STAFF COMMENTS: The owner built the structure based on what he believed to be the correct rear yard property pin. location. He attempted to keep back seven feet from the side property line. The front portion of the building is seven feet from the property line, but the rear portion of the building is four inches in the side setback zone. Acquisition of required building permit may have helped the owner in avoiding the violation. The existing house and tool shed on the property are legal nonconforming structures which were built pre -ordinance and are not a factor of this variance request.
