COMMENTS ON SIGN STUDY
REASON FOR VARIANCE: Applicant states that the sign needs to be
this height to be visible to I-81 traffic before the off ramps and
to traffic that has exited. Applicant states further that the site
is blocked by existing buildings and has no public street direct
access. In addition, applicant states that they do not want to
block or be blocked by the Travelodge sign.
STAFF COMMENTS: The height limit of 35' and sign size limit of
150 square feet is to help ensure an attractive, harmonious
community. Sign height, size, appearance, and frequency of
occurrence has a significant impact on community character, which
is of particular concern in important commercial corridor areas.
The variance must be based on "undue hardship," as required by the
Code of Virginia, and should be consistent with how that standard
has been applied over time. The lack of visibility of a business
sign, while potentially significant to the business, does not meet
the standard for hardship that a strict application of the state's
guidelines would impose. However, the state guidelines have
generally not been applied very strictly by the Board of Zoning
Appeals. Therefore, if a strong case can be made that there is no
reasonable alternative to the requested sign height and size for
providing visibility, it would be consistent to conclude that a
reasonable level of hardship may exist.
The request for this sign height and size is based mostly on a
study of sign visibility at this site performed in August, 1992, by
Elrod & Company Consulting Engineers. Several comments related to
the study follow.
The study notes that a [topographic] survey had not been conducted,
so the existing versus finished grade elevation difference was not
known. It notes further that this information is necessary to
determine the actual sign height needed for adequate visibility.
The applicant has provided no information on finished grade
elevation, so the necessity of a 95' high sign cannot be
determined. Further, the base elevation of the test crane used in
the study was not given, making it more difficult to determine the
elevations achieved for visibility testing. Still, based on the
information provided, comments about whether a 95' high, 281 square
foot sign is necessary can be made.
Based on a topographic survey of the site and surrounding parcels

dated September 1992, the test crane was located about 11.5' below

The applicant states that the sign needs to be this height to be 416H,5
visible to I-81 traffic before the off ramps and to traffic that ro*o
has exited. However, the study shows that even the 35' target is 76sI
visible before the off ramps in both directions and after the off egok,c'
ramp for southbound traffic. The exception noted is for the off FA6C-P C"j
ramp for northbound traffic. For that ramp, the study states:

However, since a traveller who has seen the sign when on the
interstate would know the general direction of the establishment
from the exit ramp, visibility of the sign at that point may not be
critical.
As for concerns about blocking and being blocked by the Travelodge
sign, the photos submitted with the study seem to suggest that a

shorter sign would be as workable as the proposed sign [see study
photos p8, p19, and p2l]. The study does not provide firm
conclusions about the optimal sign height, but says that if the
bottom of the sign were 75' above existing grade, there would not
be a blockage problem. The proposed 12' high sign face would make
the overall height 871, which would be adjusted depending on
finished grade elevation. Luf,6.15'

As for the size of the sign, the study says that the allowable 150 G94pi.
square foot sign would appear to provide very limited readability,
but does not provide much of a basis for that conclusion. In part,
the necessity for a larger sign face is brought about by the height
of the sign. The target sign appears to be a 4' X 8' (32 SF) piece
of plywood. A better test would be to elevate a 150 SF board to
various heights to determine readability and visibility. The
Travelodge sign, which was placed before size restrictions were in
effect, is 270 SF, according to its permit.
In summary, the need for the requested sign height cannot be
determined until finished elevations are determined. Based on
existing elevations, the study does not adequately support the
request in terms of height or size. Tests of various locations on
the site, with higher base elevations, would be very helpful
towards determining whether the requested sign is really necessary.
Assuming lack of visibility were enough of an "undue hardship" to
justify this variance, the lack of visibility would have to be
demonstrated more convincingly than has been done.
STAFF RECOMMENDATIONS: Denial, based on lack of justification.

Pursuant to the target test conducted August 25, 1992 at the
above referenced site, I am pleased to submit the following
information.

I_ The target was raised near the northernmost corner of the
site, approximately 24' from an existing fence (assumed to
be the right-of-way fence), and approximately 130'
southwest from a point where the Travelodge pool fence
meets the right-of-way fence (assumed to be the corner of
the site). This placement would provide at least 10'
setback from the leading edge of the sign cabinet, as
required by county codes.
Regarding target heights, the top of the crane was raised
to approximately 95' and the bottom of the plywood to
approximately 85'. Flags were placed at approximately 75'
' and 35'.
A survey had not been conducted, so the existing versus
' finished grade elevation difference was not known. The
Preliminary Plot Plan contains contour information that was
taken from previous surveys of the entire development, and
it indicates the target location is approximately 10' lower
' than the spot where the Travelodge sign is located, but it
appears to be even greater. It is my understanding you
will have the elevation of these (2) spots checked during
' the survey. This information will be necessary to
determine the actual sign height needed for adequate
visibility.

