VARIANCE: 15' rear yard variance for proposed house
REASON FOR VARIANCE: Applicant feels that the combination of the
size of the proposed house and the fact that this is a corner lot
prohibits him from placing the structure in the desired location.
STAFF COMMENTS: The Frederick County Zoning Ordinance requires
that structures on corner lots throughout the county provide for
front setbacks wherever the lot abuts a street. Applicant has not
proven that the enforcement of the ordinance will result in an
undue hardship or prevent utilization of the property. Applicant
has not proven that the topography of the land restricts his
placement of the structure. A house with a smaller footprint could
easily be placed on this large lot.
STAFF RECOMMENDATIONS: Denial. Hardship has not been proven and
permitting this would have a definite impact on the adjoining lots.
A reasonable alternative exists to allow utilization of this lot.

AGREEMENT
I (we), the undersigned, do hereby respectfully make
application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right-of-way until the hearing.
