Attn: Mr. C. William Huntsberry P.O. Box 2298 Winchester, Virginia 22601 Dear Mr. Huntsberry: This letter is to confirm action taken by the Frederick County Board of Zoning Appeals at their meeting of February 18, 1992. Your variance, application #001-92, was approved for a 7.2' side yard variance for an existing structure. This property is located on the west side of U.S. Route 11, approximately 1000 feet south of the B & O railroad crossing, in the Back Creek District, and is identified as GPIN 630000A0000068. Please do not hesitate to call if you have any questions regarding the approval of this variance. i ller nistrator WWM/slk THE COURTHOUSE COMMONS 9 N. Loudoun Street - P.O. MAGISTERIAL DISTRICT: Back Creek PROPERTY ID NUMBER: 630000A0000068 PROPERTY ZONING & USE: Zoned M-1 (Light Industrial), land -use - vacant ADJOINING PROPERTY ZONING & USE: Zoned M-1 (Light Industrial) and M-2 (General Industrial), land use - vacant, business and industrial VARIANCE: 7.2' side yard variance for an existing structure REASON FOR VARIANCE: To permit the applicant's existing structure to conform to the ordinance after a boundary line adjustment. STAFF COMMENTS: Currently, General Electric owns the strip of land between the two parcels of land that Schenck Foods owns. The two companies are selling each other equal portions of land. General Electric will be selling Schenck their portion between the two Schenck parcels and Schenck will sell General Electric the most northern portion of their property. The boundary line will be moved from the south side to the north side of the building.. The existing structure that requires this variance is presently nonconforming on the south side. With the adjustment of the boundary to the north side of the existing building, this building would then be 7.2 feet into.the north side yard setback. The northern adjoining property, which will then be owned by General Electric, will be available to be used as an entrance if required. Granting the approval of this variance would not alter the character of the area. STAFF RECOMMENDATIONS: Approval. i 9 page 1 of 5 APPLICATION FOR VARIANCE IN THE COUNTY OF FREDERICK, VIRGINIA -OFFICE USE ONLY - Variance Application No. Submittal Deadline Submittal Date For the meeting of .►/"Z Fee Paid initials: M502,0 Sign Deposit y& Sign Return Date: 1.