Southwest Approach on I-81 (Paaes P1 - P14
' The 95', 75', and 35' targets first came into view approximately .9
mile from the overpass. The 35' target became blocked by trees at
approximately .55 mile from the overpass. The 95' and 75' targets
' became blocked by trees at approximately .45 mile from the overpass.
All (3) targets came back into view at approximately .3 mile from the
overpass, and remained in view until reaching the exit ramp with the
exception of interference from the interstate signs and the
' overpass. The correct exit is South 17-East 50-South 522 which exits
beyond the overpass. All (3) targets were visible from the overpass
above the interstate, but became blocked when nearing the
' intersection with Route 522. Only the 95' target was visible from
the intersection, due to blockage by buildings.
Northbound Approach on I-81 (Pages P15 - P30)
The 95' and 75' targets first came into view approximately 2.0 miles
' from the overpass. All targets became blocked by trees at
approximately 1.8 miles from the overpass. The 95' and 75' targets
came back into view approximately .45 mile from the overpass, were
briefly blocked again by trees, but were visible again at
approximately .35 mile from the overpass, and remained in view while
passing the site. The crane boom was directly in line with the
Travelodge sign during this brief viewing window. The 35' target
' came into view at approximately .3 mile from the overpass, which was
almost in front of the site. The 35' target was blocked, when
directly in front of the site, by trees in the right-of-way area.
The 95' and 85' targets came back into view from the exit ramp, when
nearing the intersection with Route 50. Only the 95' target was
visible from the end of the exit ramp, at the traffic light.
Eastbound Approach on Route 50 (Pages P31 - P34)
The 95' and 75' targets became visible at approximately .5 mile from
the overpass, but were blocked intermittently by buildings and trees
while approaching the overpass.
Westbound Approach on Route 50 (Paaes P35 - P41
All (3) targets were briefly visible approximately .4 mile from the
intersection. The 95' target was intermittently visible the
remainder of the way to the intersection. The 95' and 75' targets
were visible from the intersection area. The 35' target was briefly
visible between trees at various points in the intersection area.
Northbound Approach on Route 522 (Pages P42 - P43)
All (3) targets became visible after clearing a curve in the road
approximately .25 mile from the site, and remained in view until
reaching the site. 0

Miscellaneous Locations (Pages P44 - Page P62)
The targets were visible from a limited number of spots on the
exit ramp from westbound Route 50 off of southbound I-81.
(Motorists might accidently exit 313-B, instead of 313-A.)
The 95' and 75' targets were visible from various hotels in the
area including Hampton Inn, Best Western, and Comfort Inn.
All (3) targets were visible from the parking lot of the Apple
Blossom Mall, located directly across the interstate.
Permit Research
I understand the site is zoned B-2 and is outside the city limits
and is governed by county zoning. We contacted Wayne Miller,
Frederick County Zoning Administrator, and obtained a copy of
their zoning ordinance. He reports:
- Maximum pylon sign area and height: Standardized franchised
signs shall not exceed 150 square feet . No structure on the
site, including the sign, shall exceed 35 feet in height above
finished grade.
- Maximum directional sign area and height: Entrance signs shall
not exceed 4 square feet in area and 5 feet in height.
- Setback: The leading edge of freestanding signs shall be
setback at least 10' from lot lines or property lines.
Entrance signs (directionals) may be located in setback areas,
provided they are no more than 5' from the entrance.
- Maximum wall sign area: Signs shall not exceed 20 percent of
the area of the wall to which the sign is attached.
- Quantity of signs: There are moo_guidelines regarding
quanti.t4s . Miller repo its t"he minimum spacing between
business signs is 50 feet, otherwise as long as the signs are
within the guidelines and the site is not cluttered there is no
quantity restrictions.
Permit process: Permits are secured through the Building
' Inspection Department. They report (2) sets of site plans and
sign drawings must be submitted with the application. They
report the fees are $25 per sign and $50 per freestanding sign
over 10' in height. They report the process takes approximately
' one week.

