VARIANCE: 20' setback variance from the normal road right-of-way
setback requirement of 60" to attach a Fellowship Hall to the
existing sanctuary.
REASON FOR VARIANCE: There is no reasonable alternative for the
location of the proposed addition for the following reasons:
1. Other locations would impair the access to the cemetery
immediately behind the existing structure;
2. The appearance of the existing structure would be damaged
with a different location;
3. This location affords better natural drainage than
alternative locations would; and
4. Other locations would not provide for reasonable
circulation of people due to location of proposed doorways.

STAFF COMMENTS: The existing structure is considered legally
nonconforming to setback requirements and comes to within 16' of
the road right-of-way. The proposed addition, while only coming
within 40' of the road right-of-way, would result in an increase in
the amount of square footage within the required setback, so a
variance would be required.
It does not appear that the authorization of this variance would
produce any substantial detriment to adjacent properties or change
the character of the district. The Ordinance allows for variances
where the strict application of the regulations would unreasonably
restrict the use of the property.

Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
