REASON FOR VARIANCE: House was constructed in violation of the setback requirements
of the Frederick County Zoning Ordinance
STAFF COMMENTS: Applicant believed that the rear portion of the lot would be the side
because a right-of-way would be constructed at the rear portion of the lot. The plat for the
subdivision did not indicate this right-of-way. The plan for the building permit, submitted in
1989, indicated that the house would be constructed fifty-eight (58) feet from the rear property
line. The house was then constructed twenty-three (23) feet from the rear property line.
STAFF RECOMMENDATIONS: Denial. This denial is based on the premise that no
hardship has been proven by the applicant