Permit Research continued
Variance process: A variance would be pursued through the
yy Zoning Department. The zoning board meets the third Tuesday of
each month. The application deadline is set each month, and is
normally one month prior to the meeting, to allow time for
' notices to be run. The variance process fee is $70. Miller
states the request must be based upon hardship, and he could
not speculate on the likelihood of receiving variance.
Conclusions
The sign should be oriented perpendicular to the interstate. The
orientation would not only provide visibility to the interstate,
but also to the secondary roads, due to the distance from the sign
' to the interchange, and also the curvature of the roadways.
During the southbound approach, it appears a 35' height sign
allowed by codes would be visible during most of the approach;"
' however, the blockage by trees just prior to the westbound Route
50 exit, and blockage by the overpass just prior to the eastbound
Route 50 exit, prevents visibility at critical points. Also, the
' 35' height would not provide visual separation from the landscape
and therefore readability would be questionable.
' During the northbound approach, the critical question is the
necessary height to provide visibility above the trees, and to
prevent blockage of the Travelodge sign. Base-esereview of the

I also understand this site will require (2) 91 square feet fascia
signs, directional signs (quantity to be determined), and tenant
panels in an existing tenant sign (see pages P61 and P62). Based
upon my understanding of this development, it appears a second
pylon would not be necessary.

in order to promote safety, to protect property values, to create an

of this Chapter.

3-5-1 SIGNS PROHIBITED IN ALL DISTRICTS - The following types of signs
shall be prohibited in all zoning districts:
Animated or flashing signs
Signs painted directly onto the exterior of buildings.
3-5-2 SIGNS ALLOWED IN ALL DISTRICTS - The following types of signs shall
be allowed in all zoning districts:
Signs indicating the names or address of the occupants of a residence
Signs or bulletin boards associated with public institutions, churches,
schools, or community centers
Commemorative plaques and historical markers
Signs identifying civic, social or other non-profit organization
Private road signs
Signs erected or required by a governmental agency
Temporary yard sale sign
Temporary real estate signs
Temporary window signs
Temporary construction signs
Entrance signs for developments or subdivisions
3-5-3 SIGNS ALLOWED IN CERTAIN DISTRICTS - The following types of signs
are allowed only if they are specifically listed under the list of allowed uses
for the zoning districts in which they are located.
Business Signs .
Directional Signs
Cottage Occupation Signs
Freestanding Building Entrance Signs
3-5-4 OFF -PREMISE BUSINESS SIGNS - Signs that advertise a product not
produced or for sale on the lot or parcel on which the sign is located and
signs that advertise a business that is not located on the premises, shall be.
allowed as a conditional use only. Such signs shall be allowed only if a
conditional use permit for that sign has been granted. In considering such a
sign the following standards should be considered.
3-5-4.1 No off -premise business sign shall be allowed in the R-P, Residential
Performance District, the R-4, Planned Community, R-5, Recreational
Community, or the MH-1, Mobile Home Community District.

3-5-4.2 Appropriate separation shall be provided between the off..premise business
sign and surrounding residences and other uses. The Board of Supervisors
may require that' such signs not be visible from surrounding residences.
3-5-4.3 Off -premise business signs shall be limited to a size, scale, and height that
does not detract from surrounding properties and uses.
3-5-4.4 Off -premise business signs shall be properly separated from each other to
avoid clutter along road corridors.
3-5-4.5 Off -premise business signs shall not be of a type that will distract motorists
or cause other safety hazards.
3-5-4.6 Off -premise business signs shall be properly maintained.
3-5-5 SETBACKS - All freestanding signs shall be setback at least ten (10) feet
from lot lines or property boundary lines. Signs that are attached to buildings
shall meet the required setbacks for that building. In general, freestanding
building entrance signs shall not be located in front yard setback areas.
However, freestanding building entrance signs may be located in front yard
setback areas as long as they are no more than five (5) feet from the entrance
to the building or use designated.
3-5-6 MINIMUM SPACING BETWEEN FREESTANDING BUSINESS SIGNS -
The minimum distance separating new from existing freestanding business
signs or separating new freestanding business signs shall be fifty (50) feet.
The Zoning Administrator may allow two signs to be separated by less than
fifty (50) feet in order to allow the signs to share an appropriate location. In
such cases, the two signs shall be separated from other signs by a distance of
fifty (50) feet plus the distance by which the separation between the'two signs
was reduced from the required fifty (50) feet.
3-5-7 HEIGHT - No sign shall exceed the maximum height requirement for the
zoning district in which they are located.. All signs other than business signs
shall be no more than ten(10) feet in height. No freestanding business
entrance sign shall exceed five (5) feet in height.
3-5-8 SIZE - The following restrictions shall apply to the size of signs.
' 3-5-8.1 No business sign or directional sign shall exceed one hundred (100) square
feet in area. Standardized, franchised signs may exceed one hundred (100)
square feet in area but shall not exceed one hundred and fifty (150) square
' feet in area. In the B-1, Neighborhood Business District, no business or
directional sign shall exceed fifty (50) square feet in area.

