STAFF COMMENTS: Due to the steep slopes at the north end of the
house, without extreme engineering, the addition could not be built
in this location. Applicant wishes to locate the addition at the
rear of the house where the land will allow the placement. To the
rear of the house is an open field, with the nearest structure at
a distance of approximately 300' from the applicant's house. By
allowing this variance it would not alter the character of the
neighborhood.

I (we), the undersigned, do hereby respectfully make
application and. petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance. to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right -of -way -until the hearing.
I hereby certify that all of the statements and information

THIS DEED, made and dated the 11th day of October, 1991, is
by and between KENNETH D. WEBB and TAMBERA S. WEBB, party of the
first part, hereinafter referred to as the Grantor's; and KENNETH
D. WEBB and TAMBERA S. WEBB, parties of the second part,
hereinafter referred to as the Grantees.
WITNESSETH: that for and in consideration of the sum of
ten dollars ($10.00) and other valuable consideration, the
receipt of all of which is hereby acknowledged, the Grantors do
hereby grant and convey with General Warranty of Title unto the
Grantees, in fee simple, as Tenants by the entirety with the
right of Survivorship between them, it being intended that the
part of the one first dying should pass to the survivor, the
following described real estate:
All that certain lot or parcel of land, together
with all easements, appurtenances, and improvements
thereunto belonging, lying and being situate in
Shawnee Magisterial District, Frederick county,
Virginia, and.more particularly described as Lot No.
5, Fairfield Acres Subdivision on that certain plat
and survey drawn by J. R. Nicely, C. L. S., dated
February 25, 1981, and attached to the Deed of
Dedication of said subdivision which is of record in
the Clerk's Office of the*Circuit Court of Frederick
County, Virginia, in Deed Book 545, at Page 806.
BEING the same real estate conveyed to KENNETH D. WEBB
by Deed dated June 23, 1982 and recorded in said
Clerk's Office in Deed Book 548 at Page 728.
This conveyance is made" subject to that certain Deed of
Trust dated the 23rd day of June, 1982 and recorded in said
Clerk's Office in Deed Book 548, at Page 731 from KENNETH D. WEBB
to MARION V. BAKER, Trustee, to secure a promissory note of even
date in the sum of $45,100.00 made by KENNETH D. WEBB and payable
