Planning Department: Requested uses are permitted with an approved conditional use permit. There was previously a gas station, convenience store and automobile repair facility at this location. The auto repair is continuing to operate at this time but will be discontinued when construction of the new facilities is started. There are several major issues associated with this site such as drainage and storm water management, site access, etc.. These issues will all need to be adequately addressed at the site plan stage. The City of Winchester has agreed to provide sewer service to this site through a private pump station and a force main. The Sanitation Authority has agreed to allow this arrangement until they can provide the service at some later date. Water will be provided by a well and private system. The Fire Marshal has expressed a concern for the availability of water for fire protection and has suggested the bonding of a future hydrant for the location. Bonding this requirement would be holding the applicant hostage for what could be a very long time depending on when public water is extended beyond the Route 37 barrier. Staff believes a condition on the permit requiring the applicant to provide a hydrant if and when public water is available would be adequate. An approved site plan will be required prior to any construction on this site. Staff Recommendation for PC Mtg. of 10/04/95: Approval with the following conditions: A site plan must be submitted and approved prior to any construction on this site. 2. SUMMARY OF 10/4/95 PLANNING COMMISSION ACTION: The Commission had several questions concerning this application. They questioned why this property was being developed with a conditional use permit rather than having the property rezoned since the property is in the Urban Development Area (UDA). The property is zoned Rural Area (RA) and the requested uses are permitted in this zoning district with an approved CUP. There is no restriction on the property 0 Page 3 Hardees/Mobil CUP #012-95 because it is in the UDA. The applicant felt it was more expeditious to go the CUP route rather than request a rezoning. Other questions centered mainly around site development issues such as landscaping, buffers, and screening and how these could be required and implemented after the CUP has been approved. There was a motion to table pending submission of a site plan, but this was defeated. A motion to recommend approval was made and passed with the stipulation that the site development plan be presented to the Commission for their approval prior to issuance of a building permit. One citizen who lives directly opposite the site expressed a concern about hours of operation and whether there would be loudspeakers playing loud music or other noise pollution. Applicant stated that a 24- hour operation was not contemplated at this time and would only be implemented if the market demanded. The citizen was advised there would be no external loudspeakers other than the traditional. intercom used by customers to order at the drive through. The Commission recommends approval with the following conditions and with the stipulation that the site plan be presented to them for their review and approval: A site plan must be submitted and approved prior to any construction on this site. 2. CONDITMNAL USE PERMIT C^INIENTS PROPOSED HARDEE'S RESTAURANT AUGUST 23, 1995 No overall objections to a Conditional Use Permit being issued for this property. However, prior to operation of the business, the existing sub -standard entrances must be upgraded to current commercial standards to allow for safe egress/ingress. Depending on the amount of anticipated traffic, the development may generate right-of-way improvements may also include adjustments/realignment of the existing median cross -over and traffic signalization. The applicant should also be aware this location has a history of having drainage problems. Drainage improvements including possible storm sewer may have to be considered in any entrance improvement .design. Prior to making any further comments, this office will require a complete set of construction site plans which include drainage calculations and trip generation data from the ITE Manual 5th Edition for review. Kiracofe Fire Marshal I have looked at the Conditional Use Permit Application submitted for the Hardee's Restaurant, to be located on Route 50 West (Nothwestern Pike). As you can see, I have made a recommendation that the plan be approved, but, I've asked for a condition of approval due to the lack of public water availability to this site for fire protection. When the Route 50 East corridor began to develop some years ago, the building of individual businesses preceeded the extension of water lines. As the area continued to develop, public water was extended. However, none of the businesses would retrofit the installation of hydrants onto their property, so today we have a serious deficit in fire protection capabilities along this corridor. There are a limited number of hydrants along the north side of Rt. 50 East. For an incident on the south side of Rt. 50 East, the Fire Department must stretch hose lines across seven (7) traffic lanes, thus closing the road. This causes the Virginia State Police many headaches, as you can imagine, and is not an efficient fire ground situation for our people to deal with. The Route 50 West area, adjacent to Route 37, is without a doubt feeling developmental pressures and is surely going to grow in the near future. To avoid creating a situation similiar to that on Route 50 East, I have suggested the "bonding" of a hydrant for this site by the owner/applicant. At the point in time when water lines are extended to the area, the hydrant could then be installed. This could be a condition of the C.U.P. that you are applying for. Similiar conditions should be placed on any other development along this corridor between now and the time public water is availble. Please understand, my concern is not with this particular site or the type of use planned for this site, it is a matter of addressing future fire protection needs for the entire area. To prepare for the future needs of the Fire Department, the necessary fire protection issues on each individual site should be addressed at the time of development. To assist your client with planning for this, may I suggest looking at the current planning taking place for the Round Hill area.