3-5-10 SIGN PERMITS - Before a sign may be constructed, reconstructed or alter6
a sign permit shall be obtained from the Director of Code Administration.
3-6 ENVIRONMENTAL REQUIREMENTS
In order to protect those areas of a parcel which have environmental
characteristics that make them unsuitable for development, certain portions
of a development shall remain undisturbed or be protected. It is the intention
of this section that the disturbance of such areas by the development process
be limited. It is also the intention of this section that the large portions of the
areas with such environmental characteristics be placed in open space,
environmental easements, the portion of the parcel left undivided, or other
areas where they will remain undisturbed. It is intended that the
environmental conditions on a property be reviewed as the first step in the
planning process before lots or dwellings are located.
3-6-1 The requirements of this section shall apply to land in the following zoning
districts:

REASON FOR VARIANCE: Applicant states that the sign needs to be

to traffic that has exited. Applicant states further that the site
is blocked by existing buildings and has no public street direct
access. In addition, applicant states that they do not want to
block or be blocked by the Travelodge sign.
STAFF COMMENTS: The height limit in this district is 35' and the
sign size limit is 150 square feet for standardized franchise
signs.
The Code of Virginia, as well as the Frederick County Zoning
Ordinance, says that no variance shall be granted unless the
following conditions are met:
a. that the strict application of the ordinance would produce
undue hardship;
b. that such hardship is not shared generally by other properties
in the same zoning district and the same vicinity;
c. that the authorization of the variance will not be of
substantial detriment to adjacent property and that the

character of the district will not be changed by the granting
of the variance; and
d. that the condition or situation of the property concerned is
not of so general or recurring a nature as to make reasonably
practicable the formulation of a general regulation to be
adopted as an amendment to the ordinance.
The application has not shown that these conditions are met in this
case. It is the opinion of the staff that any possible hardship is
generally shared by other similar properties. It is also the case
that this situation has been and is likely to be recurring.
Because of this, under the requirements of the Code of Virginia,
the situation should be addressed through the means of a possible
ordinance amendment rather than a variance.

Dear Mr. Tisinger:
Your letter to Wayne Miller of November 16th regarding the Cracker Barrel sign variance
application has been forwarded to me. I'm writing to let you know that this variance request
is scheduled to be heard at the December 15, 1992 Board of Zoning Appeals meeting, which
starts at 3:30 p.m. in the Old Frederick County Courthouse. As you know, the applicant, or
a representative, must be present at that meeting.
As Wayne Miller discussed with Jim Petry on Wednesday (Nov. 18th), the insert panel in the
Dominion Square directory sign does not need a variance, since the overall size of the existing
sign will not change. Therefore, that aspect of the variance application will be ignored.
We are in receipt of the deposit for the sign that needs to be posted on the property. That sign
must be picked up and put in place by December 8th. I would suggest placing this sign on
Interstate Properties Partnership's adjoining property which fronts Route 522 (parcel 64-A-1F),
since the idea of having the sign is to allow people to become aware of the intended action. The
requirement is for the sign to be visible from the road right-of-way.
Also, in reference to your letter's description of enclosure #3 (site plans), I assume you meant
"sign location" would not change instead of "site location."
I will be available to answer whatever questions you may have during this process.

Interstate Properties Limited Partnership has entered into a
contract with Cracker Barrel Old Country Store to locate a
Cracker Barrel Restaurant on property located just south of the
TraveLodge in Frederick County, Virginia.
A great deal of work has been done in citing the Cracker
Barrel restaurant on this location and, as one of the
prerequisites to making this a reality, Cracker Barrel is
requesting sign variances to let the travelers on Interstate 81
know where they are located and further directional signs off of
Routes 17/50, once the traveler has exited Interstate 81.
Accordingly enclosed please find the following:
1. Application for variances concerning these signs, which
has been executed by Cracker Barrel and by Interstate Properties.
2. A copy of the deed indicating ownership in Interstate
Properties Limited Partnership, which deed is recorded in Deed
Book 556, at Page 706 in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia.
3. Three site plans locating the restaurant facility and
indicating the location of the Interstate 81 sign. Cracker
Barrel would note that the site plan itself may be changed before
submission but that the site -location would not.

4. A survey by G. W. Clifford & Associates of the site, the
property being designated as Parcels 4 and 4B on the survey.
5. Two drawings of the proposed Interstate 81 sign.
6. Two drawings of the panel sign to be placed on the board
located off of Routes 17/50.
7. Checks payable to the Treasurer of Frederick County,
drawn on the account of Cracker Barrel (drafts 399101 and
399692), in the amounts of $45.00 and $25.00, respectively)
8. One copy of a study completed by Elrod & Company of
Murfreesboro, Tennessee indicating the location,,height and
visibility of the Interstate 81 sign.
As you will note, the Cracker Barrel sign approximates the
height, although starting from a different base, of the
TraveLodge sign. It has been placed in such a way that it does
not block, nor is it blocked, by the TraveLodge sign.
Cracker Barrel is quite excited about locating in Frederick
County and to begin business as soon as possible and we would ask
that this request be processed with dispatch.
