Reference is made to your letter of November 3, 1992 and my
conversation with Ron Lilly concerning side yard variances on
Lots #116 and #28•
I am indeed sorry that it was necessary for the builder to
apply for a side yard variance. However, I understand how it
happened. I don't think there will be any serious problem if you
grant the variance. I am confident it was just a mistake which
we all regret.
However, I hope the Board of Zoning Appeals will see fit to
grant these two requests as I don't think it will effect the
adjoining property owners. Mr. Lilly and I discussed this at
some length on the telephone and I am taking every possible step
to prevent this from happening again.

Reference is made to our letter of November 9, 1992
concerning the variances on Lots #116 and #28 in Pioneer Heights.
We have studied both of these lots extensively since the
previous letter was written. Wilkins Development Corporation
owns some of the land adjoining these two lots that have asked
for exemptions from the set -back lines.
We have no objection to granting the exemptions and kindly
request that you give United Builders and Granville Kerns
approval. The home on Lot #28 has been completed. The
foundation and basement is finished on Lot #116. It would be a
terrible hardship on these builders if the variances were not
granted.
Hoping the committee will approve these requested.

VARIANCE: 2.4' (2'-511) side and 1.8' (1'-1011) front setback
variance for an existing dwelling.
REASON FOR VARIANCE: Mistake in boundary location. During the
setting of the dwelling the wrong points were used. This was not
determined until the next lot was set for a house. The dwelling
was 95% completed at that time.
STAFF COMMENTS: The required side setback in this district is 101,
which is to provide for adequate light, air, and convenience of
access and facilitate a convenient, attractive, and harmonious
community.
The building permit for the lot in question is for a 50' wide
building on a lot that has just under 60' of street frontage and
flares out to 143' of width at the rear. In order to fit a 50'
wide house and two 10' side setbacks, the lot would have to be 70'
wide where the house is placed. On this lot, that is just possible
at the 35' front setback line. Obviously, the proposed house would
be a tight fit on this lot with only a 35' front setback and would
require very careful placement. The building permit shows a 10'
setback for both the left and right sides.
The applicant's drawing of the existing situation shows a left side
0
setback of 15.4' and a front setback of 33.2'. It appears that the
builder was simply not as careful as he should have been in
ascertaining the property boundaries and locating the foundation.
The Code of Virginia requires that variances be based on "undue
hardship" and the state's guidelines for evaluating "undue
hardship" stipulate that a self-imposed condition, such as improper
placement of a structure on a lot, does not constitute an "undue
hardship". Nor does loss of monetary value or inconvenience to the
applicant.
Staff sees no proper justification for this variance request.
STAFF RECOMMENDATIONS: Denial, based on lack of proper
justification.
