36 Nondiscrimination
on the Basis of Disability by Public Accommodations and in Commercial Facilities.
Minimum plumbing shall be provided as required in the BOCA National Plumbing Code.

use. A certificate of use and occupancy for the new use group shall be obtained before
operation of the bakery.
Fire Marshal: No comments.
Health Department: Health Department cannot comment favorably'on this proposal at this
time because no record has been found or provided for a sewage disposal system serving the
facility. The owner cannot verify that a septic tank and drain field serves the existing store
proposed for a bakery.
Planning and Zoning: The requested use can be permitted with an approved conditional
use permit. This would be classified as a cottage occupation since the planned activity would
be in an accessory building. The VDOT requirement for a commercial entrance is somewhat
of an overkill if there will be no retail sales as stated by the applicant. Staff concurs with the
VDOT suggestionthat the northern entrance be eliminated because of the poor sight distance
to the south. If there are going to be deliveries made to the location and/or if customers will
be coming to the location for services, the VDOT commercial entrance requirements should
be enforced. The Health Department was unable to determine if a suitable septic system was
available to service the property. Since the owners' residence is adjacent to the building
being planned for the use and if there are no employees, bathroom facilities in the residence
could be utilized and meet the need. The major problem with the lack of a health system
would be facilities to serve the use. There would certainly be need for water and, therefore,
a need for a suitable disposal system to accommodate this use. The applicant will need to
address this issue and provide whatever system or facilities required by the Health
Department.
STAFF RECOMMENDATION FOR 12/4/96 PC MEETING: Staff recommends approval of
this request with the following conditions:
1. All review agency comments must be complied with at all times.
2. The northern entrance to the facility planned for the use will be eliminated.
3. If deliveries are going to be made to the property and/or customers coming to the location,
a commercial entrance must be installed per the VDOT requirement.
4. Prior to beginning this use, Health Department inspection and approval shall be required.
5. If required for the use, proper facilities to handle waste water must be constructed.

SUMMARY OF 12-4-96 PLANNING COMMISSION ACTION: Mr. Light asked for
clarification of the requirement for a commercial entrance. Mr. Miller replied that as long as the
applicants are using their own vehicles for deliveries rather than commercial trucks making
deliveries, he did not see this as justification for construction of a commercial entrance. Regarding
the question of the septic system, Mr. Miller stated that this issue needed to be addressed because
the current system of a "dry well" was not adequate for the proposed use. Mr. Norris Westover,
applicant, stated that there has never been a problem with the septic system since he bought the
property. Regarding the current entrance, Mr. Westover stated they had deliveries there every day
for three years and there was never any problem; however, he said he would close it if necessary.
There were no citizens present to speak for or against the application. There was no further
discussion, and a motion was made and unanimously approved to recommend approval with the
following conditions:
1. All review agency comments must be complied with at all times.
